HomeMy WebLinkAboutReso 2012-1996 RESOLUTION NO. 2012 - I q 9 1 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING THE FIRST AMENDMENT TO AGREEMENT WITH LIVS ASSOCIATES FOR DESIGN REVISIONS TO THE ARLEN HOUSE PROJECT, IN AN AMOUNT NOT TO EXCEED FORTY-FIVE THOUSAND NINE HUNDRED TWENTY-FOUR DOLLARS ($45,924.00), ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE MAYOR TO EXECUTE SAID FIRST AMENDMENT TO AGREEMENT; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission has authorized the design of a Streetscape Project in front of the Arlen House Condominium along Collins Avenue from Bayview Drive to the southern City limits; and WHEREAS,on September 16, 2010 via Resolution No. 2010-1611 the City Commission approved an Agreement with LIVS Associates to provide design, construction documents, and construction administration for the streetscape improvement along Collins Avenue in front of the Arlen House Condominium from Bayview Drive to the southern City limits, in an amount not to exceed Forty-Two Thousand Nine Hundred Sixteen Dollars ($42,916.00); and WHEREAS, in 2010 the City acquired an easement for the purposes of constructing and installing landscape and hardscape enhancements abutting Collins Avenue that are within the easement; and WHEREAS, the City is now in need of a redesign that will create aesthetic continuity between this project and the Intracoastal Parks, are wholly contained in the recorded easement, and pursuant to the 2010 Florida Building Code, geotechnical services must be performed to substantiate foundation design for the wall and is included in this proposal noting that geotechnical services had not been included in the original contract for design services; and WHEREAS, the City desires to approve the First Amendment to Agreement with LIVS Associates to provide design revisions to the Arlen House Project; and WHEREAS, LIVS Associates is qualified, willing and able to provide said services and has submitted a proposal for professional services, in the amount of Forty-Five Thousand Nine Hundred Twenty-Four Dollars ($45,924.00), attached hereto as Exhibit"A". NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA,AS FOLLOWS: Section 1. Approval of First Amendment to Agreement. The First Amendment to Agreement with LIVS Associates to provide design revisions to the Arlen House Project, in an R2012-LIVS 1st Admt Design Revisions Arlen House Page 1 of 2 amount not to exceed Forty-Five Thousand Nine Hundred Twenty-Four Dollars ($45,924.00), attached hereto as Exhibit"A",be and the same, is hereby approved. Section 2. Authorization of Mayor. The Mayor is hereby authorized to execute said First Amendment to Agreement. Section 3. Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate this Resolution. Section 4. Effective Date. This Resolution will become effective upon adoption. SCOPE OF SERVICES The scope of services under this proposal consists of providing design,construction documents, and construction administration to revise the streetscape improvement construction documents submitted on March,31,2011. For the purpose of this proposal,the following statements and assumptions are made with respect to the work required: • Incorporate the comments made by the building department as included in Plan Review Report-2 dated 8/31/2012 (attached). • Make modifications to the existing design to comply with requests made by you in an email received on 10/25/2012(attached). • Provide a Soils Analysis/Report which will include soil boring tests and foundation recommendations. • Provide 3D renderings which will show the new design. • Provide technical specifications to be used for bidding and award. BASIC SERVICES LIVS will provide professional services for the above referenced project,consisting of the scope and basic services previously outlined for the fee of$45,924.00(Forty five thousand nine hundred and twenty four). This fee will be divided as follows: Basic Services Percentage of Fee* Amount • A. Schematic Design Phase 20% $ 9,184.00 • B. Construction Document Phase 80% $ 36,740.00 TOTAL 100% $ 45,924.00 *Payments for basic services will be made upon work completed and made in proportion to the services performed in each phase so that the payments for Basic Compensation for each phase shall equal the percentages shown above of the total compensation payable. B. ADDITIONAL SERVICES LIVS shall provide additional services beyond the scope previously outlined and beyond the stipulated fees as authorized in writing by the client. These services shall be a based on the hourly rates included in our General Architectural Services Agreement. These services include,but are not limited to the following: 1. CONSTRUCTION ADMINISTRATION PHASE If required,LIVS Associates will provide services during construction as an additional service to include: review of contract submittals;responses to questions (RFIs),and issuance of clarifications related to our documents.Two monthly visits will be performed for observation of the work to assist the client in monitoring the, progress of the work and compliance with the requirements of the contract documents. During these visits LIVS Associates will review the contractor's request for payments. This phase also includes a final inspection,punch list,and contract closeout. Additional visits beyond those stipulated above will be performed as an additional service(Refer to Section III-B). Fee for Construction Administration $9,904.00 2. Field representation due to changes in design,scope of work,or unforeseen conditions. Mileage shall be reimbursed at a rate of.60 cents per mile,round trip. The minimum time billed for each visit shall be 3 hours including travel. 