A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, RATIFYING A TEMPORARY
EASEMENT AGREEMENT BETWEEN THE CITY OF SUNNY ISLES
BEACH AND MIAMI-DADE COUNTY REGARDING THE USE OF
BELLA VISTA PARK FOR BEACH RENOURISHMENT PURPOSES,
ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE CITY
ATTORNEY AND THE CITY MANAGER TO DO ALL THINGS
NECESSARY TO EFFECTUATE THE TERMS OF THIS
RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Sunny Isles Beach ("City"), Miami-Dade County ("County"), the
Florida Department of Environmental Protection ("FDEP") and the United States Army Corps of
Engineers ("Corps") have jointly coordinated efforts to conduct beach restoration on eroded beach
areas of the City; and
WHEREAS, the County, on behalf of the Corps, requires a staging area in the area of Bella
Vista Park in order to stage the vehicles and equipment needed to install the fill along the beach; and
WHEREAS, the City and County agree to enter into a Temporary Easement Agreement in
order to accomplish this objective; and
WHEREAS, the City Commission wishes to ratify the Temporary Easement Agreement.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Ratifying the Temporary Easement Agreement. The Temporary Easement Agreement
for the area commonly known as `Bella Vista Park" to be used for beach renourishment purposes and
attached hereto as Exhibit "A" is hereby ratified.
Section 2. Authorization of City Manager and City Attorney. The City Manager and City Attorney
--are authorized to do all things necessary to effectuate the terms of this Resolution.
Section 3. Effective Date. This Resolution shall become effective upon adoption.

TEMPORARY EASEMENT AGREEMENT
THIS TEMPORARY EASEMENT AGREEMENT("Agreement") is made and entered into as of the
day of , 2017, by and between the CITY OF SUNNY ISLES BEACH, a municipal
corporation of the State of Florida (the "City"), with an address of 18070 Collins Avenue, Sunny Isles
Beach, Florida 33160, and Miami-Dade County (the "County"), a political subdivision of the State of
Florida, 111 NW First Street, Miami, Florida 33128.
RECITALS:
A. The City, the County and the United States Army Corps of Engineers (the "Corps") have jointly
coordinated to provide beach material in multiple eroded areas of Sunny Isles Beach (the "Mint
Project") pursuant to the 1986 Agreement between the Department of the Army and Metropolitan
Dade County for the Beach Erosion Control Project North of Haulover Beach Park; and
B. In furtherance of the Joint Project, the Corps requires the use of certain property owned by the City
for access and staging, and has requested that the County enter into this Agreement in connection
with same; and
C. The City owns certain property located at 500 Sunny Isles Beach Boulevard and more specifically
described in Legal Description attached hereto as Exhibit "A", (hereinafter referred to as the
"Temporary Easement Area" or the "Property"), in Sunny Isles Beach, that could be used for access
and staging in order to fulfill the goals of the Joint Project. This property is also known as Bella
Vista Park.
NOW, THEREFORE, in consideration of the premises, agreements and covenants set forth
hereinafter, and for other good and valuable consideration,the receipt and sufficiency of which are hereby
acknowledged,the parties hereby agree that the foregoing recitals are true and correct and further agree as
follows:
1. The foregoing recitals are incorporated as if fully set forth herein.
2. The City hereby grants to Miami-Dade County, its successors, and assigns, for the use of the County,
its agents, employees, contractors, representatives and licensees, for a 24 month period commencing
on the Effective Date, the temporary, non-exclusive easement on, over, and upon the Temporary
Easement Area, subject to the terms, conditions, reservations and restrictions set forth herein, for the
purpose of access, as well as all other work necessary or incidental to the construction of the Joint
Project, including but not limited to borrow and/or deposit fill, erection and removal of temporary
structures, staging of vehicles, equipment, and materials, together with the right to trim, cut, fell and
remove therefrom all trees, underbrush, obstructions, and any other vegetation, structures, or
obstacles, in connection with the Joint Project.

3. Assignment. The City acknowledges that any of the rights set forth herein may be assigned, in whole
or in part, including but not limited to the County's assignment of this Agreement to the Corps, its
agents, contractors, and employees, who shall be performing work and activities on the Property, and
the rights and obligations of the parties shall inure to the benefit of and be binding upon their
successors and assigns.
4. Enforcement. The parties shall resolve any disputes, controversies, or claims between them arising
out of this Agreement in accordance with the "Florida Governmental Conflict Resolution Act,"
Chapter 164, Florida Statutes, as amended.
5. Nothing herein shall constitute a waiver of Section 768.28 of the Florida Statutes or shall be
construed as impacting or modifying the protections set forth therein.
6. Nothing in this Agreement, express or implied, is intended to (i) confer upon any entity or person
other than the parties and their successors or assigns any rights or remedies under or by reason of the
Agreement as a third party beneficiary or otherwise, except as specifically provided in this
Agreement; or (ii) authorize anyone not a party to this Agreement to maintain an action pursuant to
or based upon this Agreement.
7. The City hereby warrants that it has full authority to grant and convey to the County all of the rights
to the Property that are granted to the County in this Temporary Easement Agreement, and the City
agrees to indemnify and hold harmless the County and its officers, employees, agents and
instrumentalities from any breach of this section.

RE: Resolution Approving a Temporary Easement Agreement with Miami-Dade
County for Beach Renourishment Purposes
RECOMMENDATION
It is recommended that the City Commission approve the proposed Resolution approving a
Temporary Easement Agreement with Miami-Dade County for beach renourishment purposes.
REASONS
The City of Sunny Isles Beach ("City"), Miami-Dade County ("County"), the Florida Department
of Environmental Protection ("FDEP") and the United States Army Corps of Engineers ("Corps")
have jointly coordinated efforts to conduct beach restoration on eroded beach areas in the City of
Sunny Isles Beach. The County, on behalf of the Corps, requires a staging area in the area
commonly known as the "Bella Vista Park" in order to stage the vehicles and equipment needed
to install the fill along the beach. The City and County have agreed to enter into a Temporary
Easement Agreement in order to accomplish this objective.
