HomeMy WebLinkAboutZoning Resolution 17-Z-161 RESOLUTION NO. 17-Z - I(p 1 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH,FLORIDA, ("CITY")APPROVING A SITE PLAN APPLICATION SUBMITTED BY CENTURY TOWERS ASSOCIATES, LLP (THE "APPLICANT") FOR TWO RENTAL APARTMENT TOWERS, CONSISTING OF 127 DWELLING UNITS IN EACH TOWER, A PARKING GARAGE OF 860 PARKING SPACES, AND A REMODELED EXISTING TOWER WITH 335 DWELLING UNITS; PROVIDING THE CITY MANAGER WITH THE AUTHORITY TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEALER; PROVIDING FOR AN EFFECTIVE DATE. I. RECITALS WHEREAS, the Applicant Century Towers Associates, LLP (the "Applicant") has submitted a site plan application(PZ2016-12) to the City of Sunny Isles Beach, Florida requesting the following: 1. Pursuant to Section 265-18 of the City of Sunny Isles Beach Land Development Regulations,the Applicant is requesting a site plan approval for two rental apartment towers of 190 feet in height with 127 dwelling units each and an enclosed parking garage with 860 parking spaces. 2. Pursuant to Section 265-15 of the City of Sunny Isles Beach Land Development Regulations, the Applicant is requesting a variance of Section 265-34(D)(6)(a) to permit building separation to be 33 feet and 7 inches where 50 feet separation is required. 3. Pursuant to Section 265-15 of the City of Sunny Isles Beach Land Development Regulations, the Applicant is requesting a variance of Section 265-34(D)(4)(c)[3] to permit 16 feet and 11 inches to the north garage side setback where 25 feet side setback is required. 4. Pursuant to Section 265-15 of the City of Sunny Isles Beach Land Development Regulations, the Applicant is requesting a variance of Section 265-34(D)(4)(c)[3] to permit 13 feet and 2 inches to the south garage side setback where 25 feet side setback is required. 5. Pursuant to Section 265-15 of the City of Sunny Isles Beach Land Development Regulations, the Applicant is requesting a variance of Section 265-34(D)(4)(c)[3] to permit 3 feet and 2 inches to the north and south tower porte-cochere side setback where 25 feet side setback is required. 6. Pursuant to Section 265-63.3 (G) of the City of Sunny Isles Beach Land Development Regulations, the Applicant is requesting the use of graphics and murals on a temporary construction fencing. 17-Z- 15920 Collins Ave R 100 Kings Point Drive 1 7. Pursuant to Section 265-11 N. (2) of the City of Sunny Isles Beach Land Development Regulations, the Applicant is requesting 12 additional months beyond the 24-month time frame for a total of 36 months to obtain a building permit. Legal Description: PARCEL 1 (SOUTH PARCEL): That portion of Lot 83, of TATUMS OCEAN BEACH PARK SUBDIVISION, according to the Plat thereof, as recorded In Plat Book 5, Page 35, of the Public Records of Miami-Dade County, Florida, which lies between the Westerly Right of Way line of State Road A-1-A, as the same as shown on the Plat thereof recorded In Plat Book 45,Page 39,of the Public Records of Miami-Dade County, Florida, and the Easterly high water line of Ocean Canal, as the same is shown on the Plat of"ROYAL PALM ISLAND",according to the Plat thereof,as recorded In Plat Book 40,Page 3, of the Public Records of Miami-Dade County, Florida. ADDRESS: 15920 Collins Avenue and 100 Kings Point Drive FOLIO: 31-2214-013-0010, 31-2214-010-0060 and 31-2214-008-0080 WHEREAS, on February 16, 2017, the City Commission conducted a public hearing on this site plan application; and WHEREAS, the public hearing of the City Commission was advertised and held as required by law, all interested parties concerned in the matter were heard, and due and proper consideration was given to the matter and to the positive recommendation contained in the City's Community Development Department Review Report; and WHEREAS, notice was provided to all interested parties regarding the site plan modification application; and WHEREAS, the City Commission reviewed the site plan application, the written and oral recommendations of the Zoning Administrator of the Community Development Department, including the recommended conditions, and finds substantial competent evidence to support a showing by the Applicant that the request for site plan application approval is in compliance with the Land Development Regulations and the Comprehensive Master Plan of the City and maintains the basic intent and purpose of the zoning, subdivision or other land use regulations, which is to protect the general welfare of the public, particularly as it affects the stability and appearance of the community; and, further finds that said request should be granted, subject to the conditions described herein. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: II. INCORPORATION OF RECITALS All recitals above are incorporated into the body of this Resolution as if same were fully set forth herein. • 17-Z- 15920 Collins Ave& 100 Kings Point Drive 5 III. FINDINGS AND CONCLUSIONS: Based on an analysis of the application and the standards for approval for a site plan application under the Land Development Regulations, the City Commission makes the following findings and conclusions: A. The Applicant's request for approval for a residential condominium tower with north and a south rental apartment towers, consisting of 127 dwelling units in each tower, a parking garage of 860 parking spaces, and a remodeled existing tower with 335 dwelling units, is in compliance with the Land Development Regulations and the Comprehensive Plan of the City of Sunny Isles Beach. IV. APPROVALS A. The Applicant's request for site plan approval for two rental apartment towers of 190 feet in height with 127 dwelling units each and an enclosed parking garage with 860 parking spaces is hereby approved subject to all conditions set forth in Section V below. B. The Applicant's request for a variance to permit building separation to be 33 feet and 7 inches where 50 feet separation is required is hereby approved subject to all conditions set forth in Section V below. C. The Applicant's request for a variance to permit 16 feet and 11 inches to the north garage side setback where 25 feet side setback is required is hereby approved subject to all conditions set forth in Section V below. D. The Applicant's request for a variance to permit 13 feet and 2 inches to the south garage side setback where 25 feet side setback is required is hereby approved subject to all conditions set forth in Section V below. E. The Applicant's request for a variance to permit 3 feet and 2 inches to the north and south tower porte-cochere side setback where 25 feet side setback is required is hereby approved subject to all conditions set forth in Section V below. F. The Applicant's request for the use of graphics and murals on a temporary construction fencing is hereby approved subject to all conditions set forth in Section V below. G. V. CONDITIONS A. Conditions to be completed before demolition, below grade or building permits are issued. I 7-Z- 15920 Collins Ave& 100 Kings Point Drive 6 1. That the plans in the approval be substantially in accordance with that submitted for public hearing, which are entitled "Marina del Mar II", prepared by MSA Architects stamped received Jan. 31, 2017 consisting of 26 sheets, and Landscaping prepared by Architectural Alliance Landscape stamped received Jan. 31, 2017 consisting of 14 sheets; and Civil prepared by SRS Engineering Inc. stamped received Jan. 31, 2017 consisting of 11 sheets; and survey consisting of 8 sheets prepared by Maser Consulting P.A. a/k/a Triangle Surveying and Mapping stamped received Jan. 31, 2017. 2. If applicable, a Miami-Dade County tree removal permit must be secured and attached to the landscape permit application prior to demolition. 3. That palms along Collins Avenue beat least 12' clear-wood Medjool Palms to be consistent with the City Streetscape Master Plan. 4. That the Applicant provides the Lighting/Photometric Plan prior to building permit. 5. That the Applicant provides the Signage and Pavement Marking Plan prior to building permit. 6. Upon the submittal of an application for a building permit, the plans submitted shall be approved by the Community Development Department and be consistent with the specific site plan approved by the City Commission. Plans shall include all the required elements of the site plan pursuant to the City's Land Development Regulations and recommendations. Should compliance with recommendations result in a change that would not be considered "minor" in accordance with Section 265-18 of the City Code; the Applicant shall be required to obtain another approval of the City Commission. 