A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, REGARDING THE
APPLICATION FOR TEMPORARY USE OF FOOD TRUCK
SERVICE AT SOLE CONDOMINIUM/HOTEL LOCATED AT
17315 COLLINS AVENUE; PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the City has the authority to approve certain temporary uses within certain
zoning districts; and
WHEREAS, the City Commission wishes to permit on a temporary basis the food truck
service for Sole condominium/hotel.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Temporary Use and Conditions. The City Commission hereby approves
temporary food truck service at the Sole Condominium/Hotel at 17315 Collins Avenue to be
located in the area designated in the plans submitted to the City Commission at the .public
meeting on June 21, 2012, for a period not to exceed Ninety (90) days. The Applicant, 17315
Collins Avenue, LLC, has to obtain a permit to install service station for the catering truck. This
approval shall be null and void if Sole fails to comply with the conditions herein.
Section 2. Effective Date. This Resolution shall become effective upon adoption.

Dear Sharon,
WEB We respectfully request your consideration for the use of the Bite
www.soleoto.com Food Truck at Sole on the Ocean as a temporary food service
solution. Providing food service to our guests is essential to our
operations and a timely approval would allow us to do so without
disruption. Disrupting this service would greatly harm the
reputation and future operations of the hotel, especially when
dissatisfied guests have the ability to post their comments on
websites with wide readership such as Trip Advisor, Yelp, Google
and Expedia. The use of the food truck is only intended to be
temporary until the restaurant kitchen is constructed and
operational.
Our short term plan is to have a Fully Operational Restaurant
Kitchen. We have finalized an agreement with a celebrity chef who
has restaurants in Miami (both hotel and freestanding) and New
York City. The Food Truck is operated by the same individuals who
will be operating the restaurant at Sole once the kitchen is
finalized. Not only does The Food Truck operation provide the
hotel with an essential service, it also allows these operators to
better understand our guest profile, and allows them to start laying
the groundwork in place for the restaurant operations in advance.
We are currently targeting a restaurant start date of October, 2012.
Quality Food Service is Essential to our Operations. Sole
previously had working relationships with a a series of local area
restaurant to provide food service to guests. However, due to the
logistical differences of operating a hotel restaurant versus a stand
along restaurant, as well as
competing interests between the local area restaurants own
patrons in the restaurant versus outside patrons from the hotel, we
had many dissatisfied guests and found it necessary to find
another solution for food service.
The Bite LLC Food truck is an award winning gourmet mobile food
service. Its awards include best burger in south Florida 2 years in a
row. Due to the low overhead for the food truck and its ability to be
located on site, Bite is able to operate at the hours required by a
hotel operation and to provide timely food service to guests.
The Food Truck is fully self contained. The truck has containers for
its own fresh water and a tank for dirty water. Grease bins are
used to dispose old fryer oil. The Food Truck is licensed by State of
Florida Dept of Health.
The truck is not open to the general public. It is not visible from the
street or public right of way. It is not seen by hotel guests. The
hours of operation are 11:30 AM - 10:00 PM. The truck is fully
mobile and can move off site every day if necessary.
For these reasons, we do not believe that the Bite food truck will
have a negative impact on the city of Sunny Isles. We respectfully
request that you approve the use of the Bite to provide food
service to Sole on the Ocean on a temporary basis as
contemplated above.

Attached for your consideration is a Resolution approving a request for temporary use of food
truck service.

The Applicant is requesting approval for the temporary placement of a food truck to be located at
17315 Collins Avenue until October 2012. The food truck will serve as a short term solution to
provide food to guests at the hotel until the restaurant kitchen is constructed and operational.
Staff recommends the following conditions:
(1) Remove food truck and service within one (1) month of approved temporary use.
(2) Obtain electrical permit to install an electrical service station for the food truck.
REASONS:
Pursuant to section 265 -14, the City may issue a pemlit for a temporary use or structure not
permitted in a particular zoning district.
