FOR CONSTRUCTION OF A NEW DRIVEWAY ACCESS ON THE WEST SIDE OF COLLINS AVENUE, SOUTH OF 183RD STREET, IN AN AMOUNT NOT TO EXCEED FIFTY -EIGHT THOUSAND THREE HUNDRED THIRTY -ONE DOLLARS AND TWENTY -ONE CENTS ($58,331.21), ATTACHED HERETO AS EXHIBIT "A "; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on January 19th, 2012 the City Commission approved Resolution No. 2012- 1834, awarding RFP No. 11 -11 -03 and authorized the City Manager and City Attorney to enter into an agreement with Tenex Enterprises, Inc. to provide services on a unit price basis for the Collins Avenue Sidewalk Pavers Project, in an amount not to exceed Five Hundred Forty-Six Thousand One Hundred Sixty -One Dollars and Fifty -Cents ($546,161.50), attached hereto as Exhibit "A "; and WHEREAS, on March 1, 2012 via Resolution No. 2012 -1862 the City Commission approved the optional landscaping component to RFP No. 11- 11 -03, to expand the scope of the Collins Avenue (west side) Sidewalk Pavers Project to include enhanced landscaping and fiber optic projects by amending Resolution No. 2012 -1834 increasing the amount from $750,000.00 to $990,000.00; and WHEREAS, on June 21, 2012 via Resolution No. 2012 -1921 the City Commission approved the Second Amendment to an Agreement with Tenex Enterprises, Inc., to add landscaping improvements to Intracoastal Parks, irrigation and electrical work related to the tree up- lights, and for the installation of a meandering walkway in the Parks, in an amount not to exceed Three Hundred Seventy -Two Thousand One Hundred Fifty -Seven Dollars and Thirty-Six Cents ($372,157.36); and WHEREAS, the City wished to have the walkway in the Intracoastal Parks constructed in concrete, with in -house crews performing the form work, and on September 21, 2012 via Resolution No. 2012 -1960 the City Commission rescinded Resolution No. 2012 -1921 and approved Change Order No. 2 for landscape and lighting improvements directly abutting Collins Avenue in an amount not to exceed Two Hundred Eighty Thousand Three Hundred Ninety Dollars and Thirteen Cents ($280,390.13), and a 60 -day extension to complete the work; and WHEREAS, the City now wishes to approve Change Order No. 3 for construction of anew driveway access on the west side of Collins Avenue, south of 183rd Street, in an amount not to exceed Fifty -Eight Thousand Three Hundred Thirty -One Dollars and Twenty -One Cents ($58,331.21), attached hereto as Exhibit "A ", bringing the total amount of the project to Three Hundred Thirty -Eight Thousand Seven Hundred Twenty -One Dollars and Thirty -Four Cents ($338,721.34). 82012- Tenex Change Order 3 Driveway Cut Collins 183 St Page 1 of 2 NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Approval of Change Order No. 3 to Agreement. The City Commission hereby approves Change Order No. 3 to Agreement with Tenex Enterprises for construction of a new driveway access on the west side of Collins Avenue, south of 183rd Street, in an amount not to exceed Fifty -Eight Thousand Three Hundred Thirty -One Dollars and Twenty -One Cents ($58,331.21), attached hereto as Exhibit "A ". Section 2. Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate this Resolution. Section 3. Effective Date. REASONS: In a previously adopted budget, the City included a capital project for the construction of a new Collins Avenue driveway cut into the RK Village Plaza just south of 183rd Street that generally aligns with an on -site access aisle that runs between the existing CVS Pharmacy and BB &T Bank. Plans are complete and the project is ready to go to construction. It is recommended to have Tenex perform this work in order to take advantage of their current mobilization in the City, the modest value of the project, and plan requirements that the existing wave pattern pavers be removed and replaced noting these pavers were installed by Tenex several years ago. Once the new driveway into the plaza is constructed and placed in service, flexible delineators will be placed in the center stripe area of 183rd Street west of Collins Avenue to discourage motorists from turning left into the plaza at the access point closest to Collins Avenue.
