AN ORDINANCE OF THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, PROHIBITING MEDICAL
MARIJUANA TREATMENT CENTERS OR MEDICAL
MARIJUANA DISPENSING FACILITIES FROM BEING
LOCATED WITHIN THE CORPORATE BOUNDARIES OF THE
CITY OF SUNNY ISLES BEACH,PROVIDING FOR LEGISLATIVE
FINDINGS, INTENT AND PURPOSE; PROVIDING FOR
CONFLICT; PROVIDING FOR INCLUSION IN THE CODE;
PROVIDING FOR SEVERABILITY; PROVIDING FOR
REPEALER; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS,by Ordinance No. 2017-491,passed and adopted on second reading on January
19, 2017, the City Commission imposed a moratorium on the issuance of licenses or permits for
marijuana dispensing facilities; and
WHEREAS, pursuant to Article VII, Section 2 of the Florida Constitution and Chapter 166,
Florida Statutes, the City of Sunny Isles Beach, Florida, is authorized and required to protect the
public health, safety, and welfare of its residents and has the power and authority to enact regulations
for valid governmental purposes that are consistent with general or special law; and
WHEREAS, enacting legislation for the public health, safety, and welfare is a legitimate
public purpose recognized by Florida courts; and
WHEREAS, on June 9, 2017, the Florida Legislature passed and adopted a new medical
marijuana reform Bill, i.e. Senate Bill 8-A, 3`d Engrossed; and
WHEREAS, on June 23, 2017, Florida Governor Rick Scott signed Senate Bill No. 8-A,
3rd Engrossed, into Florida law; and
WHEREAS,under the newly enacted Senate Bill,the regulatory framework for cultivating,
processing, and delivering marijuana by medical marijuana treatment center dispensing facilities is
preempted to the state of Florida with certain exceptions; and
WHEREAS, a primary exception to this preemption is the ability of a county or a
municipality to ban medical marijuana treatment dispensing facilities from being located within the
boundaries of that county or municipality; and
WHEREAS, the City Commission has determined that the effects of medical marijuana
treatment center dispensing facilities, as they relate to crime, demand on City services, surrounding
property values,traffic and congestion,are detrimental to the health, safety and welfare of the City's
residents and visitors; and
WHEREAS, the City Commission wishes to use its authority pursuant to Florida Senate
Bill No. 8-A, § 3 (2017),to ban medical marijuana treatment center dispensing facilities from being
located within the corporate boundaries of Sunny Isles Beach.

NOW,THEREFORE,BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified
and confirmed as being true and correct and are hereby made a specific part of this Ordinance.These
clauses represent the legislative findings of the City Commission. It is the purpose and intent of this
Ordinance to promote the health, safety, and welfare of the residents and visitors of the City of Sunny
Isles Beach.
Section 2. Definition. For purposes of this Ordinance a"Medical Marijuana Treatment Center"
or"Medical Marijuana Dispensing Facility"shall be defined as a business and/or a location or place
permitted by State law to acquire, cultivate, possess, process, transfer, transport, sell, distribute,
dispense, prescribe or otherwise administer legal marijuana/cannabis.
Section 3. Prohibition against any Medical Marijuana Treatment Center or Medical Marijuana
Dispensing Facility within the City of Sunny Isles Beach. The City Commission hereby prohibits
any Medical Marijuana Treatment Center or Medical Marijuana Dispensing Facility from being
located anywhere within the corporate boundaries of the City of Sunny Isles Beach.
Section 4. Inclusion in the Code. It is the intention of the City Commission, and it is hereby
ordained that the provisions of this Ordinance shall become and made a part of the City of Sunny
Isles Beach Code; that the sections of this Ordinance may be renumbered or re-lettered to
accomplish such intentions; and that the word "Ordinance" shall be changed to "Section" or other
appropriate word, as required.
Section 5. Severability. The provisions of this Ordinance are declared to be severable and if
any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid
or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences,
clause, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent
that this Ordinance shall stand notwithstanding the invalidity of any part.
Section 6. Repealer. All Ordinances or part of Ordinances in conflict herewith be and the same
are hereby repealed
Section 7. Effective Date. This Ordinance shall become effective upon adoption on second
reading.

Ordinance Prohibiting Medical Marijuana Treatment
RE: Centers or Medical Marijuana Dispensing Facilities from
being located in Sunny Isles Beach
RECOMMENDATION:
It is recommended that the City Commission adopt the proposed
Ordinance prohibiting Medical Marijuana Treatment Centers or Medical
Marijuana Dispensing Facilities from being located in Sunny Isles
Beach.
REASONS:
By Ordinance No. 2017-491, passed and adopted on second reading
on January 19, 2017, the City Commission imposed a moratorium on
the issuance of licenses or permits for marijuana dispensing facilities.
On June 9, 2017, the Florida Legislature passed and adopted a
comprehensive medical marijuana reform law. On June 23, 2017,
Florida Governor Rick Scott signed the reform law.
Under the new law, the regulatory framework for cultivating, processing,
and delivering marijuana by medical marijuana treatment center
dispensing facilities is preempted to the state of Florida with certain
exceptions. However, a primary exception to this preemption is the
ability of a county or a municipality to ban medical marijuana treatment
dispensing facilities from being located within the boundaries of that