3. Permit processing and/or expediting. 4. Any other services not specifically included under Sections I& II. INFORMATION,DATA,&DOCUMENTATION The Client shall be responsible for providing information,data,and documentation on existing site conditions, which may be necessary and relevant for completion of this project, including,but not limited to: 1. Surveys of right-of-way with pavement marking to the center of Collins Avenue for the length of the previously determined project limits. To give you some advance warning,these are the topics I need to discuss and have you prepare a supplemental work authorization/contract amendment for City Commission approval (in no particular order): 1. Soils analysis/report required to get the wall and footing properly designed and permitted. We have no chance whatsoever of getting a permit based upon an assumed soil bearing capacity. This is, of course, if a soils report has not been done already. If it has, I would like a copy for my files. 2. Plan revisions to bring them up to 2010 FBC. 3. Revised landscaping to be consistent with the remainder of the streetscape project(Medjool and green island ficus along with other plantings). 4. Revised electrical to include uplighting on the palms. 5. Revisions to the hardscape plan that shows the wave pattern pavers. 6. Revisions to the plans to have all improvements within the easement that has already been granted which is much less than the 30 feet that was assumed. I attached a copy of the easement that was recorded several months before your original work authorization. I cannot tell you why the then CM let your project move forward with the 30 feet(it is closer to 22 feet). If there is good news in this,Calvin Giordano did the site survey for the project as well as prepared the Arlen House easement legal description and sketch. 7. Written technical specifications to accompany the plan set for advertisement and bid. 8. A complete set of revised renderings that show what is being proposed (wave pattern, appropriate landscape materials, no trellises along the stucco wall etc). 9. A list of all required agency permits understanding that we are not asking,at this time,for you to process any plans. I need to bring the amendment to City Commission at their November 15 meeting. In order to do that, I need your proposal and fee estimate no later than the end of next week, November 2,so that legal can work their magic. Also, I will need to take the item to Commission with the renderings as backup materials,so to the extent the$600 already approved for the Bayview Drive portion can cover that one,we can take the rest out of remaining balance on the current and open PO but I must approve the fee for revising the other two renderings before you start the work. The final renderings I must have by Thursday, November 8 for them to be included in Commission backup. The earlier we can meet to discuss,the better, noting that we need to leave ourselves some wiggle-room timewise for negotiation and revision to the proposal and renderings. Both tomorrow and the bulk of my week next week is open (only Tuesday morning is booked right now). I look forward to hearing from you. REASONS: In a previously adopted budget, the City approved a project for improvements to Collins Avenue and Bayview Drive, and is commonly referred to as The Arlen House project. A design contract with LIVS Associates was approved by City Commission September 2010. Also in 2010, the City acquired an easement for the purposes of constructing and installing landscape and hardscape enhancements abutting Collins Avenue that are within the easement. There are three issues that are being addressed in this contract amendment, and specifically include: 1)The original design was prepared in advance of the City's acquisition of the Intracoastal Park properties and as such did not include the same landscape and hardscape aesthetic elements (i.e. wave pattern pavers, Medjool date palms/green island ficus and uplighting). The redesign will create aesthetic continuity between this project and the Intracoastal Parks. 2)The original design was based upon an easement width on the Arlen House property of 30 feet, however, the actual easement is only approximately 22 feet in width. Code, as well as sound engineering practice, requires that geotechnical services be performed to substantiate foundation design for the wall and is included in this proposal noting that geotechnical services had not been included in the original contract for design services. Design on the project will occur in two distinct phases. Schematic design will be done and includes renderings that accurately reflect proposed improvements for approval by City Commission and management. Upon approval by the City, the construction drawings will be revised and the project will be processed for permits. Note that due to some work elements being within FDOT right of way, a Construction Agreement with FDOT will be required and will be processed by the City at a later date. Subsequent to the incorporation of any changes to the design drawings due to jurisdictional agency requirements,the project will be publicly bid. COST: Cost not to exceed $45,924.00.
