AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING
ORDINANCE NO. 2017-499 TO EXTEND FOR A PERIOD OF
SIX (6) MONTHS FROM DECEMBER 15, 2017 THE
TEMPORARY MORATORIUM TO PROHIBIT THE FILING,
ACCEPTANCE OR PROCESSING OF ANY PERMIT,
DEVELOPMENT ORDER, OR ANY OTHER OFFICIAL
ACTION OF THE CITY HAVING THE EFFECT OF
PERMITTING OR ALLOWING THE CONSTRUCTION OF
WIRELESS COMMUNICATION FACILITIES IN THE
PUBLIC RIGHTS-OF-WAY WITHIN THE CITY LIMITS;
PROVIDING FOR REPEALER; PROVIDING FOR
SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, to protect the public health, safety and welfare of its citizens, the City has adopted
several ordinances, including regulation of the location, design and operation of wireless-communication
facilities, towers, antennae (Chapter 129 of the City Code);
WHEREAS, Section 337.401, Florida Statutes, addresses the authority of municipalities to
regulate the placement and maintenance of communication facilities, and other utilities, in the public-
rights-of-way; and
WHEREAS, the communication industry is in a constant state of emerging technology that
includes the infrastructure required to support the increased demand and capacity to receive and to
transmit larger data and voice communications; and
WHEREAS, a new network of wireless communication infrastructure has emerged comprised of
a series of small individual antenna("Small Cells"),or nodes("Distributed Antenna Systems"or"DAS"),
and wireless backhaul networks that are linked to a larger hub site; and
WHEREAS, the City has been contacted by companies requesting permission to place their
wireless communication facilities within the public rights-of-way within the City; and
WHEREAS, the current City ordinances do not specifically address the placement of wireless
communication facilities within the public rights-of-way; and
WHEREAS, additionally since the adoption of the City's Code of Ordinances, the Federal
Communication Commission has adopted new rules addressing wireless communication facilities;
and
WHEREAS, these changes in federal regulations, the emerging technology, and the new
communication infrastructure require a careful review by the City of its policies and ordinances
associated with regulation of cell towers, antennae, and other wireless communication facilities; and
WHEREAS, the City Commission determines that it is in the best interest of its residents,

businesses and visitors to enact sufficient regulations to protect the public health, safety and welfare; and
WHEREAS, an extension of the temporary moratorium on the acceptance of applications
for, the processing of, and the issuance of right-of-way use permits, development permits, site plan
approvals or any other official action of the City of Sunny Isles Beach permitting or having the effect
of allowing the construction of wireless communication facilities in the public rights-of-way within the
City will allow time to review, study, hold public hearings, and prepare and adopt an amendment or
amendments to the City of Sunny Isles Beach Comprehensive Plan and/or Code of Ordinances to
address this use; and
WHEREAS, at least 10 days notice has been given of the public hearing once by publication in
a newspaper of general circulation notifying the public of this proposed ordinance and of a public
hearing in the City Commission meeting room; and
WHEREAS, the public hearings were held pursuant to the published notice described at which
hearings the parties in interest and all others had an opportunity to be and were, in fact, heard.
NOW,THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA,AS FOLLOWS:
Section 1. Findings. The City Commission adopts the foregoing findings.
Section 2. Purpose.
(a) The purpose of this Ordinance is to enable the City of Sunny Isles Beach sufficient time
to review, hold public hearings and adopt an amendment or amendments to the
City of Sunny Isles Beach Code of Ordinances, relating to the location, design and
operation of wireless communication facilities within the public rights-of-way within
the City. The City will not approve any application or issue any permits authorizing the
construction of wireless communication facilities within the public rights-of-way,
except as provided in this Ordinance, or as may otherwise be required by applicable law.
(b) It is further the purpose of this Ordinance to fulfill the City's constitutional charge and
statutory obligations to protect and preserve the public health, safety and welfare of the
citizens of the City of Sunny Isles Beach, regarding whether wireless communications
facilities should be permitted within the public rights-of-way; and if permitted within the
public rights-of-way, the types of regulations to be imposed upon placement of wireless
communication facilities; and thus defer official government action until the City of
Sunny Isles Beach has properly held public hearings and adopted amendments to the
City of Sunny Isles Beach Code of Ordinances, as necessary.
(c) To fulfill the City's obligations to continue uninterrupted provision of public works, fire
safety, law enforcement, and emergency management, it is clarified that this moratorium
will not apply to the construction, installation, maintenance and replacement of facilities
within the public rights-of-way that are for governmental purposes.

