ORDINANCE NO. 2017 - St O AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, EXTENDING THE TIME ON THE MORATORIUM ON THE SUBMITTAL, PROCESSING, AND ISSUANCE OF LOCAL BUSINESS TAX RECEIPTS AND/OR LAND USE APPROVALS FOR MEDICAL MARIJUANA DISPENSING ORGANIZATIONS AND TREATMENT CENTERS, AS DEFINED HEREIN, FOR A PERIOD OF ONE HUNDRED EIGHTY (180) DAYS FROM THE DATE OF ADOPTION OF THIS ORDINANCE; PROVIDING FOR LEGISLATIVE FINDINGS, INTENT AND PURPOSE; PROVIDING FOR CONFLICT; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, January 19, 2017, the City Commission adopted Ordinance NO. 2017-491 establishing a moratorium on the submittal, processing and issuance of local business tax receipts and/or land use approvals for medical marijuana dispensing organizations and treatment centers for a period of one hundred eighty days (180); and WHEREAS, the purpose of the moratorium is to allow City staff time to thoroughly research and analyze impacts to the City, its residents, and its visitors and to develop land use regulations for Medical Marijuana Dispensing Organizations and Medical Marijuana Treatment Centers; and WHEREAS, the Florida legislature has yet to pass laws regulating the medical marijuana dispensing and therefore, the City Commission deems it necessary and in the best interests of the health, safety, and welfare of the residents and visitors of the City of Sunny Isles Beach to extend the temporary moratorium on the issuance of business tax receipts and land use approvals for another period of one hundred and eighty (180) days to allow the state to enact the laws regarding any applications for any Medical Marijuana Dispensing Organization and Medical Marijuana Treatment Center. NOW,THEREFORE,BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance. These clauses represent the legislative findings of the City Commission. It is the purpose and intent of this Ordinance to promote the health, safety, and welfare of the residents and visitors of the City of Sunny Isles Beach. Section 2. Definition. For purposes of this Ordinance a "Medical Marijuana Dispensing Organization" and "Medical Marijuana Treatment Center" shall be defined as a business and/or a location or place permitted by State law to acquire, cultivate, possess, process, transfer, transport, 1 sell, distribute, dispense, prescribe or otherwise administer legal marijuana/cannabis. Section 3. Extending the Temporary Moratorium. The City Commission hereby extends the temporary moratorium on the submittal of applications,processing of applications, and the issuance of any business tax receipt and/or approval for land use in the City of Sunny Isles Beach for any Medical Marijuana Dispensing Organization and any Medical Marijuana Treatment Center. Said extended temporary moratorium shall be for a period of one hundred eighty (180) days from date of expiration of the initial moratorium in order to allow City staff time to thoroughly review, consider, modify, process, and research for adoption and implementation business and land use regulations pertaining to a Medical Marijuana Dispensing Organization and Medical Marijuana Treatment Center. Section 4. Inclusion in the Code. It is the intention of the City Commission, and it is hereby ordained that the provisions of this Ordinance shall become and made a part of the City of Sunny Isles Beach Code; that the sections of this Ordinance may be renumbered or re-lettered to accomplish such intentions; and that the word "Ordinance" shall be changed to "Section" or other appropriate word, as required. Section 5. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 6. Repealer. All ordinances or part of ordinances in conflict herewith be and the same are hereby repealed Section 7. Effective Date. REASONS: The Florida Legislature has failed to adopt regulations regarding the constitutional amendment approving medical marijuana. As such, it is recommended that the moratorium be extended for another one hundred eighty (180) days from the date on expiration of the initial moratorium.
