AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING
SECTION 172-5 (B) OF THE CITY CODE ENTITLED
"CHARITABLE DONATIONS" TO AUTHORIZE THE CITY
MANAGER TO MAKE CHARITABLE CONTRIBUTIONS
REGARDING IN-KIND GOODS AND SERVICES AND USE OF
GOVERNMENT FACILITIES UP TO $10,000.00 TO NON-
PROFIT ORGANIZATIONS; PROVIDING FOR REPEALER;
PROVIDING FOR SEVERABILITY; PROVIDING FOR
INCLUSION IN THE CITY CODE; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City Commission has made a commitment to support charitable
organizations which provide services to the residents of the City of Sunny Isles Beach; and
WHEREAS, Section C-7.6 of the City Charter, as well as Section 172-5 of the City Code,
require the affirmative votes of at least four (4) members of the City Commission at a public
meeting to approve charitable contributions for in-kind use of government facilities owned by the
City; and
WHEREAS, the City Commission wishes to amend Section 172-5 (B) of the City Code to
authorize the City Manager to make charitable contributions regarding in-kind use of government
facilities up to $10,000.00 in total cost of rent value to non-profit organizations.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISISON OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Ordinance upon
adoption hereof
Section 2. Amendment. Section 172-5 (B) of the Code of Ordinances of the City of Sunny Isles
Beach is hereby amended to read as follows:
§ 172-5 Charitable Donations
A. Financial Donations
B. In-Kind Goods and Services and Use of Facilities. In-kind goods and services
and use of the City's governmental facilities by charitable organizations must be
approved by the affirmative votes of at least four members of the City Commission
at a public meeting if such in-kind goods and services exceed a total cost of
$10.000.00 for rent value or cost of goods. In-kind goods and services for charitable
contributions under $10.000.00 in total cost maybe approved administratively by the
City Manager.

Section 3. Severability. If any section, subsection, clause or provision of this Ordinance is declared
invalid or unconstitutional by a court of competent jurisdiction, the remainder shall not be affected
by such invalidity.
Section 4. Repeal of,Conflicting Provisions. All Ordinances, or parts of Ordinances in conflict
herewith be, and the same, are hereby repealed
Section 5. Inclusion In The Code. It is the intention of the City Commission, and it is hereby
ordained that the provisions of this Ordinance shall become and made a part of the City of Sunny
Isles Beach Code; that the sections of this Ordinance may be renumbered or re-lettered to
accomplish such intentions; and that the word "Ordinance" shall be changed to "Section" or other
appropriate word.
Section 6. Effective Date. This Ordinance shall become effective ten (10) days after adoption on
second reading.

RE: Ordinance Amending Section 172-5 (B) of the City Code
Recommendation:
This Ordinance is presented for your consideration.
Reasons:
This Amendment allows the City Manager to approve the in-kind use of governmental facilities
to non-profit organizations to further support charitable organizations which provide services to
the residents of the City of Sunny Isle Beach. Under the proposed Ordinance, the City Manager
will have the authority to approve administratively in-kind use up to $10,000.00 of the actual rent
value under the City's rental policies.