7. That the Applicant acknowledges and agrees that the property located at 15920 Collins Avenue and 100 Kings Point Drive and legally described herein shall be considered one plot and parcel of land and that said property shall be considered as one plot and.parcel of land for development purposes under the Zoning Code of the City. The Applicant shall submit a Declaration of Restrictive Covenants in lieu of Unity of Title in a form acceptable to the City Attorney. The Declaration of Restrictions shall be recorded in the public records of Miami-Dade County at the Applicants expense. 8. That a plot plan be submitted to the Community Development Department for review. The plot plan shall include all easements proffered by the Applicant to the City, including but not limited to (i) the 0.407 acre open space area along the south side of Kings Point Drive fronting Collins Avenue; (ii) a fifteen (15) feet baywalk easement along north and west borders of north property; (iii) a fifteen (15) feet baywalk easement along south and west borders of south property; and (iv) three (3) bus stop shelter easements. 9. That the Applicant submit a Declaration of Restrictions and a perpetual open space easement in recordable form acceptable to the Community Development Department and acceptable to the City Attorney prior to submittal for an application for building permit, which proffers: (i) the 0.407 acre open space area along the south side of Kings Point 17-Z-_ 15920 Collins Ave R 100 Kings Point Drive 7 fronting Collins Avenue; (ii) a fifteen (15) foot baywalk easement along north and west borders of north property; (iii) a fifteen (15) foot baywalk easement along south and west borders of south property; (iv) three (3) bus stop shelter easements; and (v) the three (3) dry model units, one in each tower, to be used solely for marketing purposes. The Declaration of Restrictions shall include the easements proffered to the City. The maintenance of the easements shall be the responsibility of the Applicant and Applicant shall ensure that the baywalk easement are opened to the public at all times. 10. That the Applicant shall install the improvements including but not limited to decorative pavers, benches, lighting, garbage containers, signage, landscaping, and bicycle racks on the Baywalk Easements. The Applicant shall design all improvements on the Baywalk Easements. The final design is subject to the approval of the City Manager or Designee. 11. That the Applicant shall not provide a lease agreement for a term of less than six (6) _ months. The Applicant shall not permit lessees to sublease their dwelling units for a term of less than six (6)months. The Applicant shall provide to the City with a covenant running with the land that will impose the short term restriction discussed herein. 12. That the Applicant comply with all conditions and permit requirements, including but not limited to Miami-Dade County, including environmental conditions and permitting, the Fire and Water and Sewer Departments, Florida Department of Environmental Protection (DEP), Florida Department of Transportation (FDOT), and the Federal Aviation Administration (FAA). 13. No building permits shall be issued (except for demolition and sales trailers) unless the Applicant has submitted all documents referred to under this approval and shall have paid all impact fees, bonuses, and Transfer of Development Rights (if applicable), professional fees (as per Section 265-11 and such other applicable Land Development Regulations)due to the City. 14. That Applicant shall obtain concurrency review approval from Miami-Dade County School Board. 15. The Applicant shall pay all fees related to the review of the application described herein and shall have paid all other fees due to the City. 16. That the Applicant shall pay the required contribution to the Art in Public Places Fund in the amount equal to 1% of the construction cost but not to exceed $365,000.00 in lieu of the required artwork. The Applicant shall provide the City with a non-refundable deposit in the amount of ten percent (10%) of the contribution amount of$365,000.00. The total amount of the deposit is $36,500.00. Failure to pay the required deposit within the three (3)working days of approval of the site plan application shall result in an automatic voiding of the City Commission site plan approval. 17-Z- 15920 Collins Ave& 100 Kings Point Drive 8 17. That the Applicant shall address comments provided by City's Traffic Consultant regarding Traffic and vehicular issues. The City Manager or his designee shall review and provide additional comments if necessary. 18. That the Applicant shall address comments provided by City's Landscaping Architect regarding landscaping plans submitted during site plan review process. The City Manager or his designee shall review and provide additional comments if necessary. 19. That the Applicant shall address comments provided by City's Civil Engineer regarding civil plans submitted during site plan review process. The City Manager or his designee shall review and provide additional comments if necessary. 20. That if the Applicant provides artwork in compliance with the City Code prior building. permitting,the Applicant is not required to submit the balance of the monetary contribution to meet the minimum monetary requirement. Any artwork must be presented and approved by the City Commission. 21. If approved, the Applicant must submit a separate building permit prior any installation of murals or graphics on temporary construction fencing to be approved administratively by the City Manager or designee. 22. That the Applicant shall provide in perpetuity thirty five (35)workforce housing dwelling units within the remodeled apartment tower in accordance with the City's Workforce Ordinance. The Applicant shall specifically designate the units and their location in the plans and in the restrictive covenant. The Applicant shall be responsible for ensuring that the units are affordable based on income guidelines established by the City for the units. The units shall not be rented as market rate pricing by the Applicant or any other institution. 23. That the Applicant shall revise the garage opening by providing finishes that reduce the lighting exposure and view from the interior of the garage. The final exterior design of the garage shall be approved by the City Manager prior issuance of a building permitting. B. Conditions to be completed before any certificate of Occupancy is issued. 24. That the Applicant shall underground all utility lines in front of the proposed project apartment complex, and at the time of underground utility lines for the project, the Applicant shall also install decorative sidewalk pavers consistent with decorative sidewalk pavers installed by the City on the west side of Collins Avenue. The decorative sidewalks shall be installed at the baywalk easements. 25. If the Applicant proposed artwork does not meet the minimum monetary requirement, as determined by the City, the owner must submit the balance of funds payable to the City prior to the issuance of a Certificate of Occupancy. 26. Under Section 267-4, the City Manager and/or his/her designee in review of any application, may refer any such application presented to it to such engineering, planning, 17-Z- 15920 Collins Ave& 100 Kings Point Drive 9 legal, technical, or environmental consultant or professional(s) employed by the City as the Manager shall deem reasonably necessary to enable him/her to review such application as required by law. Charges made by such consultants or professionals shall be in accord with the charges customarily made for such services in Miami-Dade County, and pursuant to an existing contractual agreement by and between the City and such consultant. Charges made by the City shall be in accord with the hourly rates charged by such consultants or hourly rates of employed professionals and shall be paid within 30 days on submission of City voucher. 