HomeMy WebLinkAboutReso 2018-2794 RESOLUTION NO. 2018- 2--1q1" A RESOLUTION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, ENCOURAGING THE FLORIDA LEGISLATURE TO ENACT MEASURES TO PROTECT SCHOOL CHILDREN AND OUR COMMUNITIES FROM GUN VIOLENCE,AND TO DEVELOP EFFECTIVE STRATEGIES TO ADDRESS, SUPPORT, AND PROVIDE RESOURCES FOR PERSONS SUFFERING FROM MENTAL HEALTH ISSUES, WHICH MAY INCLUDE ENACTING REASONABLE FIREARMS REGULATIONS (SUCH AS UNIVERSAL BACKGROUND CHECKS), PROVIDING RESOURCES TO ADDRESS MENTAL HEALTH ISSUES, ENHANCING "ACTIVE SHOOTER" AND RELATED SAFETY AND SECURITY TRAINING FOR STUDENTS, TEACHERS, ADMINISTRATORS, PARENTS, AND OTHERS, AND IMPLEMENTING ENHANCED SECURITY MEASURES FOR PUBLIC SCHOOLS AND OTHER COMMUNITY INSTITUTIONS; DIRECTING THE CITY CLERK TO DISTRIBUTE COPIES OF THIS RESOLUTION; PROVIDING AN EFFECTIVE DATE. WHEREAS, the recent tragedy at Marjory Stoneman Douglas High School in Parkland, Florida, has once again brought the issue of school gun violence and gun violence in our communities to the public's attention; and WHEREAS, as a City with a public school like the City of Parkland, the issue strongly resonates in the City of Sunny Isles Beach; and WHEREAS,under Florida law,the regulation of firearms has been preempted to the Florida Legislature, and therefore the City Commission generally lacks the authority to legislate in this area; and WHEREAS, the City Commission believes that the Florida Legislature should consider all potential methods for protecting school children from gun violence, as well as effective strategies to address, support, and provide resources for persons suffering from mental health issues; and WHEREAS, such measures may include enacting reasonable firearms regulations (such as universal background checks), providing resources to address mental health issues, enhancing "active shooter" and related safety and security training for students, teachers, administrators,parents, and others, and implementing enhanced security measures for public schools and other community institution. Page 1 of 3 NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Encouraging Florida Legislature To Enact Reasonable Firearms Regulations. The City Commission of the City of Sunny Isles Beach strongly encourages the Florida Legislature to take up the issues of school gun violence and gun violence in our communities, considering all potential methods for protecting school children from gun violence and develop effective strategies to address, support, and provide resources for persons suffering from mental health issues, which may include: enacting reasonable firearms regulations (such as universal background checks); providing resources to address mental health issues; enhancing "active shooter" and related safety and security training for students, teachers, administrators,parents, and others; and implementing enhanced security measures for public schools and other community institutions. Section 2. Authorization of the City Manager. The City Manager is hereby authorized to do all things necessary to effectuate this Resolution Section 3. Direction to the City Clerk. The City Clerk hereby directed to send a certified copy of this Resolution to the President of the Florida Senate, Chairperson of the Florida House of Representatives, Senator Daphne Campbell, Representative Joseph Geller and City lobbyist Ron Book. REASONS: It is well known that the City of Sunny Isles Beach has a special relationship with the Sunny Isles Beach K-8 Community School. This special relationship is based on the fact that the City contributed $12.5 million to construct the school and has continued to provide financial and in kind services to the school throughout its history. In terms of in- kind services, the City has allocated a school resource police officer to the school and has continuously provided traffic safety service with police officers and crossing guards. The City has allowed the school to use Pelican Park as a facility for school recreation activities. Additionally, the City has made its resources available to the school to ensure the safety of the children since our school first opened. City and school officials have always and are currently working diligently on ways to make our school safer. However, it is important to note that in certain areas that the City has no authority to act. For example, the regulations of firearms has been preempted to the Florida Legislature, and the City Commission lacks the authority to legislate in this area. The impetus for the Legislature to take action is clearly there. As the Mayor of this City, I certainly believe more should be done to 27 protect our school age children.As such, I am asking my colleagues on this Commission to support this resolution requesting the Florida Legislature to take the following action: 1) Enact measures to protect school children and our communities from gun violence; 2) Provide resources for persons with mental health issues; 3) Enact reasonable firearm regulations; 4) Provide Active Shooter and related safety and security training for students and teachers, administrators and parents; 5) Implement Enhanced Security Measures for public schools and other community Institutions. While the Florida Legislature has proposed certain regulations to combat gun violence in schools, the City Commission believes that the Florida Legislature should consider all potential methods for protecting school children from gun violence.
