A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, APPROVING THE
REQUEST SUBMITTED BY ST. TROPEZ BEACH
DEVELOPERS, LLC; APPROVING A WAIVER OF THE
LANDSCAPING AND SETBACK REQUIREMENTS FOR THE
TEMPORARY CONSTRUCTION FENCE TO BE PLACED
AROUND THE "ST. TROPEZ OFFICE BUILDING" PROJECT
(16690 COLLINS AVENUE); PROVIDING THE CITY
MANAGER AND THE CITY ATTORNEY WITH THE
AUTHORITY TO DO ALL THINGS NECESSARY TO
EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS,the City Commission approved Resolution No. 12-Z- 133 on November 15th,
2012 and as amended by Resolution No. 13- Z- 137 adopted on October 17th, 2013 consisting of
two residential towers (Phase II) and an office building (Phase III) and later modified by Zoning
Resolution No. 15-Z-151, adopted on September 22nd, 2015 for the Parque Towers and St. Tropez
Office Building site plan ("Project"); and
WHEREAS, St. Tropez Beach Developers, LLC. (the "Applicant") is requesting a waiver
for the installation of the construction fence prior commencing any construction of the Project;
and
WHEREAS, the Applicant is requesting a waiver of the landscaping and setback
requirements for the installation of the construction fencing; and
WHEREAS, the City Commission wishes to approve the waiver to permit the Applicant
with the flexibility to install the construction fence without the required setback and landscaping
buffer and prior construction activity.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Approval. Pursuant to Section 218-1 of the City Code of Sunny Isles Beach, the
City Commission hereby approves the application submitted by the applicant, subject to the
conditions set forth herein.
Section 2. Waiver. The City Commission hereby approves the waiver of the installation of the
construction fence prior to construction of the Project and approves the waiver of the landscaping
and setback requirements set forth in Section 265-63.3 (E) of the City Code for the Project, subject
to the conditions below.
Section 3. Conditions. The Applicant is required to comply with the following conditions:
(1) The construction fence must be properly maintained at all times; and
(2) The construction fence must be removed if a construction building permit is not
obtained according to the approved site plan timeframe.
Section 4. Authority of the City Manager and City Attorney. The City Manager and City
Attorney are hereby authorized to do all things necessary to effectuate this Resolution.
Section 5. Effective Date. This Resolution shall become effective upon adoption.

St. Tropez Office Building - Landscape Waiver for
RE: Temporary Construction Fence

RECOMMENDATION:
Staff has no objection to the Applicant waiver request, as long as the
conditions are maintained.
REASONS:
St. Tropez Beach Developers, LLC. ("Applicant') submitted a request
to the City of Sunny Isles Beach, Florida to waive the landscaping'and
front setback requirements at the construction fence for the St. Tropez
Office Building to facilitate the construction of the project. City
Commission has previously approved similar requests for other
construction sites.