27. At the time of submission of any application or thereafter, it is required that an escrow account be established, from which withdrawals shall be made to reimburse the City for the cost of professional review services, if any. The Applicant shall then provide funds to the City for deposit into such account in an amount to be determined by the City Manager, based on his/her evaluation of the nature and complexity of the application. The Applicant shall be provided with copies of any City voucher for such services as they are submitted to the City. When the balance in such escrow is reduced to one-third (1/3) of its initial amount, the applicant shall deposit additional funds into such account to bring its balance up to the amount of the initial deposit. If such account is not replenished within thirty-days (30) after the applicant is notified, in writing, of the requirements for such additional deposit,the City may suspend its review of the application. An application shall be deemed incomplete if any amount shall be outstanding. A building permit or Certificate of Use and Certificate of Occupancy shall not be issued unless all professional review fees charged in connection with the applicant's project have been reimbursed to the City. Once all pertinent charges have been paid, the City shall refund to the Applicant any funds remaining on deposit. 28. The Applicant shall furnish payment and performance bond in an amount determined by the Building Official to ensure Applicant's performance of public improvements required pursuant to site plan approval and in accordance with recommendations of the Building Official after review of construction plans submitted based on development approval granted herein. Any such bond shall be issued by a surety having a minimum rating of A- 1 in the Best's Key Rating Guide, Property/Casualty Edition, shall be subject to the approval of the City, and shall provide that "this bond may not be cancelled or allowed to lapse until 30 days after receipt by the City, by certified mail, return receipt requested, of written notice from the issuer of the bond of intent to cancel or not to renew". As improvements are made the City, within its discretion, may reduce or eliminate the bond amount. These rights reserved by the City with respect to any construction bond established pursuant to this section are in addition to all other rights and remedies the City may have under this Resolution, in law or in equity. C. Other conditions. 29. That the Applicant obtains a Certificate of Occupancy and a Certificate of Use from the City upon compliance with all terms and conditions. That the approved site plan shall remain valid for a period of 36-months(Per Commission approval) from the date of approval. The Applicant agrees to provide a monetary contribution of $365,000. 16. 265-11 (N)(2) General development provisions - Time periods/expiration - development order : Requires City Commission Approval. Allowed: 24 months Requested: 36 months 17. Pursuant to Section 265-15 Variances. A variance shall be granted only where competent and substantial evidence presented in the particular case shows that all of the following are met: (1) Special conditions and circumstances exist which are peculiar to the land, structure, or building involved and which are not applicable to other lands, structures or buildings in the same zoning district; 9 U:\PLANNING&ZONING2008\ZONENG HEARING-APPLICATIONS\2016 APPLICATION\PZ2016-12 Marina Del Mar II Applicant: Parking Garage Setbacks: The Property is unique because it is composed of irregularly shaped parcels on one of the City's finger islands which narrows towards the middle of the lot, where the setback relief is being requested. The survey shows that the Property narrows to approximately 155 feet towards the middle, whereas the lot is approximately 162 feet at the western most portion of the Property. This discrepancy of approximately seven (7) feet would eliminate the need for the southern setback variance if the Property was a regularly shaped lot. The peculiar shape of the land necessitates the need for setback variances to build the required parking for the Proposed Project. Porte Cochere Setbacks: There are special conditions which are peculiar to the land and which are not applicable to other properties within the RMF-2 zoning district, most of which are located north of 173rd street. It is a uniquely shaped lot, which differs from the neighboring lots in both size and shape. Further, a significant portion of the Property is submerged. The narrow finger island creates a special condition which limits the development of the Property. Although Applicant is meeting all setback requirements for the Proposed Buildings, the Porte Cochere will not fit within the 25 foot setback of the narrow lots along Kings Point Drive. Building Separation: Section 265-34(D)(6)(a) states: When there are two or more - towers on the same property, the building-separation shall be a minimum of 50 feet_._N. between towers. The Proposed Buildings and Existing Building will meet the building separation requirements. However, the North Tower and Parking Garage will not meet the 50 foot separation requirement due to the unique nature of the Property. Rather, - - Applicant is requesting a variance for a building separation of 33'7" at the narrowest center point and 43'9"at the corners, between the North Tower and Parking Garage. (2) The special conditions and circumstances do not result from the actions of the petitioner; Applicant: Parking Garage Setbacks: Applicant did not create the shape, size and location of the Property, which uniquely narrows in the location of the proposed Parking Garage; rather these qualities are inherently distinct to the Property. Porte Cochere Setbacks: The special condition of the narrow finger island did not result from the actions of the Applicant. Building Separation:Applicant did not create the unique shape, size and location of the lot. These qualities are inherently unique to the Property and create challenges for the Applicant to provide required parking onsite. The Parking Garage provides the required parking for the Existing and Proposed Buildings-and any modifications will significantly limit Applicant's ability to provide required parking for the Proposed Project (3) Literal interpretation of the provisions of these LDRs deprives the applicant of rights commonly enjoyed by other properties in the same zoning district under the terms of this chapter and works unnecessary and undue hardship on the applicant; 10 U:\PLAINNNING&ZONING2008\ZONENG HEARING-APPLICATIONS\2016 APPLICATION PZ2016-12 Marina Del Mar II Applicant: Parking Garage Setbacks: Literal interpretation of the LDRs will deprive Applicant of utilizing its full development rights and present an undue hardship since the Proposed Project would lose the first row of parking and Applicant would be unable to fulfill its parking requirements. Therefore, the setback limitations of the code impose an unnecessary and undue hardship. Porte Cochere Setbacks: Most of the properties zoned RMF-2 are located north of 173rd street and are not narrowly shaped finger islands, which creates the unique - condition and hardship that deprives the Applicant of rights enjoyed by y other properties in the same zoning district. Building Separation: Denying the variance would deprive the Applicant the full use of the Parking Garage to accommodate the required parking for the Proposed Project. (4) The alleged hardship is not economic and has not been deliberately created to establish a use or structure, which is not otherwise consistent with the LDRs. --- Applicant: — - -- Parking Garage Setbacks: The hardship is not economic, but rather was created by the unique shape of the lot which narrows towards the middle, at the location where the Parking Garage is proposed. The survey shows that the Property narrows to -- -approximately 155 feet towards the middle, whereas the Property is approximately 162 feet at the western most portion. This discrepancy of approximately seven (7) feet would eliminate the need for the southern encroachment. Porte Cochere Setbacks: The hardship was not deliberately created, but rather is a result of the irregularly shaped narrow finger island. Building Separation: The hardship has not been deliberately created by the Applicant, but rather results from the unique nature of the Property. (5) Granting of the variance requested conveys the same treatment to the individual owner as to the owner of other lands, buildings or structures in the same zoning district; Applicant: Parking Garage Setbacks: Because of the Property's unique qualities, the code would present undue hardship to the Applicant if the setback variances were not permitted. The variance requests will not confer any special privileges that are being denied by the land development regulations to other structures in the same zoning district because the narrowing of the lot and irregular shape and location creates special circumstances which are unique to the Property. Porte Cochere Setbacks: A majority of properties zoned RMF-2 are not located on the irregularly shaped and uniquely situated finger islands at the southern end of the City. Therefore, granting the variance for this unique treatment will not confer any special privileges to the Applicant. 