Summary Minutes: Regular City Commission Meeting September 19,2013 City of Sunny Isles Beach,Florida <br /> 7. ORDINANCES FOR FIRST READING <br /> 7A. An Ordinance of the City of Sunny Isles Beach,Florida,Granting to Peoples Gas System,a <br /> Division of Tampa Electric Company, a Florida Corporation its Successors and <br /> Assigns, a Non-Exclusive Natural Gas Franchise Agreement to Use the Public Rights- <br /> of-Way of the City of Sunny Isles Beach, Florida, and Prescribing the Terms and <br /> Conditions Under which Said Franchise May be Exercised; Making Findings; Providing for <br /> Acceptance;Providing for Severability; Providing for an Effective Date;and Repealing Prior <br /> Ordinance. <br /> Action: City Clerk Hines read the title, and City Attorney Ottinot reported noting this is a <br /> renewal of the Franchise Agreement under the same terms as the previous Agreement. This <br /> Agreement will require Peoples Gas to Pay the City 6% of its gross sales in order to use the <br /> City street to operate the Franchise Agreement. Mayor Edelcup noted this is a 1 0-year term, <br /> and City Attorney Ottinot said that is correct with an option for renewal. <br /> Public Speakers: None <br /> Commissioner Scholl moved and Vice Mayor Aelion seconded a motion to approve the <br /> proposed Ordinance on first reading. The motion was approved by a roll call vote of 5- <br /> 0 in favor. Second reading,public hearing will be held on Thursday,October 17,2013, <br /> at 6:30 p.m. <br /> Vote: Commissioner Gatto yes <br /> Commissioner Levin yes <br /> Commissioner Scholl yes <br /> Vice Mayor Aelion yes <br /> Mayor Edelcup yes <br /> 7B. An Ordinance of the City Commission of the City of Sunny Isles Beach,Florida,Amending <br /> Section 197-18 of the City Code to Prevent Illegal Surcharge for Use of Credit Card by <br /> Consumers; Providing for Severability; Providing for Repeal of Conflicting Provisions; <br /> Providing for Inclusion in the Code; and Providing for an Effective Date. <br /> Action: City Clerk Hines read the title, and Commissioner Gatto reported noting this is a <br /> gentle reminder to our retailers that it is against the law to put any kind of surcharge on a <br /> purchase using a credit card or debit card. This is basically a consumer protection item,and <br /> we have a lot of visitors coming to Sunny Isles Beach that do not know Florida law and could <br /> be subject to the surcharge. <br /> Public Speakers: None <br /> Commissioner Scholl moved and Vice Mayor Aelion seconded a motion to approve the <br /> proposed Ordinance on first reading.
