HomeMy WebLinkAboutReso 2013-2020 RESOLUTION NO. 2013 - 2,02,0 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING THE DESIGN/BUILD BUDGET FOR GATEWAY PARK, PARKING GARAGE AND PEDESTRIAN BRIDGE(THE"PROJECT")FROM A GUARANTEED MAXIMUM PRICE OF S16.5 MILLION DOLLARS TO AN AMOUNT NOT TO EXCEED $20 MILLION DOLLARS (INCLUSIVE OF ALL PAYMENTS MADE TO CONTRACTOR TO DATE) TO PAY FOR ADDITIONAL COSTS ASSOCIATED WITH THE PROPOSED REDESIGNED PARKING GARAGE AS MORE SPECIFICALLY DESCRIBED IN THE DETAILED LIST PROVIDED BY THE CITY ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE CITY MANAGER AND THE CITY ATTORNEY TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,by Resolution No. 2011-1735,adopted on July 21,2011,the City Commission entered into a Design-Build Agreement with 4M Investors,LLC("Contractor")for certain parcels of real property located in the City which the City oWms and upon which it intends to have constructed site improvements consisting of a Park, Parking Garage and Pedestrian Bridge; and WHEREAS, by Resolution No. 2012-1883, adopted on March 28, 2012, the City entered into a Second Amendment to the Agreement with the Contractor to revise the scope of the project to include additional amenities to the Park and Parking Garage,and a Pedestrian Bridge in the amount not to exceed a guaranteed maximum of$16,500,000.00; and WHEREAS, the City wishes to amend the guaranteed maximum price for the Project from $16.5 Million Dollars to an amount not to exceed $20 Million Dollars (inclusive of all payments made to Contractor to Date) to pay for additional costs associated with the proposed redesigned parking garage, and requiring Contractor to provide the City with a modified guaranteed maximum price inclusive of the costs for the redesigned parking garage, no later than February 18, 2013. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Amending Construction Budget. The City Commission hereby approves a revised Design/Build Budget for Gateway Park, Parking Garage,and Pedestrian Bridge(the"Project")from a guaranteed maximum price of $16.5 Million Dollars to an amount not to exceed $20 Million Dollars(inclusive of all payments made to Contractor to Date)to pay for additional costs associated with the proposed redesigned parking garage as more specifically described in the detailed list attached hereto as Exhibit"A", and requiring 4M Investors, LLC to provide the City with a modified guaranteed maximum price inclusive of the costs for the redesigned parking garage, no later than February 18, 2013. Section 2. Authorization of City Manager and City Attorney. Exhibit "A" GATEWAY PARK GARAGE SHOPPING LIST 12/14/12 Listed below are the redesign criteria requested by the City for the Gateway Park Garage. This list is being compiled after an initial meeting that was held between Jaime Eisen, Helen Gray, Eduardo Castineira, and Clay Parker on 12/4/2012: 1. New garage design to be divided into two zones with 60' clear each side providing parking spaces 18' deep, parking access drive 24' wide. This will be similar to Heritage design. 2. No interior columns(open design), similar to Heritage. 3. Ground level height will be 15' slab to slab, to allow the development of usable ground floor space for future facility. Ground level clear height to be from 12'6"to 14'. 4. Additional floors, floor to floor height should be adjusted to maintain a minimum clear headroom height with sprinkler system at 7' 6". 5. Enclose approximately 16,000 square feet of ground floor air conditioned space on the South side of parking garage for future facility. 6. The South perimeter wall of the parking structure to be designed utilizing a transfer beam to carry the load of the upper floors of the garage, allowing for the open design of the enclosed 16,000 square foot space, all the way to the south wall. 7. The South and East perimeter walls of the enclosed 16,000 square feet space should utilize as much glass storefront as possible. 8. All glazing for the entire project shall utilize impact safety glass to meet the High Wind Zones of the Florida Building Code. 9. Exhaust vents and electrical service through ramp area to the north (not to the roof). 10. Air Conditioning/Refrigeration Condensers to be placed on the North side of the building. 11. Maintain design for 308 parking spaces as spelled out in the Design-Build agreement. 12. All handicap parking on ground level. (8 spaces) 13. The current design shows the West end of the parking structure at 18' 6" to the property line. The west setback by zoning ordinance is 15'. However, it could be reduced, as needed, for lengthening of parking structure to meet the 6% grade for parking on ramp. If needed, the West set back could be reduced to a minimum of 10' by variance. 14. The previous design located the entrance drives 50' east of the west end of the garage. This was done to support the two future elevators that are not going to be needed and could be moved closer to the west end, giving us the needed additional length to allow for parking ramps. 15. Provide adequate Electrical, Plumbing, and Mechanical rough-ins to prepare the 16,000 square feet of ground floor space, to accommodate the final occupational use of the space. 16. Design a 10' public corridor along the North side of the 16,000 square feet of ground floor space, at the Center of the garage facility. Include 2 separate glassed-in store fronts for ingress and egress into the 16,000 square foot space. Likewise, provide 2 service entrances leading to the corridor. Within this corridor, design an additional 10' secured service corridor mid-way, which will cut thru the underside of the ramp portion of the parking garage. This service corridor will provide pickup and delivery service to the North side of the building. 17. Move the Southeast elevator/stair tower to the Northeast area of the building to provide a better park view for the enclosed space. 18. The Heritage parking garage has two 2,500 pound 7' by 5' elevator lifts. We would prefer 2 lifts similar to this design. The 3 stair shafts under the current design would be adequate. 