Williams, Jr. et al. v Landmark Companies, Inc. et al. Case No: 04 -00568 CA 23 D /A: June 16, 2002 Sun -Tech Engineering (STE) was the civil engineering consultant for Landmark Companies, Inc. Landmark Companies, Inc. was the developer of a low- income apartment complex in Dade County. The case involved the drowning of a 4 -year old boy on June 16, 2002 which took place in a canal adjacent to the project. The canal pre -dates the development. STE was under contract with the developer responsible for on -site infrastructure i.e., water, sewer, paving, grading and drainage. The child and his parents were tenants at the development. The child's parents sued the developer, Architect, STE and the general contractor for negligence arising from breaches of the following legal duties: • Duty to provide a fence along the canal • Duty to provide a less steep slope of the canal bank • Duty to place a tot lot and sidewalk a greater distance from the canal • Duty to provide a working gate latch for the tot lot perimeter fence • Duty to not allow tenants to move into the development until after safety features were completed The Architect, Engineer and General Contract argued that they had no contractual obligation to work in the canal right -of -way except to construct two head walls for a drainage outfall and shouldn't be included in the suit. They were all kept in the case however and the case settled out of court mid 2009.
