A Resolution of the City Commission of the City of Sunny Isles Beach,Florida,Approving a <br /> Waiver and Release Agreement between the City of Sunny Isles Beach and Lukes' <br /> Landscaping,Inc.d/b/a Lukes-Sawgrass Landscape,Inc.in Substantially the Same Form <br /> Attached Hereto as Exhibit"A"; Providing the City Manager and the City Attorney with the <br /> Authority to Do All Things Necessary to Effectuate this Resolution; Providing for an <br /> Effective Date. <br /> Action: City Clerk Hines read the title, and Deputy City Attorney Fernando Amuchastegui <br /> reported this is related to disputed landscape maintenance invoices submitted to the City <br /> between 2009 and 2010 which totaled approximately$300,000.00. The City is requesting to <br /> settle the invoices for $150,000.00. <br /> Public Speakers: None <br /> Commissioner Scholl moved and Commissioner Gatto seconded a motion to approve the <br /> resolution. Resolution No. 2014-2203 was adopted by a voice vote of 5-0 in favor. <br /> 10V. A Resolution of the City Commission of the City of Sunny Isles Beach,Florida,Approving a <br /> Fourth Amendment to the Agreement between the City of Sunny Isles Beach and <br /> Lukes' Landscaping, Inc. d/b/a Lukes-Sawgrass Landscape, Inc. for Citywide <br /> Landscaping Services in Substantially the Same Form Attached Hereto as Exhibit "A"; <br /> Providing the City Manager and the City Attorney with the Authority to Do All Things <br /> Necessary to Effectuate this Resolution; Providing for an Effective Date. <br /> Action: City Clerk Hines read the title, and Deputy City Attorney Fernando Amuchastegui <br /> reported noting that the Agreement requires a Performance and Payment Bond for 100%of <br /> the total recurring services. The City wishes to waive the Performance and Payment Bond <br /> requirement which would result in a cost savings to the City. <br /> Public Speakers: None <br /> Mayor Edelcup asked how much the cost savings would be, and Assistant City Manager <br /> Evans said about $22,000.00. <br /> Commissioner Gatto moved and Commissioner Scholl seconded a motion to approve the <br /> resolution. Resolution No. 2014-2204 was adopted by a voice vote of 5-0 in favor. <br /> 10W. A Resolution of the City Commission of the City of Sunny Isles Beach, Florida, Opposing <br /> the Passage of House Bill 703 Preempting Local Government Authority to Protect <br /> Wetlands,Springs and Regulate Stormwater Runoff;Further Opposing the Passage of <br /> House Bill 7023 Preempting Local Government Authority to Apply Impact Fees to New <br /> Commercial Developments; Urging the Florida Legislature Not to Pass Such Legislation; <br /> Providing the City Manager With the Authority to Do All Things Necessary to Effectuate <br /> this Resolution; Providing Directive to the City Clerk; Providing for an Effective Date. <br /> Action: City Clerk Hines read the title, and Mayor Edelcup reported. <br /> Public Speakers: None <br /> 12 <br />