19. Provide a 21' by 220' plaza area along the south side of the 16,000 square feet of ground floor space to accommodate approximately 4,500 square feet of outdoor patio seating area. 20. Finished park bathrooms to remain the same as the original calculations and design separate roughed out bathrooms for enclosed facility space to meet the minimum of an assembly use area. 21. Finished ground floor elevation to be 8'(NGVD 1929,) 1 foot above FEMA's Flood Plain. 22. Provide Handicap accessibility and egress from street sidewalk area to all enclosed areas of the parking garage. 23. Structural ground floor slab to be designed utilizing interior piles and grade beams. 24. Create sidewalk access on the North side of parking garage to pedestrian bridge and park/playground area. 25. Provide gated fence area on the East side of parking garage allowing for the closure of the park, leaving the egress going in and out of the parking garage/enclosed area open at all times. • 26. Provide Office space similar to the original design. 27. Provide all other enclosed areas of the original design on this design as allowed and any remaining usable space under the ramp for storage 28. Provide future concession stand area similar to the original design. 29. Create façade on North/East/South side of the garage. (Not a screen type as the one used on Heritage parking garage) 30. Solid crash wall/security barrier on top deck sloped or angled with no eyebrows for sitters. 31. Building to have fire sprinkler system throughout. 32. Provide enclosed Dumpster/Trash room on the North side, near the service corridor. 33. Service entrance should coincide to the dumpster/service corridor area. 34. Wiring and conduit for security cameras. 35. Vehicular access, both on north and south, is at West end of the building. Provide ground level speed humps at these entrances. 36. East bound entrance/exit should be lined up with the traffic light. 37. Provide Bicycle/Motorcycle racks similar to original design. 38. Russo, City Manager�/lY DATE: January 30, 2013 ll RE: Gateway Park Design and Construction Budget The purpose of this memorandum is to provide you with a status report'on the on-going negotiations with representatives of 4M Investors, LLC (the "Contractor") regarding the additional costs for the proposed redesigned of the parking garage. Background Based on instructions provided by the City Commission, I have asked the Contractor to redesign the parking garage to include a multi-purpose shell on the first floor based on the programming submitted in the detailed list discussed below. As you know, by letter dated January 15, 2013, the Contractor submitted a redesigned fee in the amount of $1,290,000.00 for the redesigned of the parking (letter enclosed). In providing the redesigned fee, the Contractor stated that design plans ("current drawings") submitted thus far to the City cannot be used for the redesigned project even though the City had paid to the Contractor $1.3 Million Dollars for such plans. Analysis of Contractor's Redesigned Fee Attached is a letter from Nina Gladstone of AECOM Design, the architect's for both the Government Center and Heritage Park, providing a review of the redesign proposal submitted by the Contractor for the redesigned of Gateway Park. Ms. Gladstone's review was based on a request from me via a letter dated January 25, 2013 requesting her firm review of the Contractor's cost proposal in this context of a design-build project (letter enclosed). Based upon her review of the proposal and review of relevant documents, Ms. Gladstone stated that the current drawings can be used except for the drawings for the parking garage. Simply put, Ms. Gladstone stated that the modification of the parking garage "would have a minimal affect on the drawings for the park, mostly coordinating entrances and site re-grading." As such, Ms. Gladstone concluded that a redesigned fee or costs for "the parking garage and shell space to be $826,130.00." This.amount is considerably less than the amount submitted by the Contractor. Aeenda Item 3 A Date I - 30- 13 Additionally, Ms. Gladstone opined that the City should obtain the total costs of construction before proceeding with any redesign under a Design-Build Agreement. Specifically, she stated that as a matter of industry practice design/construction costs are inclusive in a Design/Build Agreement. Budget Request To this end, it is clear that we are at the point where the City Commission must give staff a maximum budget amount to work within. This action will give us a benchmark to work from in order to evaluate a total proposed cost from the Contractor, in order for this project to proceed further. (Enclosed is Resolution requesting approval of a revised budget) Specifically, staff is asking for a maximum budget amount and, the Commission's confirmation of the total Gateway Park major project components, inclusive of the following: (1) Redesigned Parking Garage Inclusive of Multipurpose facility; (2) Park amenities and performance stage; (3) Pedestrian overpass bridge. To provide clarity to the Contractor regarding the features of the redesigned parking garage, the City provided the Contractor with a "Shopping List" document dated December 14, 2012 (copy enclosed). The City has not requested any changes to the Park area features, which are provided for in the current drawings for the Park. These drawings includes a great lawn with, butterfly garden, water feature, playground, performing art stage at 42" in height and a pedestrian bridge over the west bound lanes of Sunny Isles Boulevard (State Road 826). For the Commission's reference and information, the cost for Heritage Park and Parking Garage inclusive of design and construction costs was approximately $15.6 million. After our various discussions with you and your staff and considering the December 14. 