A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, EXPRESSING SUPPORT FOR
SENATE BILL 1682 WHICH WOULD PROHIBIT CERTAIN
CONDUCT BY WAYWARD CONDOMINIUM BOARD MEMBERS
AND PROVIDING FOR CRIMINAL PENALTIES, AMONG
OTHER REQUIREMENTS; URGING THE FLORIDA
LEGISLATURE TO ADOPT THE LEGISLATION AND
GOVERNOR RICK SCOTT TO SUPPORT AND APPROVE THE
LEGISLATION; DIRECTING THE CITY CLERK TO
DISTRIBUTE COPIES OF THIS RESOLUTION; PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, Senator Rene Garcia has filed Senate Bill 1682 for consideration by the
Florida Legislature, which would amend Chapter 718 of the Florida Statutes to prohibit certain
conduct by wayward members of condominium boards and providing for criminal penalties,among
other requirements; and
WHEREAS, these proposed revisions to Chapter 718 of the Florida Statutes would greatly
assist in protecting condominium unit owners by imposing tightened conflict of interest
restrictions, requiring full disclosure and greater recordkeeping requirements, clarifying board
membership and election requirements and imposing criminal penalties against wayward board
members; and
WHEREAS, legislative reform is sorely needed in the area of condominium law given the
many reported cases of abuse by certain wayward condominium board members throughout the
state of Florida; and
WHEREAS, the proposed tightened restrictions, full disclosure requirements and
imposition of criminal penalties against wayward board members is the only effective deterrent for
board member misconduct; and
WHEREAS, it is in the best interests of the public and condominiums throughout the state
of Florida that the Florida Legislature adopt the proposed Senate Bill 1682.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Recitals. The foregoing "WHEREAS" clauses are hereby ratified and incorporated
herein.

Section 2. Support for Senate Bill 1682. The City Commission hereby expresses support for
Senate Bill 1682 and urges the Florida Legislature to adopt and Governor Rick Scott to support
and approve it.
Section 3. Directions to the City Clerk. The City Clerk is directed to distribute copies of this
Resolution to Senator Rene Garcia, Governor Rick Scott, the Speaker of the House of
Representatives, the President of the Florida Senate, the Florida League of Cities, the Florida
Association of Counties, the Florida City County Management Association, and the Miami-Dade
County League of Cities.
Section 4. Effective Date. This Resolution shall become effective upon adoption.

RE: Resolution supporting Florida Senator Rene Garcia's Senate Bill 1682
RECOMMENDATION
It is recommended that the City Commission adopt the Resolution supporting Florida Senator Rene
Garcia's Senate Bill 1682.
REASONS
Senator Rene Garcia has filed Senate Bill 1682 for consideration by the Florida Legislature,
which would amend Chapter 718 of the Florida Statutes to prohibit certain conduct by wayward
members of condominium boards and providing for criminal penalties, among other
requirements. These proposed revisions to Chapter 718 of the Florida Statutes would greatly
