HomeMy WebLinkAboutOrdinance 2012-393 ORDINANCE NO. 2012- .Sq3 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING SECTIONS 265-34, 265- 35, 265-36, 265-37, 265-38 OF THE LAND DEVELOPMENT REGULATIONS TO CLARIFY THAT COMMERCIAL JET SKIS, PERSONAL WATERCRAFT LAUNCHING FACILITIES AND COMMERCIAL MARINAS ARE CONDITIONAL USES WITHIN PARTICULAR ZONING DISTRICTS; PROVIDING FOR REPEALER; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City's Land Development Regulations must be consistent with the City's Comprehensive Plan in designating certain uses within particular zoning districts; and WHEREAS, the City Commission wishes to clarify that commercial jet skis, motorized and non-motorized watercraft launching facilities and commercial marinas are conditional uses within particular zoning districts, due to their impacts to surrounding properties and environmental sensitive areas; and WHEREAS, the City desires to amend the Land Development Regulations to accomplish the aforesaid objective. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part by this Ordinance upon adoption hereof. Section 2. Amendment. Section 265-34 of the City Code is amended to read as follows: § 265-34. — Medium— High Density Multifamily Residential (RMF-2). *** C. Conditional uses (1) All conditional uses permitted in the RMF-1 District. (2) Apartment hotels (3) Convenience retail and office as an accessory use as part of a site plan approved prior to the adoption of these LDRs. (4) Commercial jet skis and personal watercraft launching facilities. For the purpose of this Section. a personal watercraft is defined as a small, iet powered craft, resembling a snowmobile in appearance and ridden like a motorcycle for individual use in water. (I) Commercial marinas or boat storage. (6) Non-motorized or motorized watercraft leasing or launching facilities. (2) Eleemosynary, charitable. religious and philanthropic institutions. (3) Nightclubs, private clubs. lodges, fraternities and sororities. (4) Commercial jet skis and personal watercraft launching facilities. For the purpose of this Section. a personal watercraft is defined as a small.jet-powered craft. resembling a snowmobile in appearance and ridden like a motorcycle for individual use in water. (5) Commercial marinas or boat storage. (6) Non-motorized or motorized watercraft leasing or launching facilities. *** § 265-36. —Neighborhood Business (B-1). *** C. Conditional uses (1) Open, unenclosed display and sales of flowers, fruits and vegetables as an accessory use to an adjacent established business housed in a permanent structure. (2) Open, unenclosed display and sales of retail merchandise from pushcarts and kiosks. (3) Temporary public markets, festivals and special events limited to three consecutive day periods. (4) Bars, taverns, lounges, provided that individual establishments shall not exceed 3.000 square feet in gross floor area. There shall be a three-hundred-foot distance separation between any two such establishments. Bars. taverns, and lounges located within a hotel and without direct grade-level exposure and access to the building front setback area shall not be subject to the distance separation requirement. (5) Veterinarians and ancillary kennels fully enclosed. (6) Commercial jet skis and personal watercraft launching facilities. For the purpose of this Section. a personal watercraft is defined as a small, jet-powered craft, resembling a snowmobile in appearance and ridden like a motorcycle for individual use in water. (7) Commercial marinas or boat storage. (8) Non-motorized or motorized watercraft leasing or launching facilities. *** § 265-37. —Town Center Zoning District. *** D. Conditional uses (1) Bars, taverns and lounges. provided that individual establishments shall not exceed 3.000 square feet in gross floor area. Conditional uses a) All conditional uses provided for in the RMF-1 and B-1 zoning districts. (2) Commercial let skis and personal watercraft launching facilities. For the purpose of this Section. a personal watercraft is defined as a small, jet-powered craft. resembling a snowmobile in appearance and ridden like a motorcycle for individual use in water. a) Commercial marinas or boat storage. W. Non-motorized or motorized watercraft leasing or launching facilities. *** Section 3. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 4. Inclusion in the Code. It is the intention of the Commission, and it is hereby ordained, that the provisions of this Ordinance shall become and be made a part of the code of the City of Sunny Isles Beach, Florida; and that the sections of this Ordinance may be renumbered or relettered to accomplish such intentions; and that the word "ordinance- shall be changed to "section' or other appropriate word, as required. Section 5. Repealer. All ordinances or part of ordinances in conflict herewith be and the same are hereby repealed. Section 6. Effective Date and Applicability. This Ordinance shall be effective upon adoption on second reading. This Ordinance shall apply to any site plans approved by the City Commission which have not expired and have not been issued a building permit. REASONS: The purpose of the attached Ordinance is to clarify that commercial jet skis, personal watercraft launching facilities, commercial marinas, boat storage, as well as non- motorized and motorized watercraft leasing or launching facilities, are conditional uses within certain zoning districts in the City. A conditional use is generally compatible with other land uses in the district but because of potential negative impacts on surrounding neighborhoods, require review by the City Commission. It is the opinion of City staff that the launching and presence of commercial jet skis, personal watercraft launching facilities, commercial marinas, boat storage, as well as non- motorized and motorized watercraft leasing or launching facilities, in particular zoning districts may be disruptive not only to the particular zoning districts identified in the Ordinance, but also to the environmentally sensitive areas, further supporting the reasoning that they be considered conditional uses requiring approval by the City Commission.
