A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, AMENDED ZONING
RESOLUTION NO. 09 -Z -119 TO REQUIRE ADDITIONAL
CONTRIBUTION FROM ARIE SUNNY ISLES INC. FOR THE
USE OF TWO (2) PARKING SPACES IN THE MUNICIPAL
PARKING GARAGE LOCATED ON SUNNY ISLES
BOULEVARD; PROVIDING THE CITY MANAGER AND THE
CITY ATTORNEY WITH THE AUTHORITY TO DO ALL
THINGS NECESSARY TO EFFECTUATE THIS
RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Commission approved the Zoning Resolution No. 09 -Z -119,
adopted on November 19, 2009. for the project known as One Netanya, which is being
developed by Arie Sunny Isles, Inc. ( "Developer'); and
WHEREAS, Pursuant to Section IV(11) of Resolution No. 09 -Z -119 the Developer
agreed to pay $264,000 for 24 parking spaces pursuant to the Public Parking Bonus Program
under Section 265 -37 F. (1) (g) of the City of Sunny Isles Beach Code: and
WHEREAS, the Developer has commenced the building permit process and is in need
of two (2) additional parking spaces in the municipal garage: and
WHEREAS, the City Commission requests a contribution of Twenty Thousand
($20,000) for each additional parking spaces, for a total of Forty Thousand ($40,000).
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Incorporation of Recitals. The foregoing recitals are true and correct and are
incorporated herein by reference as if they are fully set forth herein.
Section 2. Parking Contribution. Pursuant to Section 265 -37 F. (1) (g) of the City Code and
in accordance with Zoning Resolution No.09 -Z -119, the City Commission hereby requires Arie
Sunny Isles Inc. ( "Developer') to pay a contribution of Fort Thousand Dollars ($40,000) for the
use of two (2) additional parking spaces in the municipal parking garage to be located on Sunny
Isles Boulevard. The contribution is required if the Developer is in need of the parking spaces
prior to the issuance of a building permit for the One Netanya Project. No contribution is
required if the Developer is in compliance with its parking requirement under the City Code.
Section 3. Authoritv of the Citv Manager and Cite Attorney. The City Manager and City
Attorney are hereby authorized to do all things necessary to effectuate this Resolution.
Section 4. Effective Date. This Resolution shall become effective upon adoption.

RECOMMENDATION:
This Resolution is presented for your consideration.
REASONS:
Arie Sunny Isles Inc. developers of One Netanya, approved project under
Resolution 09 -Z -119 adopted November 19, 2009, have commenced the building
permitting phase_ at. 323- Sunny Isles Boulevard. During this process, they
encountered some issues and they have been obligated to modify certain aspect
of their structure. These modifications resulted on losing two (2) parking spaces
at their garage. Therefore, the owner is requesting to contribute to the Public
Parking Bonus Program under Section 265 -37 F. (1) (g) for the two (2) required
parking spaces in the total amount of $40,000 in order to satisfy the parking
requirement of the project.