2012 "shopping list." we have a good'understanding of the nature and scope of the changes to the Project. As you know, the design drawings, as well the permit plans must be re-done to reflect the changes. The plans for both the Garage and Park components of the Project are affected. The substantial changes to the Garage (with the addition of the new banquet hall/restaurant) result in the need to completely re-engineer the structure, including changes in . occupancy involving all architectural and engineering disciplines. Unfortunately, we are not able to utilize the existing plans. An entirely new set of architectural and engineering plans are necessary to accomplish the changes. While the requested changes to the Park are rather insignificant, the new design/layout of the Garage (including the banquet hall) necessitates the redesign/alteration of several areas of the Park. These include revisions in the design of the water/sewer and other utility systems. sprinkler system. lighting. access cuts and outdoor dining areas, etc. To better understand the overall effect the changes to the Project have on the design and permit plans, our architect has prepared a brief memorandum with a breakdown of the cost of the additional architectural and engineering services. which is enclosed with this letter. Corporate Registration/AA0002273 Architect Registration/AR 14049 `� Mr.Joe Milton 4M Investors.LLC January 11,2013 2) The changes affect Architecture, Landscape Architecture, Civil, Mechanical, Electrical, Plumbing, and Structural Engineering as described below. a) The south edge of the garage building will be re-designed as an exterior dining terrace (serving the restaurants) therefore changing the plans from its current garden concept. b) The north edge of the garage building will be re-designed to accommodate the service and back-of-house requirements of the restaurant facility, including all of the utility requirements for same facilities. c) The west edge of the garage building will now have a set-back of 10'-0° therefore requiring adjustments to the current landscape plan. d) The east edge Plaza area requires redesign since the parking garage building is longer than the previous concept. e) The water wall and children water feature will require adjustments to its size and layout in order to accommodate pedestrian accessibility from the north sidewalk and the future pedestrian bridge. f) We need to re-design the sprinkler system drawings as it relates to all of the affected green areas and new planting areas. g) We need to re-design the site lighting plan as it relates to all of the affected pedestrian paths, green areas and new planting areas. It is also anticipated that the site lighting concept will need to be a bit more extensive, especially as it relates to the restaurant facility (at the ground level) and the exterior dining areas. h) The civil plans will require substantial modifications as it relates to new curb cuts, water & sewer connections and the more complex utility systems that will serve the multiple restrooms, kitchens and the facility in general. I am certain that there are many other lesser items that are also affected by the re-design, but these are the main items that I can think off at this moment. Subject: Gateway Park and Parking Garage Distribution: Agustin Barrera Chris, In your letter dated January 25, 2013, the City of Sunny Isles Beach has asked AECOM to review the re-design proposal drawings submitted by 4M Investors, LLC regarding the Gateway Park and Parking Garage. Based on our review of the Axioma3 Architects drawings for the parking garage, the drawings would have to be completely revised to incorporate the 16,000 SF shell space on the ground floor and a revised structural grid to provide as much unobstructed space in the shell space as possible. In our opinion, this modification would have a minimal affect on the drawings for the park, mostly coordinating entrances and site re-grading. We have based an analysis of fees (See Attachment A) for this re-design on the State of Florida Department of Management Services AE Fee Calculator which is a tool available to the public and professionals on-line. It is a good baseline used by many Counties in procuring professional services. I have included those guidelines with this letter. We estimate the cost to redesign the garage and shell space to be $826,130. This fee would include revised contract documents, permitting, and construction administration services.The information I have provided above, is only an estimate of design costs based on the information we have been provided. The below the line additional services items and expenses costs are based on our professional opinion and on other similar projects.These items would need further discussion and development. You also asked about design-build projects and the information that the Owner should be provided by the design builder. Typically, in design build projects, the Owner enters into an agreement with the design builder regarding scope of work and the cost of the work. See below excerpt for the American Institute of Architects: memoranaum Page 2 Date:January 29, 2013 A141-2004,Agreement Between Owner and Design-Builder AIA Document A141”4-2004 replaces ALA Document A191"4-1996 and consists of the agreement and three exhibits:Exhibit A,Terms and Conditions; Exhibit B, Determination of the Cost of the Work;and Exhibit C, Insurance and Bonds. Exhibit B is not applicable if the parties select to use a stipulated sum.AIA Document A141- 2004 obligates the design-builder to execute fully the work required by the design-build documents,which include A141 with its attached exhibits,the project criteria and the design-builder's proposal, including any revisions to those documents accepted by the owner,supplementary and other conditions,addenda and modifications.The Agreement requires the parties to select the payment type from three choices: (1)Stipulated Sum, (2)cost of the work plus design-builder's fee,and(3)cost of the work plus design-builder's fee with a guaranteed maximum price. A141-2004 with its attached exhibits forms the nucleus of the design-build contract. Because A141 includes its own terms and conditions, it does not use AIA Document A201 T".
