A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, APPROVING THE REQUEST
SUBMITTED BY A3 DEVELOPMENT, LLC ("APPLICANT") FOR AN
OFF-SITE TEMPORARY USE CONSTRUCTION TRAILER AND
PARKING TO BE LOCATED AT 17775 NORTH BAY ROAD AND 17505
NORTH BAY ROAD TO FACILITATE THE CONSTRUCTION OF THE
ESTATES OF ACQUALINA PROJECT; PROVIDING THE CITY
MANAGER AND CITY ATTORNEY WITH THE AUTHORITY TO DO
ALL THINGS NECESSARY TO EFFECTUATE THE TERMS OF THIS
RESOLUTION; PROVIDING FOR AND EFFECTIVE DATE.
WHEREAS, on September 18, 2014, the City Commission approved Resolution No. 14-
Z-144 for the project located at 17901 Collins Avenue; and
WHEREAS, the Applicant is the developer of the Estates at Acqualina project located at
17901 Collins Avenue; and
WHEREAS, the Applicant is seeking approval of an off-site temporary use of a
construction trailer and parking for the project to be located at 17775 North Bay Road and 17505
North Bay Road; and
WHEREAS, the City Commission wishes to approve the request for the off-site
temporary use of a construction trailer and parking for the project to be located at 17775 North
Bay Road and 17505 North Bay Road.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Approval of Application. The City Commission hereby approves A3 Developer,
LLC's request for the off-site temporary use of a construction trailer and parking for the Estates
of Acqualina project to be located at 17775 North Bay Road and 17505 North Bay Road subject
to the conditions set forth herein.
Section 2. Conditions. The Applicant is required to comply with the following conditions:
(1) The off-site construction trailer shall be for the duration of the construction of
the project
(2) The construction trailer is proposed at the south west corner of the St. Mary
Magdalen Catholic Church with additional parking at the east side of the parking
lot of the Marian Towers property.
(3) The construction trailer will be buffered with a black aluminum picket fence
and landscaping from street view.

Section 3. Authorization of City Manager and City Attorney. The City Manager and City
attorney are hereby authorized to do all things necessary to effectuate the terms of this
Resolution.
Section 4. Effective Date. This Resolution shall become effective upon adoption.

RE: Temporary Use Approval for off-site Construction Trailer
and Parking
RECOMMENDATION:
This Resolution is presented for your consideration.
REASONS:
A3 Development, LLC ("Applicant") as developer of the Estates at
Acqualina Project, is requesting approval of an off-site temporary use
for the construction trailer and parking for the Project. The Applicant
has proposed an off-site construction trailer and parking located at
17775 North Bay Road and 17505 North Bay Road respectively. The
request is for the duration of the construction of the Project. The
construction trailer is proposed at south west corner of the St. Mary
Magdalen Catholic Church and with additional parking at the east side
of the parking lot of the Marian Towers property. The construction
trailer will be buffered with a black aluminum picket fence and
