.by the Contractor to strictly comply with the provisions of this Paragraph 7.8 shall constitute a • <br /> material breach of this Contract. <br /> The Contracttor:;within fifteon.(.15)days of cornmencingthe Work;shalt s,.ib t to.: - <br /> the City and the Engineer / Architect for their information, an anticipated monthly draw <br /> schedule for the duration of the Work. If during the course of performing the Work the <br /> Contractor anticipates a substantial change in the draw schedule, the Contractor shall notify <br /> the City and the Engineer /Architect within three (3) days of anticipating such change. For <br /> purposes of this paragraph, a substantial change shall be anyincrease or decrease equaling <br /> q 9 <br /> or exceeding ten percent (10%) of any anticipated monthly draw. <br /> 7.9 The Contractor shall continuously maintain at the site, in an orderly fashion and <br /> format acceptable to the City, for the benefit of the City and the Engineer / Architect one <br /> record copy of this Contract and all Contract Documents marked to record on a current basis <br /> changes, selections and modifications made during construction. Additionally, the Contractor <br /> shall maintain at the site for the City and Engineer/Architect the approved Shop Drawings, <br /> Product Data, Samples and other similar required submittals. Upon final completion of the <br /> Work, all of these record documents shall be delivered to the City. <br /> 7.9.1 -No less than weekly, the Contractor shall conduct a Project meeting which shall <br /> include the Contractor's administrative, managerial and supervisory rY personnel and <br /> representatives of each subcontractor working on the Project site. The meeting shall address, <br /> but shall not be limited to, the current status of the Work, including the current Project <br /> schedule and the existence of any defective or deficient work as well as the appropriate action <br /> required to correct or replace such work. The City and the Engineer/Architect shall have the <br /> right, but not the duty, to attend such weekly meetings. The Contractor shall maintain detailed <br /> minutes of each such weekly meetings and shall distribute typewritten copies of such minutes <br /> to the City and the Engineer/Architect no later than the close of the next workday following <br /> completion of such meeting. The Contractor shall further require its General Superintendent <br /> to maintain a daily job diary which shall include for each work day the daily weather <br /> conditions, the identity of each subcontractor working on the site, the manpower of each <br /> subcontractor working on the site, the identity of all visitors to the Project site, documentary <br /> progress photographs, and any and all other information reflecting any delays, hindrances, <br /> interferences, or other problems encountered or incurred on the Project site. Each week the <br /> Contractor shall furnish to the City and the Engineer / Architect on a weekly basis full and <br /> complete copies of said daily job diary. <br /> 7.10 Shop Drawings, Product Data and Samples <br /> 7.10.1 Shop Drawings,s, Product Data, Samples and other submittals from the <br /> Contractor do not constitute Contract Documents. Their purpose is merely to demonstrate the <br /> manner in which the Contractor intends to implement the Work in conformance with <br /> information received from the Contract Documents. <br /> 7.10.2 The Contractor shall not perform any portion of the Work requiring submittal and <br /> review of Shop Drawings, Product Data or Samples unless and until such submittals shall <br /> have been approved by the Engineer / Architect. Approval by the Engineer / Architect, <br /> however shall not be evidence that Work installedconf conforms thereto <br /> p o s w'ith the <br /> requirements of this Contract. <br /> 7.10.3 The Contractor shall maintain a log of all Shop Drawings, Product Data and <br /> Samples submitted to the Engineer / Architect and the City including, but not limited to, <br /> 20 <br />
