A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, APPROVING CHANGE ORDER
NO.6 TO AGREEMENT WITH SHORELINE FOUNDATION, INC.
FOR THE NEWPORT FISHING PIER DEMOLITION AND
CONSTRUCTION PROJECT, INCREASING THE AGREEMENT BY
THIRTEEN THOUSAND TWO HUNDRED NINETY -EIGHT
DOLLARS AND FORTY -SIX CENTS ($13,298.46), FOR THE
INSTALLION OF EIGHT (8) 18" ROUND AUGER CAST PILES,
AND INCREASING THE CONTRACT TIME BY FIFTEEN (15)
DAYS, ATTACHED HERETO AS EXHIBIT "A "; AUTHORIZING
THE CITY MANAGER TO DO ALL THINGS NECESSARY TO
EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, on September 16, 2010 via Resolution No. 2010 -1605, the City Commission
approved an Agreement with Shoreline Foundation, Inc. to provide professional construction
services for the demolition and construction of the Historic Sunny Isles Beach/Newport Fishing Pier
at Pier Park, in an amount not to exceed Three Million Seven Hundred Seventy -Seven Thousand
Eight Hundred Sixty -Six Dollars ($3,777,866.00); and
WHEREAS, on June 21, 2012 via Resolution No. 2012 -1927 the City Commission approved
Change Order Numbers 1 -4 with Shoreline Foundation, Inc., decreasing the Agreement amount by
Eight Hundred Eighteen Thousand One Hundred Fifty -Eight Dollars and Seventy -Nine Cents
($818,158.79), bringing the total Agreement amount not to exceed to Two Million Nine Hundred
Fifty -Nine Thousand Seven Hundred Seven Dollars and Twenty -One Cents ($2,959,707.21); and
WHEREAS, on June 21, 2012 via Resolution No. 2012 -1928 the City Commission approved
Change Order No. 5 with Shoreline Foundation, Inc., increasing the Agreement in an amount not to
exceed Thirty-Seven Thousand Six Hundred Five Dollars ($37,605.00), bringing the total amount
not to exceed to Two Million Nine Hundred Ninety -Seven Thousand Three Hundred Twelve Dollars
and Twenty -One Cents ($2,997,312.21).
WHEREAS, the original contract plans for the approach slab to the restaurant building
called for six (6) 24" x 24" precast piles at a cost of $43,795.64, to be driven via diesel hammer and
would require temporary encroachment onto LaPerla property and would have the potential for
cracking/spalling of the deck/structure due to vibrations; and
WHEREAS, the revised plan relocates the piles, reduces their size and utilizes in installation
methodology which reduces vibrations, and due to the smaller size of these piles, the number of piles
required to support the structure is increased from six (6) to eight (8); and
WHEREAS, the change order for installing eight (8) 18" round auger cast piles was not
considered in the original contract and is resulting in Change Order No. 6 increasing the Agreement
in an amount not to exceed Thirteen Thousand Two Hundred Ninety -Eight Dollars and Forty -Six
Cents ($13,298.46), and increasing the contract time by fifteen (15) days; and

WHEREAS, the City wishes to approve Change Order No. 6 with Shoreline Foundation,
Inc., increasing the Agreement in an amount not to exceed Thirteen Thousand Two Hundred Ninety-
Eight Dollars and Forty -Six Cents ($13,298.46); attached hereto as Exhibit "A ", bringing the total
amount not to exceed to Three Million Ten Thousand Six Hundred Ten Dollars and Sixty -Seven
Cents ($3,010,610.67).
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Approval of Change Order No. 6. The City Commission hereby approves Change
Order No. 6 to the Agreement with Shoreline Foundation, Inc., in an amount not to exceed Thirteen
Thousand Two Hundred Ninety -Eight Dollars and Forty -Six Cents ($13,298.46), and increasing the
contract time by fifteen (15) days, attached hereto as Exhibit "A ", bringing the total amount not to
exceed to Three Million Ten Thousand Six Hundred Ten Dollars and Sixty -Seven Cents
($3,010,610.67).
Section 2. Authorization of City Manager. The City Manager is hereby authorized to do all
things necessary to effectuate this Resolution.
Section 3. Effective Date. This Resolution will become effective upon adoption.

Per Mr. Ottinot's email dated July 2, 2012, please find below a report regarding the attached
change order which I discussed with Mr. Ottinot last week:
Reasons the modification from the original contract work was required:
The original contract plans for the approach slab to the restaurant building called for six (6)-
24" x 24" precast piles to be driven via diesel hammer. The location of these piles is shown
in the diagram below; please note the proximity to the existing condo pool and deck:

As you can see from the diagram above, the location and area of the 24" x 24" precast driven
piles would require temporary encroachment onto La Perla property and would have the
potential for cracking /spalling of the deck /structure due to vibrations. The revised plan, as
shown below, relocates the piles, reduces their size and utilizes an installation methodology
which reduces vibrations. Due to the smaller size of these piles, the number of piles required
to support the structure is increased from six (6) to eight (8).
Deductive Change Order (Credit) for not installing six (6) -24" x 24" Precast Driven
Piles:
The originally contracted 24" x 24" precast driven piles have an established rate per LF as
shown in the contract documents. The breakdown of these costs is shown in Attachment "A"
and total to a credit to the contract of $43,795.64.
Additive Change Order (Increase) for installing eight (8) —18" round auger cast piles:
This scope of work was not originally contemplated in the original contract, thus there is no
set value contained in the contractual documents. Attachment "B" contains Shoreline
Foundation, Inc (SFI) breakdown of the change order request which totals, $57,094.10.
CGA staff has reviewed these change orders with City Staff and a determination was made
that the net increase of $13,298.46 is justified in order to minimize the potential impacts to
the adjacent existing structures while utilizing the same contractor /contract documents,
which ensures that the bonding and insurance is upheld and consistent throughout the project
and contractual warranty period.

RECOMMENDATION:
It is recommended that the attached Resolution be approved.
