A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, APPROVING DESIGN PLANS
PREPARED BY MIAMI-DADE COUNTY FOR THE WATER AND
SEWER DEPARTMENT PUMP STATION SITE #301, LOCATED
AT 350 SUNNY ISLES BOULEVARD, ATTACHED HERETO AS
EXHIBIT "A"; AUTHORIZING THE MAYOR TO ENTER INTO A
NEW LEASE AGREEMENT WITH MIAMI-DADE COUNTY FOR
A PASSIVE PARK, ATTACHED HERETO, IN SUBSTANTIALLY
THE SAME FORM, AS EXHIBIT "B"; PROVIDING AUTHORITY
TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS
RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Sunny Isles Beach has been working with Miami-Dade Water
and Sewer Department (WASD) to reach an agreement to modify and beautify the current sewer
pump station site #301, located at 350 Sunny Isles Boulevard ("Pump Station"); and
WHEREAS, the City intends to lease a certain area adjacent to the Pump Station to create
a passive park, walkway and landscape improvements for the public's community interest and
welfare; and
WHEREAS, the City Commission wishes to approve Design Plans prepared by Miami-
Dade County for the Water and Sewer Department Pump Station Site #301, located at 305 Sunny
Isles Boulevard, Sunny Isles, Florida; and
WHEREAS, the City wishes to enter into a new Lease Agreement with Miami-Dade
County for a passive park located adjacent to the Pump Station.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Approval of Lease Agreement. The City Commission hereby approves Design
Plans prepared by Miami-Dade County for the Water and Sewer Department Pump Station Site
#301, located at 350 Sunny Isles Boulevard, attached as Exhibit "A".
Section 2. Authorization of Mayor. The Mayor is hereby authorized to execute a new Lease
Agreement with Miami-Dade County for a passive park, located at 350 Sunny Isles Boulevard,
attached hereto, in substantially the same form, as Exhibit "B".
Section 3. Authorization of City Manager and City Attorney. The City Manager and City
Attorney are hereby authorized to do all things necessary to effectuate the terms of this Resolution.
Section 4. Effective Date. This Resolution.shall become effective upon adoption.

This Resolution is presented for your consideration.
REASONS:
The Miami-Dade County Water and Sewer Department (WASD) owns
the existing pump station and property located at 350 Sunny Isles Blvd.
The City has continuously pursue a lease agreement for a portion of the
property since WASD must reconstruct the pump station. WASD is on
the track to completely demolished the existing pump station and is
presenting you with plans and estimate schedule for the fully
reconstructed pump station. In addition, the WASD has agreed with the
proposed lease agreement to allow the City to occupy certain areas
described on exhibit B of the agreement. This agreement, if approved
• by the County,will be for 20 years with 2-10 years option to renew.
