Precautions shall be exercised at all times for the <br /> protection of persons and property. All services performed under this contract shall conform to all <br /> relevant regulations as prescribed in the current edition of the Manual of Uniform Traffic Control <br /> Devices (MUTCD), the Florida Department of Transportation's Design Standards (DS) and OSHA <br /> during the course of such effort. Where requirements vary or conflict, the more stringent shall <br /> apply. Any fines levied by the above mentioned authorities for failure to comply with these <br /> requirements shall be borne solely by the Contractor. <br /> 2.39 APPLICATION FOR PROGRESS PAYMENT MATERIAL AND EQUIPMENT <br /> At least ten (10) days before each progress payment is scheduled (but not more often than once <br /> a month), Contractor shall submit to architect and project manager for review an Application for <br /> Payment filled out and signed by Contractor if payment is requested on the basis of materials and <br /> equipment not incorporated in the Work but delivered and suitably stored at the site or at another <br /> location agreed to in writing, the Application for Payment shall also be accompanied by a bill of <br /> sale, invoice or other documentation warranting that OWNER has received the materials and <br /> equipment free and clear of all liens, charges, security interests and encumbrances (which are <br /> hereinafter in these Construction Services General Conditions referred to as "Liens") and evidence <br /> that the materials and equipment are covered by appropriate property insurance and other <br /> arrangements to protect City's interest therein, all of which will be satisfactory to City.The amount <br /> of retainage with respect to progress payments will be as stipulated in the Agreement. <br /> 2.40 CORRECTION OR REMOVAL OF DEFECTIVE WORK <br /> If required by City, Contractor shall promptly, as directed and at its sole expense, either correct all <br /> defective Work,whether or not fabricated, installed or completed,or, if the Work has been rejected <br /> by City, remove it from the site and replace it with non-defective Work. Contractor shall bear all <br /> direct, indirect and consequential costs of such correction or removal (including but not limited to <br /> fees and charges of engineers, architects, attorneys and other professionals) made necessary <br /> thereby. <br /> 2.41 TEST AND INSPECTIONS <br /> Owner and architect with jurisdiction over the project shall have access at all times to the work, <br /> whether the work is being performed on or off the project site, for their observation inspection and <br /> testing. Contractor shall provide proper, safe conditions for such access. Contractor shall provide <br /> owner with timely notice of readiness of the work for all required inspections, test or approvals. <br /> Contractor shall assume full responsibility, pay all costs in connection therewith and furnish <br /> Architect the required certificates of inspection, testing or approval for all materials, equipment or <br /> the Work or any part thereof unless otherwise specified herein. <br /> 2.42 CHANGE ORDER <br /> n <br /> ,' -.
