A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY
ISLES BEACH, FLORIDA, APPROVING CHANGE ORDER NO. 2 TO
AGREEMENT WITH TENEX ENTERPRISES, INC. FOR COLLINS
AVENUE STREETSCAPE IMPROVEMENTS AND LANDSCAPING
SERVICES FOR THE INSTALLATION OF TREES IN THE
INTRACOASTAL PARKS, IN AN AMOUNT NOT TO EXCEED TWO
HUNDRED EIGHTY THOUSAND THREE HUNDRED NINETY DOLLARS
AND THIRTEEN CENTS ($280,390.13), ATTACHED HERETO AS EXHIBIT
"A "; APPROVING SIXTY (60) ADDITIONAL DAYS TO COMPLETE THIS
WORK; RESCINDING RESOLUTION NO. 2012-1921 ADOPTED ON JUNE
21,2012; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS
NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, on January 19th, 2012 the City Commission approved Resolution No. 2012-
1834, awarding RFP No. 11 -11 -03 and authorized the City Manager and City Attorney to enter into
an agreement with Tenex Enterprises, Inc. to provide services on a unit price basis for the Collins
Avenue Sidewalk Pavers Project, in an amount not to exceed Five Hundred Forty-Six Thousand One
Hundred Sixty -One Dollars and Fifty -Cents ($546,161.50), attached hereto as Exhibit "A "; and
WHEREAS, on March 1, 2012 via Resolution No. 2012 -1862 the City Commission
approved the optional landscaping component to RFP No. 11- 11 -03, to expand the scope of the
Collins Avenue (west side) Sidewalk Pavers Project to include enhanced landscaping and fiber optic
projects by amending Resolution No. 2012 -1834 increasing the amount from $750,000.00 to
$990,000.00; and
WHEREAS, on June 21, 2012 via Resolution No. 2012 -1921 the City Commission approved
the Second Amendment to an Agreement with Tenex Enterprises, Inc., to add landscaping
improvements to Intracoastal Parks, irrigation and electrical work related to the tree up- lights, and for
the installation of a meandering walkway in the Parks, in an amount not to exceed Three Hundred
Seventy -Two Thousand One Hundred Fifty -Seven Dollars and Thirty-Six Cents ($372,157.36); and
WHEREAS, the City now wishes to have the walkway in the Intracoastal Parks constructed
in concrete, with in -house crews performing the form work, and now Change Order No. 2 only
includes those landscape and lighting improvements directly abutting Collins Avenue in an amount
not to exceed Two Hundred Eighty Thousand Three Hundred Ninety Dollars and Thirteen Cents
($280,390.13), and a 60 -day extension to complete the work, attached hereto as Exhibit "A ".
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Approval of Change Order No. 2 to Agreement. The City Commission hereby
approves the Change Order No. 2 to Agreement with Tenex Enterprises for landscape and lighting
improvements directly abutting Collins Avenue in the Intracoastal Parks, and a 60 -day extension to

complete this work, in an amount not to exceed Two Hundred Eighty Thousand Three Hundred
Ninety Dollars and Thirteen Cents ($280,390.13), attached hereto as Exhibit "A ".
Section 2. Rescind Resolution No. 2012 -1921. Resolution No. 2012 -1921 approving an
Agreement between the City and Tenex Enterprises, Inc. to add landscaping improvements to
Intracoastal Parks, irrigation and electrical work related to the tree up- lights, and for the installation
of a meandering walkway in the Parks, is hereby rescinded.
Section 3. Authorization of City Manager. The City Manager is hereby authorized to do all
things necessary to effectuate this Resolution.
Section 4. Effective Date. This Resolution will become effective upon adoption.

Irrigation allowance; Install irrigation system to provide 100% coverage to
newly installed material. Tie into existing clock, mainline and backflow
preventor. Price includes boring across one street.
This proposal assumes that the existing irrigation system is in good working
order, and does not include any pre - existing repairs that may be necessary.
Total: $ 6,180.00
Grand Total: 187,773.96
* Price includes one time relocation, any additional relocations will require
additional costs. A temporary above ground mist irrigation will be set up.
Water is to be supplied by others within 100 feet of planting area.
This price includes staking. No transplanted trees are guaranteed, however,
Nanak's Landscaping will take every precaution to ensure their survival. This
price is based on easy access to all areas. The owner is responsible for
maintaining a continuous supply of water to the trees after the transplanting.
Price does not include replacement cost of any trees that may die upon
relocating.
** This limited (1) year warranty cover labor and materials only. Transportation
and equipment charges associated with the initial installation are included in our
original estimate. Transportation and equipment charges associated with
installing a replacement Palm are the SOLE responsibility of the customer.
Palms provided as replacements carry no warranties what- so ever. If the
__ - _ _pint dies five may at our discretion, offer you a discounted Palm but will
not give you another replacement for the cost of transportation and equipment
alone. We will not replace Palms that are exposed to winds in excess of 50 miles
per hour, or that are exposed to unusual freezing conditions. It is the customer's
responsibility to pay whatever charges are necessary to have your Palm
reinstalled should they be moved by high winds. Warranty does not include
failure due to lethal yellowing, ganoderma, or other pest /disease issues that are
not addressed promptly.
Terms: To be negotiated. Payment for services rendered is due within 30 days.
If not paid by due date, 11/2% interest will be assessed every month thereafter.
If legal action is required to collect sums due under this agreement, the non-
prevailing party agrees to pay all costs of collection, including reasonable
attorney's fees.
Nanak's Landscaping, Inc. is not responsible for any damage to underground
utilities, including irrigation pipes. Nanak's Landscaping will not be responsible
for damages to concrete driveways, walkways and /or curbs, asphalt paving,
signage or sod damage. The price above does not include the cost of permits, if
necessary.
Acceptance of Proposal: The above prices, specifications and conditions are
satisfactory and are hereby accepted. You are authorized to do the work as
speecififie�d. Payment will be made as outlined above.

RE: A Resolution Approving the Change Order to the Agreement with
Tenex Enterprises, Inc. for Collins Avenue Streetscape
Improvements and Landscaping Services for the Installation of Trees
in the Intracoastal Parks
RECOMMENDATION:
It is recommended that City Commission adopt the Resolution approving Change Order
to the Agreement with Tenex Enterprises, Inc.
REASONS:
On June 21, 2012, City Commission adopted a Resolution approving a Change Order to
the Agreement with Tenex Enterprises, Inc. in the amount of $372,157.36. Work
included in this contract amendment included the installation of medjool date palms,
green island iicus, irrigation and up- lighting adjacent to the west side of the Collins
Avenue sidewalk along with constructing a paver sidewalk on park parcels proper. Since
adoption of the Resolution, the City has decided to construct the on -site meandering
sidewalk with in -house forces. This Change Order reflects the cost savings to the contract
and previously approved contract amendment due to the elimination of the on -site
meandering walk from the contractor's scope of work. In an amount of $280,390.13, or a
net reduction of $91,767.23 from the previously approved contract amendment.