11 U:\PLANNING&ZONING2008\ZONING HEARING-APPLICATIONS\20 I 6 APPLICATIONTZ2016-12 Manna Del Mai II Building Separation: The existing conditions are unique to the Property and granting the variance would not confer special privilege to the Applicant. (6) The variance, if granted, is the minimum variance that makes possible the reasonable use of the land, building or structure; Applicant: Parking Garage Setbacks: Because of the unique shape, location and size of the Property, the setback variance requested is the minimum variance that would make possible the reasonable use of the land and construction of the required garage. Without the setback variance, Applicant would lose the first row of parking along Kings Point Drive, depriving applicant of utilizing its full development rights and providing required parking. The encroachments for purposes of developing the parking structure is the minimum variance that makes possible the reasonable use of the Property. Porte Cochere Setbacks: The Proposed Buildings meet the setback requirements. However, each of the Proposed Buildings contain a proposed Porte Cochere which encroaches into the side setback along Kings Point Drive. Although the Proposed Buildings are setback 25 feet, each Porte Cochere is proposed to be setback approximately 3'2'; which is the minimum variance-that makes reasonable use of the Proposed Buildings. Building Separation: The North Tower and Parking Garage will not meet the 50 foot separation requirement due to the unique nature of the Property. Rather, Applicant is requesting a variance for the building separation between the North Tower and Parking Garage, which is the minimum request that makes possible the reasonable use of the Property. (7) The grant of the variance is in harmony with the general intent and purpose of these LDRs, is not injurious to the neighborhood or otherwise detrimental to the public safety and welfare and will not substantially diminish or impair property values within the vicinity. _ Applicant: All of the variances associated with the Proposed Project are in harmony with the City's Code and Comprehensive Plan. Approval of the variances will not be injurious or detrimental to the area or public welfare; and will not impair property values within the vicinity. . V. PLANNING REVIEW: 1. Comprehensive Plan The proposed development is consistent with the City of Sunny Isles Beach Comprehensive Plan. The proposed development also supports the goals of open space and affordable housing set forth in the plan. 12 U:\PLANNING&ZONING2008\ZONING HEARING-APPLICATIONS\2016 APPLICATION\PZ2016-12 Marina Del Mar II 2. Traffic Engineering Traffic Impact Study: The Applicant submitted a traffic report dated November 30th, 2016 prepared by Carlos X. Valentin, P.E. from Richard Garcia & Associates, Inc. (a/k/a RGA). The report has been reviewed by the City's Consultant Eric Czerniejewski, P.E. from Calvin, Giordano, and Associates. The City provided comments on January 24, 2017 and the Applicant has . agreed to address comments from City's consultant. The City's Consultant has approved the submitted plans subject to compliance with Consultant's memo dated January 23, 2017 and with Condition # 18 in this report. 3. Landscaping Architecture The Applicant's Landscaping Plans were prepared by Architectural Alliance Landscape dated January 31, 2017 and have been reviewed by City's Landscape_Consultant Kathy O'Leary Richards, PLA, ASLA, LEED GA from O'Leary Richards Design Associates, Inc. dated January 23, 2017. The City's Consultant has approved the submitted plans subject to conipliance-With Coridition# 19 in this report. - — 4. Civil Engineering. The Applicant's Civil Engineering Plans were prepared by SRS Engineering Inc: dated January 31, 2017 and have been reviewed by City's Civil Engineering Consultant Nicholas B. Mahon, P.E. from Calvin, Giordano, and Associates. The City's Consultant has approved the submitted plans subject to compliance with memo dated January 23, 2017 and Condition # 20 in this report. VI. FINAL ANALYSIS Based on the above review, the application is generally consistent with the City's Comprehensive Plan and the City's Land Development Regulations. The project is utilizing the maximum density allowed through an existing workforce housing bonus available in the RMF-2 zoning district. This bonus would provide 35 workforce housing units within the existing tower in this project. These workforce housing units must satisfy all requirements stipulated in Section 265-39 of the City Land Development regulations. In addition, the project is providing an extended baywalk with approximately 1,680 linear feet of pathway that would be improved with art components, benches, pavers, and lighting. In conjunction with the baywalk, the Applicant is proposing to dedicate 0.4 acres of land for open space that will unified and continued the existing Intracoastal Park system at the south end of the City. The dedicated open space shall be provided to the City via a perpetual open space easement. 13 U:\PLANNING&ZONING2008\ZONING HEARING-APPLICATIONS\2016 APPLICATIOMPZ2016-12 Marina Del Mar II Moreover, the requested variances, are internal variances, which do not negatively affect neighboring properties. At this time, City Staff has no objection to the Applicant's requests. VII. CONDITIONS If the City approves this application, the application shall be subject to the following conditions set forth in Section VII below. Conditions to be completed before demolition, below grade or building permits are issued. 1. That the plans in the approval be substantially in accordance with that submitted for public hearing, which are entitled "Marina del Mar II", prepared by MSA Architects stamped received Jan. 31, 2017 consisting of 26 sheets, and Landscaping prepared by Architectural Alliance Landscape stamped received Jan. 31, 2017 consisting of 14 sheets; and Civil - prepared by SRS Engineering _Inc_ stamped received Jan. 31, 2017 consisting..of 11 sheets; and survey consisting of 8 sheets prepared by Maser Consulting P.A. a/k/a Triangle Surveying and Mapping stamped received Jan. 31, 2017. Plans are subject to revisions based on comments provided by zoning staff of the City of Sunny Isles Beach. Plans are subject to modification. 2. If applicable, a Miami-Dade County tree removal permit must be secured and attached to the landscape permit application prior to demolition. 3. That palms along Collins Avenue must be at least 12' clear-wood Medjobl Paims to'be consistent with the City Streetscape Master Plan. 4. That the Applicant provides the Lighting/Photometric Plan prior to building permit. 5. That the Applicant provides the Signage and Pavement Marking Plan prior to building permit. 6. Upon the submittal of an application for a building permit, the plans submitted shall be approved by the Community Development Department and be consistent with the specific site plan approved by the City Commission. Plans shall include all the required elements of the site plan pursuant to the City's Land Development Regulations and recommendations. Should compliance with recommendations result in a change that would not be considered "minor" in accordance with Section 265-18 of the City Code; the Applicant shall be required to obtain another approval of the City Commission. 