A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, AMENDING CONDITION # 21
IN RESOLUTION NO. 14-Z-146 OF THE RITZ PROJECT
LOCATED AT 15701-15795 COLLINS AVENUE RELATING TO
ARTWORK COMPONENT OF THE RITZ PROJECT;
AUTHORIZING THE CITY MANAGER TO DO ALL THINGS
NECESSARY TO EFFECTUATE THIS RESOLUTION;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, pursuant to Section 104 of the City Code, all private projects shall provide an
artwork component or contribution to the City's Art in Public Places fund; and
WHEREAS, pursuant to Resolution No. 14-Z-146, adopted on October 16, 2014, the City
Commission approved the Ritz Project with the condition to contribute to the Art in Public Places
fund or to present an artwork component to the City Commission for approval prior the issuance
of a master building permit; and
WHEREAS, the Project provided the required deposit amount equal to $50,000 for the
Artwork component three days after the Resolution No. 14-Z-146 was approved; and
WHEREAS, the Project's developer is requesting to extend the contribution to the Art in
Public Places fund or to present an artwork component to the City Commission for approval prior
the issuance of the Certificate of Occupancy; and
WHEREAS, the City Commission wishes to amend Condition #21 in Resolution No. 14-
Z-146 of the Ritz Project located at 15701-15795 Collins Avenue relating to the Artwork
component of the Ritz Project.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Incorporation of Recitals. The foregoing recitals are true and correct and are
incorporated herein by reference as if they are fully set forth herein.
Section 2. Authorizing the Modification of Resolution No. 14-Z-146. Pursuant to Section 265-
18 of the City Code, the City Commission hereby amends Condition #21 in Resolution No. 14-Z-
146 of the Ritz Project located at 15701-15795 Collins Avenue relating to Artwork component of
the Ritz Project. The Ritz Project's Art in Public Places contribution funds or presentation of an
artwork component to the City Commission to be approved prior the issuance of a master building
permit is hereby approved.
Section 3. Authority of the City Manager. The City Manager is hereby authorized to do all
things necessary to effectuate this Resolution.

Section 4. Effective Date. This Resolution shall become effective upon adoption.

RE: Minor Modification Request for Ritz Art Component
RECOMM ENDAT ION:
This Resolution is presented for your approval.
REASONS:
Sunny Isles Property Venture LLC (the "Owner") of the approved Ritz
project is requesting more time to comply with the City's Art
Component requirement. The Owner was required to submit a full
contribution or a piece of art for your review and approval prior the
issuance of the master building permit for the project, instead the
Owner is requesting to comply with the condition prior the issuance of
the Certificate of Occupancy for the project.
