AN ORDINANCE OF THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, AMENDING CHAPTER 62
OF THE CITY CODE TO INCREASE THE CITY MANAGER'S
GENERAL EXPENDITURE AUTHORITY TO ENTER INTO
PURCHASES OF, OR CONTRACTS FOR, MATERIALS,
SUPPLIES, EQUIPMENT, IMPROVEMENTS OR SERVICES
FOR PURCHASES UP TO TWENTY FIVE THOUSAND
DOLLARS ($25,000.00); PROVIDING FOR REPEALER;
PROVIDING FOR SEVERABILITY; PROVIDING FOR
INCLUSION IN THE CODE; PROVIDING FOR AN EFFECTIVE
DATE AND APPLICABILITY.
WHEREAS, Chapter 62 of the Code of Ordinances of the City of Sunny Isles Beach
establishes the purchasing procedures by the City to maximize the purchasing value of public
funds in procurement, and to provide safeguards for maintaining a procurement system of quality
and integrity; and
WHEREAS, City staff has reevaluated the City's purchasing procedures to determine
changes to the City's procurement processes that would increase staff efficiency and reduce the
City's costs of procurement and contracting; and
WHEREAS, Section 62 -6 of the City Code currently requires the City Commission to
approve all purchases of, or contracts for, materials, supplies, equipment, improvements or
services where the total amount to be expended is in excess of $10,000.00 (ten thousand dollars);
and
WHEREAS, the City wishes to amend Section 62 -6 of the City Code to increase the City
Manager's general expenditure authority for materials, supplies, equipment, improvements or
services for which funds are provided in the budget, up to $25,000.00 (twenty five thousand
dollars) without submittal to the City Commission.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby
ratified and confirmed as being true and correct and are hereby made a specific part by this
Ordinance upon adoption hereof.
Section 2. Amendment. Section 62 -6 of the City Code is amended to read as follows:
§ 62 -6. Purchasing limitations; effect on competitive bidding requirement.

A. Purchases less than $2,500. Purchases of, or contracts for, materials, supplies,
equipment, improvements or services for which funds are provided in the budget,
where the total amount to be expended is not in excess of $2,500 may be made or
entered into by the City Manager without submittal to the City Commission and
without competitive bidding. Single purchases or contracts in excess of $2,500 shall
not be broken down to amounts less than $2,500 to avoid the requirements of this
section.
B. Purchases more than $2,500 but less than $10,000 $25,000. Purchases of, or contracts
for, materials, supplies, equipment, improvements or services for which funds are
provided in the budget, where the total amount to be expended is in excess of $2,500,
but which do not exceed $10,000 $25,000 may be made, or entered into, by the City
Manager without submittal to the City Commission, but shall require compliance with
the competitive bidding requirements set forth in § 62 -7 of this chapter. Single
purchases or contracts in excess of $10000 $25,000 shall not be broken down to
amounts less than $10,000 $25,000 to avoid the requirements of this section.
C. Purchases in excess of $1-0,000 $25,000. The City Commission shall approve all
purchases of or contracts for materials, supplies, equipment, public improvements or
services where the total amount to be expended is more than $1000 $25,000.
D. Purchases in excess of $25,000. For purchases in excess of $25,000 the City
Commission shall follow the formal provisions contained in § 62 -7 below.
E. The City Manager may not purchase or contract for any item or service which exceeds
any budget appropriation until such a time the City Commission amends the budget to
increase the appropriation to the applicable level.
Section 3. Severability. The provisions of this Ordinance are declared to be severable
and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be
invalid or unconstitutional, such decision shall not affect the validity of the remaining sections,
sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the
legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part.
Section 4. Inclusion in the Code. It is the intention of the Commission, and it is
hereby ordained, that the provisions of this Ordinance shall become and be made a part of the
code of the City of Sunny Isles Beach, Florida; and that the sections of this Ordinance may be
renumbered or relettered to accomplish such intentions; and that the word "ordinance" shall be
changed to "section" or other appropriate word, as required.
Section 5. Repealer. All ordinances or part of ordinances in conflict herewith be and
the same are hereby repealed.
Section 6. Effective Date and Applicability. This Ordinance shall be effective upon
adoption on second reading.

Revision of City Code Section 62 -6 to increase the City Manager's
general expenditure authority from up to $10,000 to up to $25,000.
RECOMMENDATION:
Staff recommends the City Commission approve the Second Reading of the Ordinance
which updates City Code Section 62 -6.
REASONS:
Currently, cumulative purchases of, or contracts for, materials, supplies, equipment,
improvements or services for which funds are provided for in the budget, with any one
vendor that exceeds $10,000 requires Commission approval. Since the $10,000 limit was
established, the City has grown significantly in staffing and in needs to service day to day
operations and our residents. As a result more common practice items exceed the $10,000
limit such as purchases of City uniforms, facility security and monitoring, City
newspaper /newsletter publishing, waste management services, replacement of small
dollar equipment with has a cumulative total exceeding $10,000, leased vehicles and
special instructors. Approving this ordinance will reduce one additional step required for
employees which will enhance the efficiency of day to day operations.
