CM'.of su$14 1a. provisions of any other direct Contract with Owner for Work on the Project) to adapt the design to',;,r '', the proposed substitute and whether or not incorporation or use of the substitute in connection with the Work is subject to payment of any license fee or royalty. All variations of the proposed substitute from that specified will be identified in the application and available maintenance, repair and replacement service will be indicated. The application will also contain an itemized estimate of all costs that will result directly or indirectly from acceptance of such substitute, including costs of redesign and claims of other Contractor's affected by the resulting change, all of which shall be considered by firm in evaluating the proposed substitute. Firm may require Contractor to furnish at Contractor's expense additional data about the proposed substitute. If a specific means, method, technique, sequence or procedure of construction is indicated in or required by the Contract Documents, Contractor may furnish or utilize a substitute means, method, sequence, technique or procedure of construction acceptable to firm, if Contractor submits sufficient information to allow firm to determine that the substitute proposed is equivalent to that indicated or required by the Contract Documents. Firm will be allowed a reasonable time within which to evaluate each proposed substitute. The firm will be the sole judge of acceptability, and no substitute will be ordered, installed or utilized without Firm's prior written acceptance, which will be evidenced, by either a Change Order or an approved Shop Drawing. Owner may require Contractor to furnish at Contractor's expense a special performance guarantee or other surety with respect to any substitute. 2.33 CLEAN-UP All unusable materials and debris shall be removed from the premises at the end of each workday, and disposed of in an appropriate manner. No equipment, material, debris, trailers or other items may be stored in any location outside of the provided construction easements without written approval from the City and the property owner. Upon completion, the Contractor shall thoroughly clean up all areas where work has been involved as mutually agreed with the City. 2.34 USE OF PREMISES Contractor shall confine construction equipment, the storage of materials and equipment and the operations of Workers to the Project site and areas identified in and permitted by the Contract Documents and other land and areas permitted by laws and regulations, rights-of-way, permits and easements and shall not unreasonably encumber the premises with construction equipment or other materials or equipment. Contractor shall assume full responsibility for any damage to any such land or area, or to the owner or occupant thereof or of any land or areas contiguous thereto, resulting from the performance of the Work. Should any claim be made against OWNER or FIRM by any such owner or occupant because of the performance of the Work, Contractor shall promptly attempt to settle with such other party by agreement or otherwise resolve the claim. The general indemnification provided elsewhere in this Contract specifically applies to claims arising out of CONTRACTOR'S use of the premises. 2.35 DAMAGE TO PUBLIC OR PRIVATE PROPERTY If property (public or private) is damaged while contractor is performing work specified or is removed for the convenience of the work, it shall be repaired or replaced at the expense of the contractor in a manner acceptable to the City prior to the final acceptance of the work.
