FOR ADDITIONAL LANDSCAPING SERVICES , IN AN AMOUNT NOT TO EXCEED FOUR HUNDRED THOUSAND DOLLARS (5400,000.00), ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE MAYOR TO EXECUTE SAID AMENDMENT; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on August 21, 2012 via Resolution No. 2012-1953 the City Commission awarded RFP No. 12-05-01 and entered into an Agreement with Lukes-Sawgrass Landscaping,Inc.to provide Citywide Landscape Maintenance Services, in an amount not to exceed Six Hundred Fifty Thousand Dollars ($650,000.00) for a one year period; and WHEREAS,staff has determined that additional landscaping work is needed throughout the City; and WHEREAS, the City being satisfied with the landscaping maintenance services of Lukes- Sawgrass Landscaping, Inc. and who has expressed its ability and desire to provide these services; and WHEREAS, the City Commission wishes to approve the First Amendment to Agreement with Lukes-Sawgrass Landscaping, Inc. to provide additional landscaping services throughout the City, in an amount not to exceed Four Hundred Thousand Dollars($400,000.00),attached hereto as Exhibit"A",bringing the total contract amount not to exceed to One Million Fifty Thousand Dollars ($1,050,000.00). NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Approval of First Amendment to Agreement. The City Commission hereby approves the First Amendment to Agreement with Lukes-Sawgrass Landscaping, Inc. to provide additional landscaping services throughout the City, in an amount not to exceed Four Hundred Thousand Dollars ($400,000.001 attached hereto as Exhibit "A". Section 2. Authorization of Mayor. The Mayor is hereby authorized to execute said Amendment. Section 3. Authorization of City Manager. CONTRACT NO. C1213-003 This First Amendment to the Agreement between the City of Sunny Isles Beach and Lukes' Landscaping. Inc., d/b/a/ Lukes-Sawgrass Landscape. Inc., executed this 2.1g day of February, 2013, is made a part of the original Agreement between the parties dated August 21, 2012, ("the Agreement") between the City of Sunny Isles Beach ("City") and Lukes' Landscaping, Inc. ("Contractor") attached hereto as Attachment "B", whose Federal Identification 4 is SI• lSfi1lfl . The City and Contractor hereby agree as follows: 1. ADDITIONAL SERVICES TO BE PERFORMED. The scope of services, as set forth in Section 2 of the original Agreement, is hereby amended to include additional landscaping services throughout the City ("Additional Services"), as more particularly set forth in Attachment "A", attached hereto and incorporated herein by reference. 2. COST. The payments to the Contractor, as set forth in Section 5 of the original Agreement, is hereby amended to include additional compensation for the additional services to be performed, in an amount not to exceed Four Hundred Thousand Dollars ($400,000.00), bringing the total contact amount not to exceed One Million Fifty Thousand Dollars ($1,050,000.00). 3. OTHER PROVISIONS REMAIN IN EFFECT: Except as specifically modified herein, all terms and conditions of the original Agreement between the parties, dated August 21, 2012, shall remain in full force and effect. REASONS: In August 2012, the City entered into an agreement with Luke's-Sawgrass Landscaping, Inc. for Citywide Landscaping Services. Resolution No. 2012-1953.capped expenses at $650,000.00, which included regular on-going maintenance as well as special projects. The 'special projects' allocation was $100,000. Once Luke's-Sawgrass was on board and a full assessment of the condition of Right-of- Ways and Parks was complete, a good portion of the special projects allocation was used to bring these visible areas up to standard. To date, the City has spent nearly $100,000 on the following 'special projects': • Spraying of all the trees in the City the first month of service $9,000. • Hurricane Sandy repairs - 54,507 • Line of Site Trimming / Collins - $8,882 • Golden Shores Park Improvements - 34,347 • Clean up of Bella Vista Bay - $3,628 • Pier Park Palm Relocation - $2,000 • Mulch Sunny Isles Blvd. - $2,400 • Margolis Seeding and field work - $2,800 http://sibagenda.sibfl.net/Agenda/Preview.aspx?ItemID=982&MeetinglD=O&MeetingDate... 2/15/2013 Preview Page 2 of 2 • Planting of TCP/Winston Towers 'pocket' on AlA - $4,786 • East bound shrubs - S4,641 • Traffic Accident repairs (allocation almost used) - $10,000 • Flower plantings - $10,000 • Center median plantings - S4,267 • Sand for event - 51,200 • Irrigation supply startup - $2,000 • Irrigation repairs - $8,000 • 174 Street Improvements - $13,000 There are still several projects that remain to be completed during this initial contract term such as: Median work to remove and replace all Crown of Thorns, Tree planting and work to improve the Retention Ponds; Annual flower replacement citywide. Medjool Drenching, New Medjool Planting Phase I and Phase II, Improvements in parking areas (Lehman and Sunny Isles Blvd.) An additional $400.000.00 is estimated to cover all of the above projects which are expected to be completed this fiscal year. See attached spreadsheet for detailed cost estimates for each of the above named projects and other capital projects that require landscaping material and maintenance. ADDITIONAL INFORMATION: A formal proposal for each project will be submitted by Luke's Sawgrass Landscaping based on the unit pricing currently under contract as each project's specifications are complete.
