A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, APPROVING CHANGE
ORDER NOS. 1 AND 2 TO AGREEMENT #3 WITH EBSARY
FOUNDATION CO. FOR THE THIRD PHASE OF THE
CONSTRUCTION OF THE NORTH BAY ROAD PEDESTRIAN
EMERGENCY BRIDGE, IN AN AMOUNT NOT TO EXCEED SIX
: HUNDRED SIXTEEN THOUSAND THREE HUNDRED SEVENTY-

- NINE DOLLARS AND FORTY-EIGHT CENTS ($616,379.48),
ATTACHED HERETO, IN SUBSTANTIALLY THE SAME FORM,
AS EXHIBIT "A"; AUTHORIZING THE CITY MANAGER TO
SIGN SAID CHANGE ORDERS; AUTHORIZING THE CITY
MANAGER AND CITY ATTORNEY TO DO ALL THINGS
NECESSARY TO EFFECTUATE THE TERMS OF THIS
P. RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on February 16, 2017, via Resolution No. 2017-2663, the City Commission
approved Agreement #1 with Ebsary Foundation Co. for the North Bay Road Pedestrian
Emergency Bridge for the North Bay Road Pedestrian Emergency Bridge, consisting of
mobilization, MOT, demolition, drilled shafts, cast in place concrete, precast concrete structure,
administration, contingency, and associated fees in an amount not to exceed $3,407,032.45; and
WHEREAS, on February 16, 2017, via Resolution No. 2017-2664, the City Commission
approved Agreement #2 with Ebsary Foundation Co. for the North Bay Road Pedestrian
Emergency Bridge for the North Bay Road Pedestrian Emergency Bridge, consisting of bridge
approaches, MSE walls, road bed support, administration, contingency and associated fees in an
• amount not to exceed $1,796,673.45; and
WHEREAS, on February 16, 2017, via Resolution No. 2017-2665, the City Commission
approved Agreement #3 with Ebsary Foundation Co. for the North Bay Road Pedestrian
Emergency Bridge for the North Bay Road Pedestrian Emergency Bridge, consisting of finish
grade, road bed, asphalt, pavers, decorative fencing, hardscape, permanent safety elements,
electrical system, administration, contingency and associated fees in a total amount not to exceed
$823,010.95; and
WHEREAS, Ebsary Foundation Co. has submitted Change Order No. 1 to include bridge
decorative colored surface material, landscape planters, wooden benches, and associated rigid
pavement slabs required to provide a pedestrian friendly atmosphere; and
WHEREAS, Ebsary Foundation Co. has submitted Change Order No. 2 to include the
addition of storm water drainage for the bridge and improved storm water drainage and pavement
for the roadway abutting the emergency/pedestrian bridge; and

WHEREAS, staff has determined that additional services beyond the original scope of

work is needed to remain on schedule and complete the project; and

WHEREAS,the City wishes to approve Change Order Nos. 1 and 2 to Agreement#3 with
Ebsary Foundation Co. for the North Bay Road Pedestrian Emergency Bridge for the North Bay
Road Pedestrian Emergency Bridge, in a total amount not to exceed Six Hundred Sixteen Thousand
Three Hundred Seventy-Nine Dollars and Forty-Eight Cents ($616,379.48), attached hereto, in

substantially the same form, as Exhibit "A", bringing the total amount of Agreement #3 not to
exceed One Million Four Hundred Thirty Nine Thousand Three Hundred Ninety Dollars and Forty
Cents ($1,439,390.40).

NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:

Section 1. Approving Change Order Nos. 1 and 2 to Agreement #3 with Ebsary Foundation
Co. The City Commission hereby approves Change Order Nos. 1 and 2 to Agreement #3 with
Ebsary Foundation Co. for the North Bay Road Pedestrian Emergency Bridge for the North Bay
Road Pedestrian Emergency Bridge,in a total amount not to exceed Six Hundred Sixteen Thousand
Three Hundred Seventy-Nine Dollars and Forty-Eight Cents ($616,379.48), attached hereto, in
substantially the same form, as Exhibit "A", bringing the total amount of Agreement #3 not to
exceed One Million Four Hundred Thirty Nine Thousand Three Hundred Ninety Dollars and Forty
Cents ($1,439,390.40).
Section 2. Authorization of City Manager. The City Manager is hereby authorized to sign

Change Order Nos. 1 and 2, attached hereto, in substantially the same form, as Exhibit "A".
Section 3. Authorization of City Manager and City Attorney. The City Manager and City
Attorney are authorized to do all things necessary to effectuate the terms of this Resolution.
Section 4. Effective Date. This Resolution shall become effective upon adoption.

Approving Change Order Nos. 1 and 2 with Ebsary
RE: Foundation Company for the North Bay Road
Emergency/Pedestrian Bridge
RECOMMENDATION:
This Resolution is presented for your consideration.
REASONS:
1. The original bridge design and bid document did not include final
aesthetic finishes including, bridge decorative colored surface material,
landscape planters, wooden benches, and associated rigid pavement
slabs required to provide a pedestrian friendly atmosphere. These
items are included in Change Order No. 1 for the amount of
$423,690.20
2. Additional design study of the bridge approaches by the project
engineer resulted in the addition of, storm water drainage for the bridge
and improved storm water drainage and pavement for the abutting
Salem House Condominium (SHC) necessitated due to the addition of
bridge approach roadways and temporary construction easements
granted by SHC necessary to physically construct the bridge structure.
These items are included in Change Order No. 2 for the amount of
$192,689.28

Remaining items not contemplated in the design and bid documents,

that will need to be funded include, the improvements to the Salem
House parking lot lighting, paving, new fencing and exit gate. These
improvements where part of the agreement with Salem House by which
they have provided us a temporary construction easement and their full
cooperation in allowing us to stage for construction from within their
property.
The relocation of the FPL transformer, which is currently in the City
bridge easement, may come to fruition on a tract of City-owned land
abutting the Salem House property for which an access easement
would be necessary. The westside of the North bridge landing ramp will
require some concrete work in order to have a finished look to this
exposed area.
Substantial completion is expected by the end of this calendar year.
