employees should not expect that their messages or data contained on any equipment are <br />personally private. The Company may engage in monitoring of electronic mail messages or <br />other electronic files created by employees. You should treat the System (including e-mail and <br />use of the Internet) with respect and only use it for official company business and in a manner <br />consistent with this policy. Even when an e-mail message is deleted, it can remain in the <br />computer's memory system and can often be retrieved at a later date. All e-mail messages and <br />other communications must be composed with the same professionalism as hard copy business <br />correspondence and when transmitting confidential client information it should be marked as <br />such. <br />Employees may not use the System to infringe the copyright or other intellectual property rights <br />of third parties, to transmit proprietary or confidential information of the Company (absent <br />permission in the performance of their duties) to view or distribute defamatory, fraudulent, <br />obscene or harassing messages, or otherwise to engage in any illegal or wrongful conduct. The <br />Company strives to maintain a workplace free of harassment and sensitive to the diversity of its <br />employees. Therefore, the Company prohibits the use of the System in ways that are disruptive, <br />offensive to others, or harmful to morale. For example, the receipt of, display or transmission of <br />sexually explicit images, messages, and cartoons is not allowed. Other misuse includes, but is not <br />limited to, ethnic slurs, racial comments, off-color jokes, or anything that may be construed as <br />harassment or showing disrespect for others. <br />Employees may not use the System to download software unless they comply with established <br />policies and check all such software for computer viruses. The unauthorized use of the System <br />for purposes of "snooping" is a violation of company policy and will be grounds for termination. <br />Unauthorized use of encryption technology to block access to any file on a company network is <br />prohibited and grounds for termination. <br />Any data stored or maintained on the System shall remain company property and must be <br />returned to the Company upon request, at any time, or upon the termination of employment <br />with the Company. Any company information and/or data saved or stored on any employee's <br />personal laptop or home computer, or otherwise, are also company property and must be <br />returned to the Company upon request, at any time, or upon the termination of employment <br />with the Company. Such use of personal or third party equipment for company business requires <br />written approval by a Officer. <br />Voicemail, electronic or instant messages, e-mails and other electronic media should only be <br />accessed by the intended recipient. Attempts to obtain unauthorized access are also <br />prohibited. Employees who improperly access another person's system will be subject to <br />discipline up to and including termination. <br />Employees must notify a member of Management upon learning of violations of this policy. <br />Employees who violate this policy will be subject to discipline up to and including termination. <br />19. INTERNET ACCEPTABLE USE POLICY <br />As a condition of providing Internet access to its employees, the Company places certain <br />restrictions on workplace use of the Internet.