Section 3. Definitions.
"Wireless communication facility" means any equipment or facility used for the transmission
or reception of wireless communications and located on public right-of-way. This term includes
but is not limited to wireless support structures, antennas, cabling, regular and backup power
supplies, and comparable equipment, regardless of technological configuration including
Distributed Antenna Systems (DAS) and small cell networks. For purposes of this Ordinance,
the term shall include communication towers and all wireless communications facilities as
defined in Section 365.172(3)(gg), Florida Statutes, or facilities to provide wireless
communication services as listed at https://www.fcc.gov/general/wireless-services.
"Communication Tower" means a building or ground-mounted tower which as measured
from the finished grade of the property (I) is greater than thirty-five feet in height (2) does not
exceed 300 feet in height (including antenna), and (3) is built for the sole or primary purpose of
supporting any Federal Communications Commission (FCC) licensed antennas and their
associated facilities. The term communication tower shall not include amateur radio operators'
equipment licensed by the FCC. Communication towers are generally described as either
Monopole (freestanding), Guyed (anchored with guy wires), or Self Supporting (square,
triangular or pyramidal in plan view and constructed of steel lattice, tubular steel, reinforced
concrete, or wood).
"Governmental Purposes" means, but is not limited to public works, fire safety, law
enforcement, emergency management, emergency medical services or municipal water,
wastewater, gas, and electric utility operations.
Section 4. Imposition of Moratorium.
For a period commencing six (6) months from -- .. . ! z•-. - - December
15. 2017 and during the consideration of this Ordinance:
(a) No application for permit,authorization or any other official action of the City having the effect
of permitting or allowing the construction of wireless communication facilities in the public
rights-of-way within the City limits, may be filed, accepted or processed or approved by the
City of Sunny Isles Beach, except as may be required by applicable law. To the extent such an
application is submitted, the City staff is authorized to take action to deny such application
during the term of this moratorium within such time frame as may be required by applicable
law.
(b) No Zoning approval may be issued by the City of Sunny Isles Beach which would authorize
the construction of a wireless communication facility within the public rights-of-way.
(b) The imposition of the Moratorium is not intended to affect nor does it affect wireless
communication facilities serving governmental purposes.
Section 5. Inclusion in the Code. It is the intention of the City Commission, and it is hereby
ordained that the provisions of this Ordinance shall become and made a part of the City of Sunny Isles
Beach Code; that the sections of this Ordinance may be renumbered or re-lettered to accomplish such

intentions; and that the word "Ordinance" shall be changed to "Section" or other appropriate word, as
required.
Section 6. Severability. The provisions of this Ordinance are declared to be severable and if any
section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or
unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clause,
and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this
Ordinance shall stand notwithstanding the invalidity of any part.
Section 7. Repealer. All ordinances or part of ordinances in conflict herewith be and the same are
hereby repealed
Section 8. Effective Date. This Ordinance shall become effective upon adoption on second reading.

RE: Extension of Moratorium for Wireless Facilities
RECOMMENDATION
This Ordinance is recommended for approval.
REASONS
Staff needs additional time to continue to review the impacts of allowing the installation of
wireless facilities on Collins Avenue. The installation of wireless facilities on Collins Avenue
may negatively impact the on-going beautification project for Collins Avenue as it relates to the
undergrounding of electric lines and the installation of new street lights. Please note that the
neighboring coastal communities have yet to permit the installation of wireless facilities. As
such, staff is seeking a six (6) months extension of the moratorium to prohibit the installation of
wireless facilities on Collins Avenue.
