A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, APPROVING THE SECOND
AMENDMENT TO AGREEMENT WITH BEISWENGER, HOCH
AND ASSOCIATES, INC. (BH &A), TO PROVIDE POST DESIGN
SERVICES FOR THE SUNNY ISLES BEACH/NEWPORT
FISHING PIER, IN AN AMOUNT NOT TO EXCEED SEVEN
THOUSAND THREE HUNDRED TEN DOLLARS ($7,310.00),
ATTACHED HERETO AS EXHIBIT "A"; RESCINDING
RESOLUTION NO. 2012 -1910 ADOPTED ON MAY 10, 2012;
AUTHORIZING THE MAYOR TO EXECUTE SAID
AGREEMENT; AUTHORIZING THE CITY MANAGER TO DO
ALL THINGS NECESSARY TO EFFECTUATE THIS
RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on March 17, 2011 via Resolution No. 2011 -1693, the City Commission
ratified an Agreement with Beiswenger, Hoch and Associates to provide post design services for
the Sunny Isles Beach Pier a/k/a Newport Fishing Pier located at 16701 Collins Avenue, in a total
amount not to exceed Forty -One Thousand Dollars ($41,000.00); and
WHEREAS, on May 10, 2012 via Resolution No. 2012 -1911, the City Commission
approved the First Amendment to Agreement with Beiswenger, Hoch and Associates, Inc., to
provide post design services for the Sunny Isles Beach/Newport Fishing Pier, in an amount not
to exceed Eleven Thousand Three Hundred Thirty -Seven Dollars and Fifty Cents ($11,337.50),
and authorized a contribution of Ten Thousand Dollars ($10,000.00) as the City's commitment
of 25% of the cost for revision to plans for restaurant area; and
WHEREAS, on May 10, 2012 via Resolution No. 2012 -1910 the City Commission
approved an Agreement with La Perla Condominium Association, Inc., for temporary use of
private property located at 16699 Collins Avenue for the Newport Pier Reconstruction Project
subject to certain conditions; and
WHEREAS, the original design for the reconstructed Pier included two undesirable
elements: the western edge of the pier design extended beyond the footprint of the original pier,
and the design change corrects this issue and eliminates the need for the agreement with La Perla
Condominium, and the redesign will move the wiring into the building on the Pier, eliminating
the need for an electrical box on the beach next to the northern staircase of the Pier; and
WHEREAS, Beiswenger, Hoch and Associates has expressed their ability and desire to
provide these services subject to the terms and conditions contained within the Second
Amendment to Agreement, and submitted a proposal to provide these services for the Sunny Isles
Beach/Newport Pier Project; and
WHEREAS, the City wishes to approve the Second Amendment to Agreement with
Beiswenger, Hoch and Associates to provide these services for the Sunny Isles Beach/Newport
Fishing Pier, in an amount not to exceed Seven Thousand Three Hundred Ten Dollars
($7,310.00), attached hereto as Exhibit "A ".

NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Approving the Second Amendment to Agreement. The Second Amendment to
Agreement with Beiswenger, Hoch and Associates, Inc., to provide post design services for the
Sunny Isles Beach/Newport Fishing Pier, in an amount not to exceed Seven Thousand Three
Hundred Ten Dollars ($7,310.00), attached hereto as Exhibit "A ", be and the same, is hereby
approved.
Section 2. Rescind Resolution No. 2012 -1910. Resolution No. 2012 -1910 approving an
Agreement between the City and La Perla Condominium Association, Inc., for temporary use of
private property located at 16699 Collins Avenue for the Newport Pier Reconstruction Project,
is hereby rescinded.
Section 3. Authorization of Mayor. The Mayor is hereby authorized to execute said
Agreement.
Section 4. Authorization of City Manager. The City Manager is hereby authorized to do all
things necessary to effectuate this Resolution.
Section 5. Effective Date. This Resolution will become effective upon adoption.

SECOND AMENDMENT TO THE AGREEMENT BETWEEN

CONTRACT NO. C1112 -048
This Second Amendment to the Agreement between the City of Sunny Isles Beach
( "City ") and Beiswenger, Hoch and Associates, Inc., ( "Consultant ") executed this day of
, 2012, is made a part of the original Agreement, C 1011 -031 ( "Agreement ")
approved by Resolution No. 2011 -1693 on March 17, 2011, and incorporated herein by
reference, between the City and Consultant, a business corporation licensed in the State of
Florida, whose Federal Identification # is The City and
Consultant hereby agree as follows:
1. ADDITIONAL SERVICES TO BE PERFORMED: The scope of services, as set
forth in Section 2 of the original Agreement between the parties, is hereby amended to include
additional engineering services for the Sunny Isles Beach Fishing Pier Restaurant, as more
particularly described in Attachment "A ", which is attached hereto and incorporated herein by
reference.
2. COST: The payment to the Consultant, as set forth in Section 4 of the original
Agreement, is hereby amended to include additional compensation for the additional services to
be performed, in an amount not to exceed Seven Thousand Three Hundred Ten Dollars
($7,310.00).
3. OTHER PROVISIONS REMAIN IN EFFECT: Except as specifically modified
herein, all terms and conditions of the original Agreement between the parties, approved by
Resolution No. 2011 -1693 on March 17, 2011, and the First Amendment to the Agreement,
approved by Resolution No. 2012 -1911 on May 10, 2012, shall remain in full force and effect.
IN WITNESS WHEREOF, the parties hereto have executed this document as of the date
mentioned above.

We will begin to provide Additional Mechanical, Electrical, Plumbing and Fire Protection
Engineering services for the Sunny Isles Fishing Pier project upon receipt of this
authorization to proceed. We will provide these additional services for the lump sum fee
of:
$2,750
Our fee for these services is based on the terms and conditions in the AIA - C401 -2007
Architect/Consultant agreement.
The additional services are to provide engineering for the revisions requested to move
the electrical room and meters to the second floor, and make minor modifications to the
first floor kitchen as discussed in our meeting on 18 May 2012.
Approval of this agreement constitutes authorization for project Caine to proceed with
these services. Authorization by the architect to proceed with this agreement constitutes
a commitment to pay the project Caine fee and represents that the architect has
received authorization from its client. After signing in the space provided, retain the
original and return a copy to our office for our files.

MEMORANDUM

RE: Approving Second Change Order to Agreement with Beiswenger, Hoch
and Associates, Inc. (BH &A), to Provide Post Design Services for the
Sunny Isles Beach /Newport Fishing Pier in the amount of $7,310.
RECOMMENDATION:
Approve the change order related to design changes of the western edge of the Pier and to
the electrical system.
REASONS:
The original design of the reconstructed Pier included two undesirable elements. The
western edge of the pier design extended beyond the footprint of the original pier. The
design change corrects this issue and also eliminates the need for the agreement with the
La Perla Condiminium that the Commission discussed last month.
The other design issue is related to the electrical system. It included an exterior electrical
box that was to be placed on the beach next to the northern staircase of the pier. The
redesign will move all of the wiring intended for this box into the building on the pier,
eliminating both an aesthetic eyesore and a future maintenance headache.
FUNDING SOURCE:
Funding is available in account number 35- 600 -5670.
