HomeMy WebLinkAboutReso 2014-2308RESOLUTION NO. 2014- R', A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE CHIEF OF POLICE, IN ACCORDANCE WITH THE COMPREHENSIVE CRIME CONTROL ACT OF 1984, AND IN ACCORDANCE WITH SECTION 932.7055, F.S., TO EXPEND PARTIAL FORFEITURE FUNDS FROM THE DEPARTMENT OF JUSTICE (DOJ) TO PURCHASE THREE (3) POLICE MOTORCYCLES, AND EMERGENCY LIGHTING AND EQUIPMENT LISTED ON THE ATTACHED CERTIFICATION, IN AN AMOUNT NOT TO EXCEED SIXTY -EIGHT THOUSAND SIX HUNDRED NINETY -SIX DOLLARS AND TWENTY -EIGHT CENTS (S68,696.28); PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984. the City and its Police Department are authorized to expend forfeiture funds from the established Department of Justice (DOJ) federal forfeiture account, for the approved programs or purchases intended to enhance law enforcement purposes; and WHEREAS, in accordance with Florida Statutes §932.7055(4)(c)(3) specifically, a law enforcement agency that acquires at least $15,000.00 pursuant to the Florida Contraband Forfeiture Act with a fiscal year must expend or donate no less than 15% of such proceeds for the support or operation of any drug treatment, drug abuse education, drug prevention, crime prevention, safe neighborhood, school resource officer programs or for other law enforcement purposes; and WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984 and Florida Statutes §932.7055(4)(b) upon the request of the Chief of Police to the governing body of a municipality, liens and forfeiture funds may be expended if accompanied by written certification that the request complies with the provisions of the aforementioned subsections; and WHEREAS, the Chief of Police has submitted a request for the purchase of three (3) Harley Davidson Road King Police Motorcycles, and Emergency Lighting and Equipment listed on the attached Certification, in an amount of up to Sixty -Eight Thousand Six Hundred Ninety -Six Dollars and Twenty -Eight Cents ($68,696.28) in forfeiture (DOJ) funds in compliance with the aforementioned legal requirements. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Expenditure of Partial Federallv Forfeited Monies. Based on the attached certification, the Chief of Police is hereby authorized to spend up to Sixty -Eight Thousand Six Hundred Ninety - Six Dollars and Twenty -Eight Cents ($68,696.28) from the established Department of Justice (DOJ) federal forfeitures account for the purchase of three (3) Police Motorcycles, and Emergency Lighting and Equipment. 82014- Police Forfeiture (DOJ) Expend Funds Motorcycles Page 1 of 2 Section 2. Grandinetti, Police Captain DATE: 10/1612014 Approval to Expend Partial Forfeiture (DOJ) Funds to RE: purchase of three (3) Harley Davidson Road King Police Motorcycles and Emergency Lighting and Equipment, in an amount not to exceed $68,696.28 RECOMMENDATION: It is recommended that the City Commission approve the expenditure of partial Federal (DOJ) Forfeiture Funds, previously awarded to the Police Department as the results of investigative participation in forfeiture and seizure cases. These funds are permissible by law to be spent for the purchases of police equipment and other law enforcement activities. It is requested that we be permitted to utilize up to $68,696.28 of said funds on deposit for such purpose. REASONS: The Sunny Isles Beach Police Department would use the requested funds to transition the traffic motorcycle unit from a motorcycle lease program to a purchase program, extending the replacement cycle of these vehicle. Requested funds would also be used to purchase and install the emergency lighting and equipment for all six (6) police motorcycles. RECOMMENDATION: It is recommended that the City Commission adopt the attached resolution authorizing the City Manager to purchase Three (3) 2015 Harley Davidson Police Road King Motorcycles and associated emergency lighting and equipment at a cost not to exceed 568,696.28. REASONS: The Sunny Isles Beach Police Department solicited bids from three (3) vendors for the purchase of three (3), 2015 Harley Davidson Police Motorcycles. Chester's Harley Davidson of Ft. Lauderdale was the most responsive, responsible bidder ADDITIONAL INFORMATION: The Sunny Isles Beach Police Department is nearing the end of our current two (2) year lease of our Police Motorcycles. After much research, staff believes that it would be more cost effective to purchase our police motorcycles, extending the rotation to a three year cycle while still maintaining a high resale value due to the limited mileage and condition of the motorcycles. During this transition cycle, we would purchase three (3) Motorcycles while continuing to lease three (3). All emergency lighting and equipment will be purchased and installed by Strobes -R -Us, Inc.
