<br />CITY OF SUNNY ISLES BEACH |INVITATION TO BID NO. 19-08-01 15 <br /> <br />correct the work within the period specified, the City may, at its discretion, notify the Contractor, <br />in writing, that the Contractor is subject to contractual default provisions if the corrections are <br />not completed to the satisfaction of the City within two (2) business day of receipt of the notice. <br />If the Contractor fails to correct the work within the period specified in the notice, the City may <br />place the Bidder in default. <br /> <br />2.18 LABOR, MATERIALS, AND EQUIPMENT SHALL BE SUPPLIED BY THE PROPOSER <br /> <br />Unless otherwise provided in Section 3 (entitled "Technical Specifications"), of this solicitation the <br />Proposer shall furnish all labor, material and equipment necessary for satisfactory contract <br />performance. When not specifically identified in the technical specifications, such materials and <br />equipment shall be of a suitable type and grade for the purpose. All material, workmanship, and <br />equipment shall be subject to the inspection and approval of the City's Project Manager. <br /> <br />2.19 WORK ACCEPTANCE <br /> <br />This project will be inspected by an authorized representative of the City. This inspection shall be <br />performed to determine acceptance of work and appropriate invoicing. <br /> <br />2.20 MAJOR SUB-CONTRACTORS: <br /> <br />The Bidder shall identify on the below questionnaire each major subcontractor it expects to <br />engage for this Contract if the work to be subcontracted is 15% or more of the bid sum or over <br />$50,000, whichever is less. The Bidder shall not change or replace a subcontractor without <br />approval by the City. No subcontractor will under any circumstances relieve the Respondent of its <br />liability and obligation under any resulting contract. Subcontractor is subject to the same <br />contractual conditions as is the Respondent. <br /> <br />2.21 DAMAGE TO PUBLIC OR PRIVATE PROPERTY <br /> <br />If property (public or private) is damaged while contractor is performing work specified or is <br />removed for the convenience of the work, it shall be repaired or replaced at the expense of the <br />contractor in a manner acceptable to the City prior to the final acceptance of the work. <br />Contractor will be responsible for applying and securing any permits that may be required to <br />complete such repairs. Such property shall include but not be limited to: existing facilities and all <br />of its components, site amenities, concrete and/or asphalt surfaces, vehicles, structures, <br />sidewalks, curbs and gutters, driveways, utilities, etc. Contractor must provide protection <br />necessary to prevent damage to property being repaired or replaced. If the work site has any <br />pre-existing damage, the Contractor shall notify the Public Works/Capital Projects Department in <br />writing. Failure to do so shall obligate the contractor to make repairs per the above section. <br /> <br />2.22 CORRECTION OR REMOVAL OF DEFECTIVE WORK <br /> <br />If required by City, Contractor shall promptly, as directed and at its sole expense, either correct <br />all defective Work, whether or not fabricated, installed or completed, or, if the Work has been <br />rejected by City, remove it from the site and replace it with non-defective Work.
