HomeMy WebLinkAboutReso 2017-2690 RESOLUTION NO. 2017- VA 0 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING A REQUEST SUBMITTED BY GSF ACQUISITION, LLC ("ESTATES AT ACQUALINA") WAIVING THE REQUIREMENT OF A CONSTRUCTION FENCE INSTALLATION PRIOR TO COMMENCING CONSTRUCTION, AND WAIVING THE LANDSCAPING AND SETBACK REQUIREMENTS FOR THE TEMPORARY CONSTRUCTION FENCE; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission approved Zoning Resolution No. 14-Z-144, adopted on September 18th, 2014 and later modified by Zoning Resolution No. 15-Z-153, adopted on April 16`h, 2015 for the Estates at Acqualina ("Project") located at 17901 Collins Avenue; and WHEREAS, GSF Acquisition, LLC (the "Applicant") is requesting a waiver of the requirement of the installation of a construction fence prior to commencing any construction of the Project; and WHEREAS, the Applicant is also requesting a waiver of the landscaping and setback requirements for the installation of the construction fence; and WHEREAS,the City Commission wishes to approve the waivers to provide the Applicant the flexibility to install the construction fence without the required setback and landscaping buffer and prior to construction activity. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Approval of Waiver. The City Commission hereby approves the waiver of the installation of the construction fence prior construction of the Project and approves the waiver of the landscaping and setback requirements set forth in Section 265-63.3 E of the City Code for the Project, subject to the conditions below. Section 2. Conditions. The Applicant is required to comply with the following conditions: (1) The construction fence must be properly maintained at all times; and (2) The construction fence must be removed if the zoning approval expires for the project Estates of Acqualina or a building permit is not obtained within the time permitted under the zoning approval. Section 3. Authority of the City Manager and City Attorney. The City Manager and City Attorney are hereby authorized to do all things necessary to effectuate this Resolution. Section 4.
