A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, APPROVING SITE PLAN
CONDITION MODIFICATION FOR THE ESTATES AT
ACQUALINA PROJECT BY A3 DEVELOPMENT, LLC (THE
"APPLICANT") FOR PROJECT LOCATED AT 17901 COLLINS
AVENUE; PROVIDING THE CITY MANAGER AND CITY
ATTORNEY WITH THE AUTHORITY TO DO ALL THINGS
NECESSARY TO EFFECTUATE THE TERMS OF THIS
RESOLUTION; PROVIDING FOR AND EFFECTIVE DATE.
WHEREAS, the City Commission approved the site plan application for A3
Development, LLC ("Applicant") pursuant to Zoning Resolution Nos. 18-Z-165, 15-Z-153, and
14-Z-144 ("Resolutions"); and
WHEREAS, the Applicant has requested the modification of certain conditions stipulated
under the Resolutions; and,
WHEREAS, the City Commission wishes to approve the modification of the conditions
of the approved site plan based on the recommendation of the Office of the City Manager.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Approval of Site Plan Condition Modification. The City Commission hereby
approves the modification of conditions for the approved site plan for the Project based on the
recommendation of the Office of the City Manager subject to certain conditions. The following
are the conditions being modified:
Pursuant Resolution 18-Z-165 Condition (9):
If the Applicant intends to use the Golden Strand Parking Lot for parking purposes, the
Applicant shall submit a site plan application for the Golden Strand Parking Lot and such
site plan shall designate parking for the Acqualina Sales Center Offices and the Estates of
Acqualina to ensure compliance with parking requirements. Such application must be
submitted prior to the issuance of the below grade building permit or master building
permit of a TCO or CO for Phase I for the Estates at Acqualina. Such Parking Lot shall
obtain Temporary Certificate of Occupancy (TCO) or Certificate of Occupancy (CO)
prior to the issuance of the TCO or CO of the North Tower of the Project.
Pursuant Resolution 18-Z-165 Condition (14):
That the Applicant shall obtain approval from the Public Art Advisory Committee

(PAAC) for the required art in public places of the project, such approval shall be
obtained prior issuance of the below grade or master building permit of Phase I of the
project. The Project's Art in Public Places conditions has been satisfied as presented
under Zoning Application PZ2015-08 and Zoning Resolution 15-Z-153.
Section 2. Authorization of City Manager and City Attorney. The City Manager and City
Attorney are hereby authorized to do all things necessary to effectuate the terms of this
Resolution.
Section 3. Effective Date. This Resolution shall become effective upon adoption.

Estates at Acqualina- Site Plan condition modification

RECOMMENDATION:
This Resolution is presented for your consideration.
REASONS:
A3 Development LLC. is the Applicant for the Estates at Acqualina
Project. The Applicant is requesting to modify condition Nos. Nine (9)
and Fourteen (14) of the approved Resolution 18-Z-165 adopted on
April 19, 2018. Condition No. 9 is requesting to obtain TCO or.CO at a
proposed Parking Structure prior issuance of TCO or CO for the North
Tower instead of providing a site plan application prior the issuance of
the below grade or master permit for the South Tower. Condition No.
14 is requesting to accept the approved fountain which was part of
Resolution 15-Z-153 adopted on April 16, 2015 as the Project Art
component.