7. That the Applicant acknowledges and agrees that the property located at 15920 Collins_ Avenue and 100 Kings Point Drive and legally described herein shall be considered one plot and parcel of land and that said property shall be considered as one plot and parcel of land for development purposes under the Zoning Code of the City. The Applicant shall submit a Declaration of Restrictive Covenants in lieu of Unity of Title in a form acceptable to the City Attorney. The Declaration of Restrictions shall be recorded in the public records of Miami-Dade County at the Applicants expense. 14 U:\PLANNING&ZONING2008\ZONING HEARING-APPLICATIONS\2016 APPLICATION\PZ2016-12 Marina Del Mar 11 8. That a plot plan be submitted to the Community Development Department for review. The plot plan shall include all easements proffered by the Applicant to the City, including but not limited to (i) the .407 acre open space area along the south side of Kings Point Drive fronting Collins Avenue; (ii) a fifteen (15) feet baywalk easement along north and west borders of north property; (iii) a fifteen (15) feet baywalk easement along south and west borders of south property; and (iv) three (3) bus stop shelter easements. 9. That the Applicant submit a Declaration of Restrictions and a perpetual open space easement in recordable form acceptable to the Community Development Department and acceptable to the City Attorney prior to submittal for an application for building permit, which proffers: (i) the .407 acre open space area along the south side of Kings Point Drive fronting Collins Avenue; (ii) a fifteen (15) feet baywalk easement along north and west borders of north property; (iii) a fifteen (15) feet baywalk easement along south and west borders of south property; (iv) three (3) bus stop shelter easements; and (v) the three (3) dry model units, one in each tower, to be used solely for marketing purposes. The Declaration of Restrictions shall include the easements proffered to the City. The _ _ _ maintenance of the easements shall be the responsibility of the Applicant and Applicant .. shall ensure that the baywalk easement are opened to the public at all times. -�� - 10: " That the Applicant shall install-the improvements including but not limited to tlecorative` - pavers, benches, lighting, garbage container, signage, landscaping, and bicycle racks on the Baywalk Easements. The Applicant shall design all improvements on the Baywalk Easements. The final design is subject to the approval of the City Manager or Designee. 11. That the Applicant shall not provide lease agreement for a term of less than six (6) months. ' ' The Applicant shall provide to the City' with a covenant running with the land that will ' ' • impose the short term restriction discussed herein. 12. That the Applicant comply with all conditions and permit requirements, including but not limited to Miami-Dade County, including environmental conditions and permitting, the Fire and Water and Sewer Departments, Florida Department of Environmental Protection (DEP), Florida Department of Transportation (FDOT), and the Federal Aviation Administration (FAA). 13. No building permits shall be issued (except for demolition and sales trailers) unless the Applicant has submitted all documents referred to under this approval and shall have paid • all impact fees, bonuses, and Transfer of Development Rights (if applicable), professional fees (as per Section 265-11 and such other applicable Land Development Regulations) _ due to the City. 14. That Applicant shall obtain concurrency review approval from Miami-Dade County School Board. 15. The Applicant shall pay all fees related to the review of the application described herein and shall have paid all other fees due to the City. 16. That the Applicant shall pay the required contribution to the Art in Public Places Fund in the amount equal to 1% of the construction cost but not to exceed $365,000.00 in lieu of 15 U:\PLANNING&ZONING2008\ZONING HEARING-APPLICATIONS\2016 APPLICATION\PZ2016-12 Marina Del Mar II the required artwork. The Applicant shall provide the City with anon-refundable deposit in the amount of ten percent (10%) of the contribution amount of$365,000. The total amount of the deposit is $36,500. Failure to pay the required deposit within the three (3) working days of approval of the site plan application shall result in an automatic voiding of the City Commission site plan approval. 17. That the Applicant shall address comments provided by City's Traffic Consultant regarding Traffic and vehicular issues. The City Manager or his designee shall review and provide additional comments if necessary. 18. That. the Applicant shall address comments provided by City's Landscaping Architect regarding landscaping plans submitted during site plan review process. The City Manager or his designee shall review and provide additional comments if necessary. 19. That the Applicant shall address comments provided by City's Civil Engineer regarding civil plans submitted during site plan review process. The City Manager or his designee shall review and provide additional comments if necessary. 20. That if the Applicant provides artwork in compliance with the City Code prior building permitting, the Applicant is not required to submit the balance of the monetary contribution 'to meetthe minimum monetary requirement.—Any artwork must be presented and approved by the City Commission. 21. If approved, the Applicant must submit a separate building permit prior any installation of ' murals or graphics on temporary construction fencing to be approved administratively by the City Manager or designee. 22. That the Applicant shall provide in perpetuity 35 workforce housing dwelling units within the remodeled tower in accordance with the City's Workforce Ordinance. The Applicant shall specifically designate the units and their location of in the plans and in the restrictive covenant. The Applicant shall be responsible for ensuring that the units are affordable based on income guidelines established by the City for the units. The units shall not be rented as market rate pricing by the Applicant or any other institution. 23. That the Applicant shall revise the garage opening by providing finishes that reduce the lighting exposure and view from the interior of the garage. The final exterior design of the garage shall be approved by the City Manager prior issuance of a building permitting. Conditions to be completed before any Certificate of Occupancy is issued. 24. That the Applicant shall underground all utility lines in front of the proposed project condominium complex, and at the time of underground utility lines for the project, the Applicant shall also install decorative sidewalk pavers consistent with decorative sidewalk pavers installed by the City on the west side of Collins Avenue. The decorative sidewalks shall be installed at the baywalk easements. 25. If the Applicant proposed artwork does not meet the minimum monetary requirement, as determined by the City, the owner must submit the balance of funds payable to the City prior to the issuance of a Certificate of Occupancy. 16 U:\PLANNING&ZONING2008\ZONING HEARING-APPLICATIONS\20I6 APPLICATION\PZ2016-12 Marina Del Mar II 26. Under Section 267-4, the City Manager and/or his/her designee in review of any application, may refer any such application presented to it to such engineering, planning, legal, technical, or environmental consultant or professional(s) employed by the City as the Manager shall deem reasonably necessary to enable him/her to review such application as required by law. Charges made by such consultants or professionals shall be in accord with the charges customarily made for such services in Miami-Dade County, and pursuant to an existing contractual agreement by and between the City and such consultant. Charges made by the City shall be in accord with the hourly rates charged by such consultants or hourly rates of employed professionals and shall be paid within 30 days on submission of City voucher. 