Judicial Circuit in and for Broward County/ Florida, in Josue Hernandez, individually v. City ofHallandale Beach, a Florida municipal corporation, Edward Alexander Dion, individually, andVennie Lynn Whitfield, individually. Case No. CACE15021372. The dispute in this matterinvolved the representation of the City of Hallandale Beach and a former police officer of theCity, arising out of a traffic stop. The matter was tried in the United States District Court of theSouthern District of Florida/ CASE NO. 12-CV-61175-WILLIAMS/SELTZER, and the jury found infavor of the plaintiff that on his claims for false arrest, malicious prosecution, excessive forceand battery against Mr. Hernandez and for the City on the remaining claims. Thereafter,plaintiff filed a Motion for Attorney's Fees and Costs, which Mr. Dion defended on behalf of theCity and Mr. Hernandez. The City thereafter took the position that it was not liable forattorney's fees because the jury had found that Mr. Hernandez violated the plaintiff's civilrights. Mr. Dion immediately moved to withdraw due the conflict of interest and that motionwas immediately granted. Mr. Hernandez subsequently filed an action against the City, Mr.Dion and the City Attorney, claiming malpractice.
