All variations of the proposed <br /> substitute from that specified will be identified in the application and available maintenance, repair <br /> and replacement service will be indicated. The application will also contain an itemized estimate of <br /> all costs that will result directly or indirectly from acceptance of such substitute, including costs of <br /> redesign and claims of other Contractor's affected by the resulting change, all of which shall be <br /> considered by firm in evaluating the proposed substitute. Firm may require Contractor to furnish <br /> at Contractor's expense additional data about the proposed substitute. <br /> If a specific means, method, technique, sequence or procedure of construction is indicated in or <br /> required by the Contract Documents, Contractor may furnish or utilize a substitute means, method, <br /> sequence, technique or procedure of construction acceptable to firm, if Contractor submits <br /> sufficient information to allow firm to determine that the substitute proposed is equivalent to that <br /> indicated or required by the Contract Documents. Firm will be allowed a reasonable time within <br /> which to evaluate each proposed substitute. The firm will be the sole judge of acceptability, and <br /> no substitute will be ordered, installed or utilized without Firm's prior written acceptance, which <br /> will be evidenced, by either a Change Order or an approved Shop Drawing. Owner may require <br /> Contractor to furnish at Contractor's expense a special performance guarantee or other surety with <br /> respect to any substitute. <br /> 2.33 CLEAN-UP <br /> All unusable materials and debris shall be removed from the premises at the end of each workday, <br /> and disposed of in an appropriate manner. No equipment, material, debris, trailers or other items <br /> may be stored in any location outside of the provided construction easements without written <br /> approval from the City and the property owner. Upon completion, the Contractor shall thoroughly <br /> clean up all areas where work has been involved as mutually agreed with the City. <br /> 2.34 USE OF PREMISES <br /> Contractor shall confine construction equipment, the storage of materials and equipment and the <br /> operations of Workers to the Project site and areas identified in and permitted by the Contract <br /> Documents and other land and areas permitted by laws and regulations, rights-of-way, permits <br /> and easements and shall not unreasonably encumber the premises with construction equipment or <br /> other materials or equipment. Contractor shall assume full responsibility for any damage to any <br /> such land or area, or to the owner or occupant thereof or of any land or areas contiguous thereto, <br /> resulting from the performance of the Work. Should any claim be made against OWNER or FIRM <br /> by any such owner or occupant because of the performance of the Work, Contractor shall promptly <br /> attempt to settle with such other party by agreement or otherwise resolve the claim. The general <br /> indemnification provided elsewhere in this Contract specifically applies to claims arising out of <br /> CONTRACTOR'S use of the premises. <br /> 2.35 DAMAGE TO PUBLIC OR PRIVATE PROPERTY <br /> If property (public or private) is damaged while contractor is performing work specified or is <br /> removed for the convenience of the work, it shall be repaired or replaced at the expense of the <br /> contractor in a manner acceptable to the City prior to the final acceptance of the work.