27. At the time of submission of any application or thereafter, it is required that an escrow account be established, from which withdrawals shall be made to reimburse the City for the cost of professional review services, if any. The Applicant shall then provide funds to the City for deposit into such account in an amount to be determined by the City Manager, based on his/her evaluation of the nature and complexity of the application. The Applicant shallbe provided with copies of any City voucher for such services as they are submitted to the City. When the balance in such escrow is reduced to one-third (1/3) of its initial amount, the applicant shall deposit additional funds into such account to bring its balance up fo the amount-of the initial deposit. If such-account-is not-replenished within thirty-days (30) after the applicant is notified, in writing, of the requirements for such additional deposit, the City may suspend its review of the application. An application shall be deemed incomplete if any amount shall be outstanding. A building permit or Certificate of Use and Certificate-of Occupancy shall not be issued unless all professional review fees charged in connection with the applicant's project have been reimbursed to the City. Once all pertinent charges have been paid, the City shall refund to the Applicant any funds remaining on deposit. 28. The Applicant shall furnish payment and performance bond in an amount determined by the Building Official to ensure Applicant's performance of public improvements required pursuant to site plan approval and in accordance with recommendations of the Building Official after review of construction plans submitted based on development approval granted herein. Any such bond shall be issued by a surety having a minimum rating of A- 1 in the Best's Key Rating Guide, Property/Casualty Edition, shall be subject to the approval of the City, and shall provide that "this bond may not be cancelled or allowed to lapse until 30 days after receipt by the City, by certified mail, return receipt requested, of written notice from the issuer of the bond of intent to cancel or not to renew". As improvements are made the City, within its discretion, may reduce or eliminate the bond amount. These rights reserved by the City with respect to any construction bond established pursuant to this section are in addition to all other rights and remedies the City may have under this Resolution, in law or in equity. Other Conditions: 29. That the Applicant obtains a Certificate of Occupancy and a Certificate of Use from the City upon compliance with all terms and conditions. While each building is similar in style, each tower will have its own sense of arrival that will distinguish themselves from each other. The two Proposed Buildings will contain an abundant outdoor amenity package consisting of pools, yoga lawns, cabanas, chaise lounges, dog park, outdoor kitchens, trellises, and water features. The prominent overall amenity feature of the Proposed Project is the baywalk. The baywalk will extend the entire length of the project for approximately 1,500 linear feet and provide a pedestrian linkage between each new tower and the Parking Garage. This walkway will also serve as a connection linkage to the Existing Building. The following amenities/elements of the baywalk will enhance the pedestrian experience: light poles, bollard lighting, cable rail barrier system, concrete unit paving, benches, trash receptacles, bike racks, water features, and one (1) bougainvillea trellis sculpture. Dedication of Park via Easement: Applicant is proposing to dedicate a portion of the Property fronting Collins Avenue to the City for purposes of a park, as depicted in the enclosed plans ("Park Dedication"). .The Park Dedication will be memorialized via a perpetual easement. Applicant will enter into the perpetual easement regarding the Park Dedication prior to building permit; however, the land being dedicated will be utilized for construction purposes and parking until the Temporary Certificate of Occupancy("TCO") is obtained for the South Tower at Phase 2. Density Bonuses and Workforce Housing: The Property is 8.68 acres and the Proposed Project contains a total of 589 units. The density count is calculated as follows: ------. -- - - • Base density(50 units/acre)-=-434.units - _ • Waterfront Development Bonus(10 units/acre)=86.8 units • Workforce Housing bonus(8 units/acre)= 69.4 units Section 265-34(D)(9)(b)(1) permits a density bonus of up to ten (10)additional units per acre for waterfront developments that comply with the City's Comprehensive Plan with respect to Community Design Element Policy 1 E, Recreation and Open Space Element Policy 1 C, and Coastal Management Element Policies 3A and 3D. Here, Applicant complies with the Community Design Element Policy 1 E since the Proposed Project will provide a public baywalk with continuous lineal public access pathways and greenways, linking public and private space. Similarly, Applicant compiles with Recreation and Open Space Element Policy 1C as the Proposed Project will preserve view corridors and provide additional public access to the water. Finally, Applicant complies with Coastal Management Element Policies 3A and 3D since the baywalk provides a public water-oriented opportunity and will facilitate public access. Therefore, the Proposed Project qualifies for the density bonus of up to ten (10)additional units per acre. In addition, Section 265-34(D)(9)(b)(2) permits a density bonus of up to eight (8) additional units per acre provided that the Applicant complies with the affordable workforce housing provision of the Housing Element of the Comprehensive Plan and provisions of Section 265-39 of the City Code. Here, Applicant will provide workforce housing in compliance with Section 265-39 of the City Code. Section 265-39(D)(1)(a) permits one (1) Market Rate unit for every one (1) Workforce Housing Unit provided. Here, there will be a total of 69 units permitted under the Workforce Housing Bonus (8.68 x 8). Therefore, Applicant will provide one (1) Workforce Housing unit for every one(1)additional Market Rate unit, for a total of 35 Workforce Housing units Applicant will provide 35 Workforce Housing units, as defined in Section 265-39. Applicant will provide an annual report to the City Manager demonstrating compliance, in accordance with Section 265-39(H). Further, Applicant will provide a Restrictive Covenant, which guarantees the availability of workforce housing for a period of thirty (30) years; and will comply with the additional requirements listed in Section 265-39. In sum, the Proposed Project complies with the Waterfront Development Bonus and Workforce Housing Bonus, for a total permitted density of 68 units per acre, or 589 units on the Property. Art in Public Places Applicant is proposing to provide two (2)water features, one(1)fountain at each of the new towers, leading to the baywalk (at a cost of $50,000.00 each). Applicant will also provide five (5) Bougainvillea Trellis_Sculptures as follows: one (1) located at-the-North-Tower within the baywalk area, two(2) located along Kings Point Drive, and two (2) located at the South Tower in the garden park area(at a cost of$7,000.00 each). Therefore, Applicant is proposing to provide approximately $135,000.00 of art on site. Applicant may propose additional artwork on site, of approximately $365,000.00; or alternatively Applicant will pay the remainder into the Public Art Fund. Variances: Although the Property is an irregularly shaped lot, the Proposed Project meets all requirements under the City's Land Development Regulations ("LDRs") including height, FAR, parking and density, with the exception of setback encroachments and building separation requirements, for which Applicant requests the following variances: • Parking Garage Setbacks: The Property is unique because it is composed of irregularly shaped parcels on one of the City's finger islands. Significantly, the Property narrows towards the middle of the lot, where the setback relief is being requested. Specifically, Applicant is requesting a side setback of approximately 13'2°, on the southern portion of the Parking Garage (Kings Point Drive) where 25 feet are required; and requesting a side setback of approximately 16'11° on the northern portion of the Parking Garage(Waterway),where 25 feet are required. • Porte Cochere Setbacks: The Proposed Buildings meet the setback requirements. However, each of the Proposed Buildings contain a proposed Porte Cochere which encroaches into the side setback along Kings Point Drive. Although the Proposed Buildings are setback 25 feet, each Porte Cochere is proposed to be setback approximately 