<br />City of Sunny Isles Beach | RFP Bella Vista Park Dock Reconstruction 19-07-01 11 <br /> <br /> An entity or affiliate who has been placed on the discriminatory vendor list may not submit a Bid <br /> on a Contract to provide goods and services to a public entity, may not submit a Bid on a <br /> Contract with a public entity for the construction or repair of a building or public work, may not <br /> submit Bids on leases of real property to a public entity, may not award or perform work as a <br /> contractor, supplier, subcontractor or consultant under any Contract with any public entity, and <br /> may not transact business with any public entity. <br />2.5 EQUAL EMPLOYMENT OPPORTUNITY <br /> Contractor shall not discriminate against any employee or applicant for employment because <br /> of race, religion, age, color, sex or national origin, or physical or mental handicap, or marital <br /> status. Contractor shall take affirmative action to ensure that applicants are employed, and <br /> that employees are treated during their employment without regard to their race, religion, <br /> age, color, sex or national origin, or physical or mental handicap, or marital status. Such actions <br /> shall include, but not be limited to the following: employment, upgrading, demotion, or <br /> transfer, recruitment or recruitment advertising, layoff or termination, rates of pay or other forms <br /> of compensation; and selection for training, including apprenticeship. <br /> <br />2.6 PRICE <br />If a Proposal is awarded a contract under this solicitation, the Price shall remain fixed and firm <br />during the contract term. Contractor shall be responsible for mobilization and demobilization of <br />labor, permits, materials and equipment. Payment for mobilization and demobilization will be <br />included in the lump sum price indicated in the RFP. Pricing shall include such amounts, as proposer <br />deems proper, for all labor, materials, supplies, equipment, subcontractors, insurance, bonds, <br />overhead, profit and any other costs to provide the Services as noted in this Request for Proposal. <br /> <br />2.7 PERFORMANCE AND PAYMENT BOND <br /> <br />The City of Sunny Isles Beach shall require the successful proposer to furnish a Performance Bond <br />and Payment Bond in the amount of 100% of the total Bid Price, with the City of Sunny Isles Beach <br />as the Obligee, as security for the faithful performance of the Contract and for the payment of all <br />persons performing labor or furnishing materials in connection herewith within ten (10) calendar <br />days after issuance of the Notice of Award by the City. The Performance and Payment Bond shall <br />continue in effect through the contract term. The bonds shall be with a surety company authorized <br />to do business in the State of Florida and having been in business with a record of successful <br />continuous operation for at least five (5) years. <br /> <br /> The Performance Bond shall guarantee all work and materials furnished under the <br /> Contract including losses resulting from defects in the materials or improper performance <br /> of Work under the Contract that may appear or be discovered during performance of the Work or <br /> during any applicable warranty period after completion of all Work, and for latent defects, <br /> during the time periods set forth in section 95.11(3)(c), Florida Statutes. The Payment Bond shall <br /> stay in effect until the time required by section 255.05, Florida Statutes, for the making of <br /> claims under such Bond, or when all claimants submitting valid claims have been paid, whichever <br /> is later. <br /> <br />
