2.10.1 Cancelllation and Ree-Insurance: <br />If any insurance should be canceeled or changged by the inssurance comppany or shoulld any <br />insurance expire duuring the periood of this conntract, the Contractor shall be responsibble for <br />securinng other acceeptable insuraance to proviide the coverrage specifiedd in this sectiion to <br />maintaain coverageduring the liffe of this Conntract. All deeductibles muust be declared by <br />the Coontractor and must be appproved by thee City. At thhe option of tthe City, eitheer the <br />Contraactor shall eliiminate or reeduce such deductible or the Contracttor shall proccure a <br />Bond,in a form sattisfactory to thhe City, coverring the samee. <br />2.11AACCIDENT PRREVENTIONN AND BARRRICADES <br />Baarricades, connes, construcction fencingand temporary constructioon fencing,pper City regulaations <br />annd other releevant requiremments, shall bbe provided bby the proposer when woork is performmed in <br />arreas traversedd by persons or when deemed necessary by the Cityy Manager or his designee at no <br />exxtra cost to tthe City. Temmporary consstruction fenccing (chain linnk – 6’ high)is required bby the <br />City and such cost of placcement shall be borne byy the proposser for any wwork that reqquires <br />deemolition andd/or requires the containmment of equippment or matterial or proteection of worrk and <br />citizens. The fence shall be covered forr dust control, shall have a windscreenn, and/or a privacy <br />sccreen as direccted by the City at the proposers sole coost. <br />Prroposer shall comply with regulationsaand permit reequirements ffor the placemment of the pproper <br />feencing. Precaautions shall be exercised at all times for the proteection of perssons and property. <br />All proposers pperforming seervices underr this contracct shall confoorm to all releevant OSHA, <br />State <br />annd City regulaations duringg the course oof such effortt. Any fines levied by thee above menttioned <br />auuthorities for failure to commply with theese requiremeents shall be borne solely by the responsible <br />prroposer. <br />2.12MMONTHLY INNVOICES PAYAYMENTS <br />Cut-off date is the close of ness day of tthe month. VVendor shall ssubmit by thee 10th <br />the last busi <br />daay of the following monthh vendor's commpleted Stateement of Servvices/Invoice. Should thee 10th <br />faall on a weekeend or holidayy, Contractor shall submit his applicatioon on the nextt workday. <br />Veendor is advissed that processing of invooices must follow this scheedule, as the CCity has funding <br />reequirements aand other payyment obligattions which mmay prevent paayment of latte Statement of <br />Seervices for that month’s billing cycle.AA late Statemeent of Servicees with a recoommendation for <br />paayment will bbe paid in the next month’ss billing cycle.. <br />2.13MMATERIALSSSHALL BE NEW AND WAARRANTED AAGAINST DEEFECTS <br />The proposer hhereby acknoowledges and agrees that all materials, except wherre recycled coontent <br />iss specifically requested,ssupplied by the proposer in conjuncction with this solicitationn and <br />reesultant contract shall bee new, warraanted for theeir merchantaability, and ffit for a partticular <br />puurpose.