3'2°. • Building Separation: Section 265-34(D)(6)(a) states: When there are two or more towers on the same property, the building separation shall be a minimum of 50 feet between towers. Here, there is a separation of approximately 33'7° at the narrowest center point and 43'9° at the corners, between the North Tower and the Parking Garage,which triggers.the need for a.variance. _- _ {40589909;2} January 31, 2017 Page 5 The Property is unique because it is composed of irregularly shaped parcels on one of the City's finger islands. Literal interpretation of the LDRs would deprive Applicant of utilizing its full development rights and present an undue hardship. Specifically, without the proposed Parking Garage setbacks and distance separation variances, the garage would be inefficient and lose an entire row of required parking on each of the eight (8) levels. Further, the narrow finger island creates a special condition which limits the development of the Property. Although Applicant is meeting all setback requirements for the Proposed Buildings, the Porte Cochere will not fit within the required setback of the narrow lots along Kings Point Drive. Therefore, Applicant seeks the minimum variances required given the undue hardship resulting from this unique Property. Section 265-15(G)of the City's Code specifies seven (7) criteria by which variance requests are reviewed.The criteria are listed below in bold and underlined text, with our responses below. 1. Special conditions and circumstances exist which are peculiar to the land, structure. or building involved and which are not applicable to other lands, structures or ------- buildings in the same zoning district; -- - - - - - - - Parking Garage Setbacks: The Property is unique because it is composed of irregularly shaped parcels on one of the City's finger islands which narrows towards the middle of the lot, where the setback relief is being requested. The survey shows that the Property narrows to approximately 155 feet towards the middle, whereas the lot is approximately 162 feet at the western most portion of the Property. This discrepancy of approximately seven (7) feet would eliminate the need for the southern setback variance if the Property was 'a regularly shaped lot. The peculiar shape of the land necessitates the need for setback variances to build the required parking for the Proposed Project. Porte Cochere Setbacks: There are special conditions which are peculiar to the land and which are not applicable to other properties within the RMF-2 zoning district, most of which are located north of 173`d street. It is a uniquely shaped lot, which differs from the neighboring lots in both size and shape. Further, a significant portion of the Property is submerged. The narrow finger island creates a special condition which limits the development of the Property. Although Applicant is meeting all setback requirements for the Proposed Buildings, the Porte Cochere will not fit within the 25 foot setback of the narrow lots along Kings Point Drive. Building Separation: Section 265-34(D)(6)(a)states: When there are two or more towers on the same property, the building separation shall be a minimum of 50 feet between towers. The Proposed Buildings and Existing Building will meet the building separation requirements. However, the North Tower and Parking Garage will not meet the 50 foot separation requirement due to the unique nature of the Property. Rather, Applicant is requesting a variance fora building separation of.33'7" at the narrowest center point and 43'9° at the corners, between the North Tower and Parking Garage. {40589909;2} January 31, 2017 Page 6 2. The special conditions and circumstances do not result from the actions of the petitioner: Parking Garage Setbacks: Applicant did not create the shape, size and location of the Property, which uniquely narrows in the location of the proposed Parking Garage; rather these qualities are inherently distinct to the Property. Porte Cochere Setbacks: The special condition of the narrow finger island did not result from the actions of the Applicant. Building Separation: Applicant did not create the unique shape, size and location of the lot. These qualities are inherently unique to the Property and create challenges for the Applicant to provide required parking onsite. The Parking Garage provides the required parking for the Existing and Proposed Buildings and any modifications will significantly limit Applicant's ability to provide required parking for the Proposed Project. 3. Literal interpretation of the provisions of these LDRs deprives the applicant of rights - - --- -commonly-enjoyed-by-other--properties-in the same zoning district under-the-terms-of- _ - -- this chapter and works unnecessary and undue hardship on the applicant; Parking Garage Setbacks: Literal interpretation of the LDRs will deprive Applicant of utilizing its full development rights and present an undue hardship since the Proposed Project would lose the first row of parking and Applicant would be unable to fulfill its parking requirements. Therefore, the setback limitations of the code impose an unnecessary and undue hardship. - - Porte Cochere Setbacks: Most of the properties zoned RMF-2 are located north of 173rd street and are not narrowly shaped finger islands, which creates the unique condition and hardship that deprives the Applicant of rights enjoyed by other properties in the same zoning district. Building Separation: Denying the variance would deprive the Applicant the full use of the Parking Garage to accommodate the required parking for the Proposed Project. 4. The alleged hardship is not economic and has not been deliberately created to establish a use or structure, which is not otherwise consistent with the LDRs. Parking Garage Setbacks: The hardship is not economic, but rather was created by the • unique shape of the lot which narrows towards the middle, at the location where the Parking Garage is proposed. The survey shows that the Property narrows to approximately 155 feet towards the middle, whereas the Property is approximately 162 feet at the western most portion. This discrepancy of approximately seven (7)feet would eliminate the need for the southern encroachment. - Porte Cochere Setbacks: The hardship was not deliberately created, but rather is a result of the irregularly shaped narrow finger island. {40589909;2} • January 31, 2017 Page 7 Building Separation: The hardship has not been deliberately created by the Applicant, but rather results from the unique nature of the Property. 5. Granting of the variance requested conveys the same treatment to the individual owner as to the owner of other lands, buildings or structures in the same zoning district; Parking Garage Setbacks: Because of the Property's unique qualities, the code would present undue hardship to the Applicant if the setback variances were not permitted. The variance requests will not confer any special privileges that are being denied by the land development regulations to other structures in the same zoning district because the narrowing of the lot and irregular shape and location creates special circumstances which are unique to the Property. Porte Cochere Setbacks: A majority_of properties zoned RMF-2 are not located on the irregularly shaped and uniquely situated finger islands at the southern end of the City. Therefore, granting the variance for this unique treatment will not confer any special -------- - - •- - privileges to the Applicant. - — -- - - ---- Building Separation: The existing conditions are unique to the Property and granting the variance would not confer special privilege to the Applicant. • 6. The variance, If granted, is the minimum variance that makes possible the reasonable use of the land, building or structure; and Parking Garage Setbacks: Because of the unique shape, location and size of the Property, the setback variance requested is the minimum variance that would make possible the reasonable use of the land and construction of the required garage. Without the setback variance, Applicant would lose the first row of parking along Kings Point Drive, depriving applicant of utilizing its full development rights and -providing required parking. The encroachments for purposes of developing the parking structure is the minimum variance that makes possible