City of Sunny Isles Beach |Request for Qualifications No. 19‐02‐02 16 <br />for projects issued; and shall comply with all laws, ordinances, regulations and building code <br />requirements applicable to the work contemplated herein. Damages, penalties and or fines <br />imposed on the City or the vendor for failure to obtain required licenses, permits or fines shall be <br />borne by the vendor. City of Sunny Isles Beach representatives reserve the right to demand safe <br />working loads, deny installation, demand removal of questionable equipment and/or require <br />appropriately qualified personnel to install or remove such equipment. <br />2.16 DEFICIENT WORK BY VENDOR <br />The Vendor selected shall promptly correct any apparent and latent deficiencies and/or defects in <br />work, and/or any work that fails to conform to the City’s documents regardless of project <br />completion status. All corrections shall be addressed immediately and mitigated after such rejected <br />defects, deficiencies, and/or non-conformances are verbally reported to the awarded vendor by <br />the City's project administrator, who may confirm all such verbal reports in writing. The awarded <br />vendor shall bear all costs of correcting such rejected work. If the awarded vendor fails to correct <br />the work within the period specified in the notice, the City shall place the vendor in default, obtain <br />the services of another vendor to correct the deficiencies, and charge the incumbent vendor for <br />these costs; either through a deduction from the final payment owed to the vendor or through <br />invoicing. If the vendor fails to honor this invoice or credit memo, the City may terminate the <br />vendor from the contract for default. <br />2.17 TERMINATION FOR CONVENIENCE <br />This agreement may be terminated immediately by the City without cause upon written notice to <br />the Contractor. In the event of such, a termination without cause, the Contractor shall be <br />compensated for all services performed to the City’s satisfaction and prior to termination. <br />2.18 PROTECTION OF PROPERTY <br />The vendor shall take extra precaution to protect all property while conducting services. Any <br />damage done by the vendor to City property shall be corrected to its original or better state, and <br />shall be corrected to the satisfaction of the Contract Manager or designee. <br />2.19 RELEASE OF LIABILITY <br />The Respondent shall release and discharge the City of Sunny Isles Beach from any and <br />all liability for loss of merchandise, goods, equipment or other property of the respondent or his <br />agents if lost, damaged, or destroyed by fire, theft, rain, water, storm, riot, civil <br />disobedience, vandalism, or any other cause(s). <br />2.20 PROHIBITION AGAINST CONTRACTING WITH SCRUTINIZED COMPANIES <br />Pursuant to Florida Statutes Section 217.4725, contracting with any entity that is listed on the <br />Scrutinized Companies that Boycott Israel List or that is engaged in the boycott of Israel is <br />prohibited. Contractors must certify that the company is not participating in a boycott of Israel. <br />Any contract for goods or services of One Million Dollars ($1,000,000) or more shall be
