HomeMy WebLinkAboutReso 2012-2001 RESOLUTION NO. 2012- 12 pt 1 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH,FLORIDA,AUTHORIZING THE CHIEF OF POLICE, IN ACCORDANCE WITH THE COMPREHENSIVE CRIME CONTROL ACT OF 1984 TO EXPEND UP TO ONE HUNDRED SIXTY-THREE THOUSAND EIGHT HUNDRED TWENTY DOLLARS AND TWENTY-ONE CENTS ($163,820.21) FROM THE PARTIAL FEDERAL (DOJ) FORFEITURE FUNDS FOR THE PURCHASE OF A CITYWIDE AUTOMATIC LICENSE PLATE READING SYSTEM(ALPR)AND NEW COMPUTER SERVERS FOR THE POLICE DEPARTMENT; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984,the City and its Police Department are authorized to expend forfeiture funds from the established Department of Justice (DOJ) federal forfeiture account, for the approved programs or purchases intended to enhance law enforcement purposes; and WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984,upon the request of the Chief of Police to the governing body of a municipality,federally forfeited funds may be expended if accompanied by written certification by the Chief of Police that the request complies with the provisions of the Comprehensive Crime Control Act of 1984; and WHEREAS, the Chief of Police has submitted a request for the expenditure of up to One Hundred Sixty-Three Thousand Eight Hundred Twenty Dollars and Twenty-One Cents ($163,820.21) in federally forfeited funds in compliance with the aforementioned. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH,FLORIDA, AS FOLLOWS: Section 1. Expenditure of Partial Federally Forfeited Monies. Based on the attached certification, the Chief of Police is hereby authorized to spend up to One Hundred Sixty-Three Thousand Eight Hundred Twenty Dollars and Twenty-One Cents($163,820.21)from the established Department of Justice (DOJ) federal forfeitures account for the purchase of a Citywide Automatic License Plate Reading System (ALPR) and New Computer Servers for the Police Department. Section 2. Effective Date. This Resolution shall become effective immediately upon adoption. Maas, Chief of Police Michael A. Grandinetti, Police Captain DATE: 12/20/2012 RE: Approval to Expend Partial Forfeiture (DOJ) Funds for the purchase of a Citywide Automatic License Plate Reading System (ALPR) and New Computer Servers for the Police Department, in an amount not to exceed $163,820.21 RECOMMENDATION: It is recommended that the City Commission approve the expenditure of partial Federal (DOJ) Forfeiture Funds, previously awarded to the Police Department as the results of investigative participation in forfeiture and seizure cases. These funds are permissible by law to be spent for the purchases of police equipment and other law enforcement activities. It is requested that we be permitted to utilize up to $163,820.21 of said funds on deposit for such purpose. REASONS: The Sunny Isles Beach Police Department would use the requested funds to supplement the $86,809.14 of grant funds (COPS Technology Grant) already allocated for the purchase of a Citywide Automatic License Plate Reading System. The additional funds would be utilized to purchase three (3) police computer servers to replace the current, out of date servers. ADDITIONAL INFORMATION: One of the benefits of participating in and providing personnel into high intensity narcotics investigations is the sharing of confiscated proceeds for the enhancement of law enforcement.