the reasonable use of the Property. Porte Cochere Setbacks: The Proposed Buildings meet the setback requirements. However, each of the Proposed Buildings contain a proposed Porte Cochere which encroaches into the side setback along Kings Point Drive. Although the Proposed Buildings are setback 25 feet, each Porte Cochere is proposed to be setback approximately 3'2°, which is the minimum variance that makes reasonable use of the Proposed Buildings. Building Separation: The North Tower and Parking Garage will not meet the 50 foot separation requirement due to the unique nature of the Property. Rather, Applicant is requesting a variance for the building separation between the North Tower and Parking Garage, which is the minimum request that makes-possible the reasonable use of the Property. {40589909;2} January 31, 2017 Page 8 7. The grant of the variance is in harmony with the general intent and purpose of these LDRs, is not incurious to the neighborhood, or otherwise detrimental to the public safety and welfare and will not substantially diminish or impair property values within the vicinity. All of the variances associated with the Proposed Project are in harmony with the City's Code and Comprehensive Plan. Approval of the variances will not be injurious or detrimental to the area or public welfare; and will not impair property values within the vicinity. Shoreline Requirements Because the Property has frontage along Biscayne Bay it is subject to the Shoreline Development review standards of Chapter 33D, Article Ill of the Miami-Dade County Code of Ordinances. Although the Proposed Project falls short of the technical requirements of Chapter 33D, the Applicant is providing a public baywalk across the perimeter of the Property on the -- - northern and southern-portions-of-the Property-along Biscayne Bay. The baywalk-provides- . - - - significant connection to the water and connectivity between the baywalks along the northern and southern portions of the Property, for a meaningful pedestrian and public experience. The Biscayne Bay Shoreline Development Review Committee approved the Proposed Project on January 26, 2017. Request for 36 Months Approval Period As provided in the proposed estimated construction schedule, Applicant intends to obtain building permits for all phases of the Proposed Project within 24 months of site plan approval. However, given the nature of the phased project, and extent of work involved, any minor deviations (by even one month) would require more than 24 months to obtain building permits for the third phase. Generators and light stands Truck Route: • Material and equipment delivery access will be arriving from Interstate 95 and or US Highway 1; then along Route 826 East to 163rd Street; turning right on Collins avenue on to Kings Point Drive. See attached Truck Route as Exhibit A. It is anticipated that all materials can be stored on the property prior to incorporation into the project. There will - need to be some coordination of deliveries along Kings Point drive which will be conducted in accordance with the appropriate permits and approvals procured by the contractor(s) selected for the project. In addition, we will have OSHA compliant certified flagmen, (Gate Attendants) at each gate that will ensure the entering and exiting of all trucks from the site minimizes disruption to traffic. Material Storage Location: We will store materials onsite and within the confines of our construction fence and within the building throughout the course of the project. Construction Trailers: We will have Construction Offices/Trailers onsite. See enclosed Exhibit B, Phased Logistics Plan, for the proposed location. Traffic Control: Sidewalk and lane closures will be required for certain key activities, such as: the delivery, erection, dismantling, and removal of the tower crane, utility work and connections. We will follow the required guidelines and submit proper MOT plans and obtain permits as required during the course of the project. Parking: The number of workers will vary during the course of the project, but at peak, we estimate that we will have approximately 200 individual workers. We will emphasize and encourage the need to carpool to ensure that there is minimal impact to the areas available for public parking. During the final tower construction phase we will use the parking garage to -accommodate-constructionrworkers. — — Clean-up: The project will require continuous daily cleanup inclusive of the area where trucks enter and exit our site. It is the responsibility of each Gate Attendant to inspect and ensure tire cleanliness before the truck leaves the site. The Gate Attendants will be been trained and have a thorough understanding of their responsibilities as it pertains to exiting vehicles from the site and pedestrian safety. We will maintain the cleanliness of both curb and gutters to ensure that the buildup of sediment does not occur. I 1 d- t . ••----- — i=�•.rym,...•.� i 1 I _ Marina Del Mar II Traffic Impact Study Executive Summary This study was prepared to determine the vehicle trips associated with. the subject project and to evaluate the traffic impacts to the most impacted intersection. The subject site is located on 100 Kings Point Drive (159th Street) in the City of Sunny Isles Beach, Florida. This site has a residential apartment building with 336 units of which 333 units will remain. The proposed development consists of two (2) high-rise residential apartment buildings with a total of 256 units (128 units each). In addition, this project will provide an eight-story parking garage and several driveways along Kings Point Drive. The full-build out year is slated for 2021 . The trip generation characteristics for the subject project were obtained from ITE's Trip Generation Manual, 9th Edition. The trip generation analysis was performed for a typical weekday's AM and PM peak hour. The trip generation rates for Land Use 232: High-Rise Residential Condominium were utilized in the trip generation analysis. As a result, the trip generation calculations yielded 87 net vehicle trips (15 trips-in & 72 trips-out) during the-AM-peak hour and 97 net vehicle trips (60 trips-in &-37-trips-out) in the PM peak hour. The AM and PM peak hour trips were distributed to the most impacted intersection and assigned to the project's driveways. The trip distribution was performed consistent with• the trip distribution percentages of TAZ 611 and by interpolating between the 2010 and 2040 TAZ data for the projected design year of 2021. Manual Turning Movement Counts (TMC's) were taken at the intersection of Collins Avenue (SR A IA) and Kings Point Drive (159th Street). These turning movement counts were performed on Thursday, November 17th, 2016 during the typical weekday's AM 9 peak period of 7:00 AM to 9:00 AM and PM peak period of 4:00 PM to 6:00 PM. Subsequently, the AM and PM peak hour volumes were determined, adjusted for peak seasonal variations by utilizing the Florida Department of Transportation Seasonal Factor (SF) and utilized in the operational analysis for the existing condition. As a result, the c0., analysis revealed that Collins Avenue (SR Al A) and Kings Point Drive (159th Street) is operating at LOS A during the AM and PM peak hour. Also, the existing driveways were analyzed and yielded LOS A. Based on historical trends regression analysis, the existing traffic volumes were ` . augmented with a compounded background growth rate of 1.57 percent and committed trips to develop the traffic volumes for the future condition without project in 2021. Similarly, the traffic volumes for the future condition with project include background growth, committed trips and the project net trips. The proposed future t traffic volumes with project were evaluated and yielded LOS B for the AM and PM peak hour. Also, the project's driveways were evaluated and resulted in LOS A. Marina Del Mar II Traffic Impact Study In conclusion, the most impacted intersections by the subject project is operating at acceptable LOS and will continue to do so in the proposed future condition with the new project traffic during the AM and PM peak hour. Therefore, off-site traffic mitigation measures are not needed or recommended at this time since the subject project will not adversely impact the traffic operations within the study area.
