A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING
A REQUEST SUBMITTED BY LPLA PARTNERS, LP TO
USE THE LOT AT THE REAR OF THE WALGREENS
LOCATED BETWEEN 174TH STREET AND 175TH STREET
FOR TEMPORARY PARKING FOR CONSTRUCTION
WORKERS; ESTABLISHING CONDITIONS FOR THE USE
OF THE LOT FOR TEMPORARY PARKING; PROVIDING
THE CITY MANAGER AND CITY ATTORNEY WITH THE
AUTHORITY TO DO ALL THINGS NECESSARY TO
EFFECTUATE THIS RESOLUTION.; PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, on or about May 7, 2013, LPLA Partners, LP ("Applicant") submitted an
application to the City of Sunny Isles Beach. Florida requesting the use of the lot at the rear of
Walgreens located between 174th Street and 175th Street for temporary parking for construction
workers: and
WHEREAS. the City Commission wishes to approve the use of the lot at the rear of
Walgreens for temporary parking lot and permit temporary egress and ingress through the City
parking lot located at 175 Street.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Incorporation of Recitals. The foregoing recitals are true and correct and are
incorporated herein by reference as if they are fully set forth herein.
Section 2. Temporary Use. Pursuant to Section 265-14 of the City Code. the City
Commission hereby approves subject to the conditions below the temporary use application
submitted by LPLA Partners. LP to use the Walgreens' rear lot for temporary parking for
construction workers for a period of time not to exceed April 30, 2015. The City Commission
hereby further approves the use of the public parking lot located on 175 Street for egress and
ingress to the Walgreens' rear lot.
Section 3. Conditions of Approval. The Applicant is required to comply with the following
conditions:
1. The temporary parking lot at the Walgreens' rear lot located between 174th Street and
175th Street shall be fenced to serve only employees of the Applicant or its
construction company and egress and ingress shall not be provided through the
Walgreens' main lot.
2. The Applicant's use of the City's parking lot for egress and ingress purposes shall not
interfere with the existing public use of the parking lot.
3. No later than May 31, 2015, the Applicant at its own expense shall restore the City's
parking lot to its original condition prior to the use the City's parking lot for egress
and ingress purposes.
4. The use of the Walgreens' rear lot shall not interfere with the sixty-six (66) parking
spaces that are available for use by customers of Walgreens.
5. The Applicant will provide to the City the amount of Fifteen Thousand Dollars
($15,000) for the use of the City's parking lot for egress and ingress purposes. The
amount of $15,000 shall be paid within five (5) business days of approval of this
Resolution.
Section 4. Authority of the City Manager and City Attorney. The City Manager and City
Attorney are hereby authorized to do all things necessary to effectuate this Resolution.
Section 5. Effective Date. This Resolution shall become effective upon adoption.

Re: Letter of Intent- Temporary Construction Parking
Dear Claudia,
To recap our meeting on May 2, 2013, with Mr. Russo and Mr. Parker about the temporary
parking located at 210 175th Terrace (west of Walgreen's and south of the public parking
lot); we will install a temporary access road through the city owned parking lot, currently
being leased by Coastal Construction for their construction trailer and parking for the -
Mansions at Acqualina project. We will need to remove some landscape materials to build
the new access road and install a gate in the aluminum black picket fence close to the
existing construction trailer. We will also fence off the new parking area.
We also formally request the temporary use of the west parking area of this lot for parking
for the workers on the Mansions at Acqualina project. We will prepare that area to safely
serve this purpose by installing site fencing and providing site security.
The schedule completion date of the Mansions at Acqualina project is April 2015. Once this
project is completed and we are finished using these areas,we will restore them to their
original design. As for the city parking lot; when the construction trailer is removed, LPLA
Partners, LP will patch the asphalt and re-seal or re-strip the entire city lot.
In addition, LPLA Partners, LP will donate$15,000 of voluntary mitigation to the City of
Sunny Isles Beach for cultural purposes.

MEMORANDUM

RE: Request from LPLA Partners, LP for a Temporary Use and
Access to a Parking Lot.
RECOMMENDATION:
Adopt the Resolution approving the request from LPLA Partners, LP for the
temporary use and access to a parking lot.
REASONS:
LPLA Partners, LP ("Applicant") has requested approval for the temporary use
and access to the parking lot located at the rear of the Walgreen's of 17534
Collins Avenue. The parking lot will be accessed through the City parking lot
located at 175th Street. The Applicant agrees to the conditions stipulated under
the attached Resolution such as, parking lot fencing, not interference with
existing public use of City parking lot, Walgreen's parking requirement shall not
be affected, and to a fee of $15,000 for the use of the City's property. Also, the
Applicant agrees to restore the City parking lot, fence, landscaping, and any
other improvements no later than May 31, 2015.
