HomeMy WebLinkAboutReso 2013-2061 RESOLUTION NO. 2013 - 20(„I • A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING THE THIRD AMENDMENT TO AGREEMENT WITH BEISWENGER, HOCH AND ASSOCIATES, INC. (BH&A), TO PROVIDE POST DESIGN SERVICES FOR THE SUNNY ISLES BEACH/NEWPORT FISHING PIER, IN AN AMOUNT NOT TO EXCEED FIFTEEN THOUSAND DOLLARS (S15,000.00), ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on March 17; 2011 via Resolution No. 2011-1693, the City Commission ratified an Agreement with Beiswenger, Hoch and Associates to provide post design services for the Sunny Isles Beach Pier a/k/a Newport Fishing Pier located at 16701 Collins Avenue, in a total amount not to exceed Forty-One Thousand Dollars ($41,000.00); and WHEREAS, on May 10, 2012 via Resolution No. 2012-1911, the City Commission approved the First Amendment to Agreement with Beiswenger, Hoch and Associates, Inc., to provide post design services for the Sunny Isles Beach/Newport Fishing Pier, in an amount not to exceed Eleven Thousand Three Hundred Thirty-Seven Dollars and Fifty Cents ($11,337.50), for a total contract amount of Fifty-Two Thousand Three Hundred Thirty-Seven Dollars and Fifty Cents ($52,337.50); and WHEREAS, on June 21, 2012 via Resolution No. 2012-1923. the City Commission approved the Second Amendment to Agreement with Beiswenger, Hoch and Associates, Inc., to provide post design services for the Sunny Isles Beach/Newport Fishing Pier, in an amount not to exceed Seven Thousand Three Hundred Ten Dollars ($7,310.00), bringing the total contract amount to Fifty-Nine Thousand Six Hundred Forty-Seven Dollars and Fifty Cents ($59,647.50); and WHEREAS, the City now desires to approve the Third Amendment with BH&A and their sub-consultants for post design services for the Sunny Isles Beach/Newport Pier Project; and WHEREAS, Beiswenger, Hoch and Associates has expressed their ability and desire to provide these services subject to the terms and conditions contained within the Third Amendment to Agreement, and submitted a proposal to provide these services for the Sunny Isles Beach/Newport Pier Project; and WHEREAS, the City wishes to approve the Third Amendment to Agreement with Beiswenger. Hoch and Associates to provide post design services for the Sunny Isles Beach/Newport Fishing Pier, in an amount not to exceed Fourteen Thousand Two Hundred Fifty Dollars ($14,250.00), and an additional Seven Hundred Fifty Dollars ($750.00) for any incidentals that may come up for a total amount not to exceed Fifteen Thousand Dollars, ($15,000.00), attached hereto as Exhibit "A", bringing the total amount of this contract to Seventy-Four Thousand Six Hundred Forty-Seven Dollars and Fifty Cents ($74,647.50). Approving the Third Amendment to Agreement. The Third Amendment to Agreement with Beiswenger. Hoch and Associates, Inc., to provide post design services for the Sunny Isles Beach Newport Fishing Pier, in an amount not to exceed Fifteen Thousand Dollars (S15,000.00), attached hereto as Exhibit "A", be and the same, is hereby approved. Section 2. Authorization of Mayor. The Mayor is hereby authorized to execute said Agreement. Section 3. Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate this Resolution. Section 4. Effective Date. This Resolution will become effective upon adoption. PASSED AND. CONTRACT NO. C1213-028 This Third Amendment to the Agreement between the City of Sunny Isles Beach and Beiswenger. Hoch and Associates, Inc., executed this 16th day of May, 2013, is made a part of the original Agreement, C1011-031 ("Agreement"), approved by Resolution No. 2011-1693 on March 17, 2011 and incorporated herein by reference, between the City of Sunny Isles Beach ("City") and Beiswenger, Hoch and Associates, Inc. ("Consultant") a business corporation licensed in the State of Florida. whose Federal Identification II is 59.0751610. The City and Consultant hereby agree as follows: 1. ADDITIONAL SERVICES TO BE PERFORMED. The scope of services, as set forth in Section 2 of the original Agreement, is hereby amended to include the Third Revision to Sunny Isles Beach Pier & Restaurant as more particularly described in Attachment "A", which is attached hereto and incorporated herein by reference. 2. COST. The payments to the Consultant, as set forth in Section 4 of the original Agreement, is hereby amended to include additional compensation for the additional services to be performed, in an amount not to exceed Fifteen Thousand Dollars ($15,000.00), bringing the total contact amount not to exceed Seventy Four Thousand Six Hundred Forty Seven Dollars And Fifty Cents ($74,647.50). 3. OTHER PROVISIONS REMAIN IN EFFECT: Except as specifically modified herein, all terms and conditions of the original Agreement between the parties, dated March 17, 2011, and the First and Second Amendment thereto shall remain in full force and effect. Russo, City Manager DATE: 5/16/2013 RE: A Resolution Approving theThird Amendment to Agreement with BHA, Inc. for Professional Services for the Newport Pier Project RECOMMENDATION: We recommend the City Commission approve the attached Resolution. REASONS: Previously the City Commission voted and approved a modification to the construction contract to include both City and private partner requested modifications made after construction began. The increase in time in the construction contract directly impacted the professional services being performed to manage this contract by also extending their duration. Previously the City contracted directly with Beiswenger, Hoch & Associates, Inc. (BHA) to act as the engineer of record for the duration of the project. The requested change order from BHA is to extend their services through the end of the project, which was extended by the construction change order by 142 calendar days.
