identification of the item of work according;to appropriate specification section; date of:receipt:. <br /> from appropriate subcontractor or supplier; date .of review by the Contractor; date of <br /> submission to the Engineer / Architect date of return from the Engineer / Architect date of <br /> ;return;to,!e subcontractor:or_sunp!ler;status of-eview by the.Engineer Architect-and any, <br /> required re-submittal information. A true and correct copy of this log shall be submitted with <br /> each Application for Payment and receipt of same by the Engineer / Architect shall be a <br /> condition precedent for approval of the Application for Payment. <br /> 7.11 Cleaning the Site and the Project <br /> 7.11.1 The Contractor shall keep the site reasonably clean during performance of the <br /> Work, shall remove debris, trash and garbage from the Site daily and allow no accumulation <br /> of debris, garbage or trash on the Site. Upon Final Completion of the Work, the Contractor <br /> shall clean the site and the Project and remove all waste, together with all of the Contractor's <br /> property therefrom. <br /> 7.12 Access to Work <br /> 7.12.1 The City, the Engineer / Architect and the Building Department shall have <br /> access to the Work at all times from commencement of the Work through Final Completion. <br /> The Contractor shall take whatever steps necessary to provide access when requested. <br /> 7.13 Safety <br /> 7.13.1 The Contractor shall take all reasonable precautions for safety of, and shall <br /> provide reasonable protection to prevent damage, injury or loss to, its employees on the Work <br /> and all other persons who may be affected thereby; the Work and materials and equipment to <br /> be incorporated therein; and all other property at the site or adjacent thereto including, but not <br /> limited to, trees, shrubs, lawns, walks, pavements, roadways, structures and utilities not <br /> designated for removal, relocation or replacement in the course of construction. The <br /> Contractor shall comply with all applicable laws, ordinances, rules, regulations and lawful <br /> orders of public authorities bearing on safety of persons or property or their protection from <br /> damage, injury or loss, and shall give all notices required by same; this requirement includes, <br /> but is not limited to, the United States Occupational Safety and Health Act and the Florida <br /> Trench Safety Act, Florida Statute § 553.60. <br /> 7.14 Indemnity <br /> 7.14.1 To the fullest extent permitted by law, CONTRACTOR shall indemnify and hold <br /> harmless CITY, its officers and employees, from liabilities, damages, losses and costs, including, <br /> but not limited to, reasonable attorneys' fees, to the extent caused by the negligence, <br /> recklessness or intentional wrongful misconduct of CONTRACTOR and persons employed or <br /> utilized by CONTRACTOR in the performance of this Contract. This indemnification shall survive <br /> the term of this Contract. <br /> 7.15 Value Engineering Incentive <br /> 7.15.1 The City encourages the Contractor to make timelyvalue engineering and cost <br /> 9 9 <br /> savings recommendations. In the event the City approves by duly executed change order any <br /> value engineering or cost savings recommendation of the Contractor, and in the further event <br /> the Contract Sum is reduced thereby, any savings shall be shared with Seventy-Five Percent <br /> (75%) being allocated to the City and Twenty-Five Percent (25%) being allocated to the <br /> 21 <br />
