HomeMy WebLinkAboutReso 2018-2817 RESOLUTION NO. 2018- 2- (1 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE CHIEF OF POLICE, IN ACCORDANCE WITH THE COMPREHENSIVE CRIME CONTROL ACT OF 1984, AND IN ACCORDANCE WITH SECTION 932.7055,F.S.,TO EXPEND PARTIAL FORFEITURE FUNDS FROM THE DEPARTMENT OF JUSTICE (DOJ)FOR THE PURCHASE OF TWO(2) NETWORK FIREWALLS, TWO (2) NETWORK SWITCHES, LAPTOP COMPUTERS, SAFETY ACCESSORIES FOR THE MARINE PATROL BOAT,AND OFFICE FURNITURE FOR THE POLICE DEPARTMENT, IN AN AMOUNT NOT TO EXCEED ONE HUNDRED TWENTY-FIVE THOUSAND SIX HUNDRED THIRTY-ONE DOLLARS AND TEN CENTS (S125,631.10); PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City and its Police Department are authorized to expend forfeiture funds from the established Department of Justice (DOJ) federal forfeiture account, for the approved programs or purchases intended to enhance law enforcement purposes; and WHEREAS, in accordance with Florida Statutes §932.7055(4)(c)(3) specifically, a law enforcement agency that acquires at least$15,000.00 pursuant to the Florida Contraband Forfeiture Act with a fiscal year must expend or donate no less than 15% of such proceeds for the support or operation of any drug treatment, drug abuse education, drug prevention, crime prevention, safe neighborhood, school resource officer programs or for other law enforcement purposes; and WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984 and Florida Statutes §932.7055(4)(b) upon the request of the Chief of Police to the governing body of a municipality, liens and forfeiture funds may be expended if accompanied by written certification that the request complies with the provisions of the aforementioned subsections; and WHEREAS,the Chief of Police has submitted a request for the purchase of two(2)network firewalls,two(2)network switches, laptop computers, safety accessories for the marine patrol boat, and office furniture for the Police Department, in an amount not to exceed One Hundred Twenty- Five Thousand Six Hundred Thirty-One Dollars and Ten Cents ($125,631.10) from DOJ forfeiture funds in compliance with the aforementioned legal requirements. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Expenditure of Partial Federally Forfeited Monies. Based on the attached certification, the Chief of Police is hereby authorized to spend an amount not to exceed One Hundred Twenty-Five Thousand Six Hundred Thirty-One Dollars and Ten Cents ($125,631.10) from the established Department of Justice (DOJ) federal forfeitures account for the purchase of two (2) network firewalls,two(2)network switches, laptop computers, safety accessories for the marine patrol boat, and office furniture for the Police Department. Grandinetti, Police Captain DATE: 5/17/2018 RE: Authorization to Expend Partial Forfeiture (DOJ)Funds RECOMMENDATION: • It is recommended that the City Commission approve the expenditure of partial Federal (DOJ) Forfeiture Funds previously awarded to the Police Department as the results of investigative participation in forfeiture and seizure cases in an amount not to exceed $125,631.10 REASONS: The Forfeiture Funds will be used to purchase two PALO ALTO PA- 3220 Network Firewalls, two Catalyst 4500-x 16 Port 10G IP Switches, new office furniture for the Police Department, the replacement of the inflatable boat bumpers on the police boat, and a new laptop computer for our detached detective, in an amount not to exceed $125,631.10. ADDITIONAL INFORMATION: These funds are permissible by law to be spent for the purchases of police equipment and other law enforcement activities. The attached list of equipment will enhance our police operations and it is requested that we be permitted to utilize up to $125,631.10 of said funds on deposit for such purpose. The Sunny Isles Beach Police Department actively participates in DEA and HIDTA(High Intensity Drug Trafficking Area) Initiative Groups that conduct numerous ongoing proactive investigations and now has a need for the attached listed law enforcement equipment. One of the benefits of participating in and providing personnel into high intensity narcotics investigations is the sharing of confiscated proceeds for the enhancement of law enforcement.
