<br />City of Sunny Isles Beach |Invitation to Bid No. 20-09-01 16 <br /> <br />2.19 DISCREPANCIES <br /> <br /> Should a Bidder find discrepancies or ambiguities in, or omissions from, the Drawings or <br /> Specifications, or should they be in doubt as to their meaning, they shall at once notify the <br /> City in writing. <br /> <br />2.20 DAMAGE TO PUBLIC OR PRIVATE PROPERTY <br /> <br />If property (public or private) is damaged while contractor is performing work specified or is <br />removed for the convenience of the work, it shall be repaired or replaced at the expense of the <br />contractor in a manner acceptable to the City prior to the final acceptance of the work. Contractor <br />will be responsible for applying and securing any permits that may be required to complete such <br />repairs. Such property shall include but not be limited to: existing facilities and all of its components, <br />site amenities, concrete and/or asphalt surfaces, vehicles, structures, sidewalks, curbs and gutters, <br />driveways, utilities, etc. Contractor must provide protection necessary to prevent damage to <br />property being repaired or replaced. If the work site has any pre-existing damage, the Contractor <br />shall notify the Public Works/Capital Projects Department in writing. Failure to do so shall obligate <br />the contractor to make repairs per the above section. <br /> <br />2.21 PUBLIC RECORDS LAW <br /> <br />The City is subject to Chapter 119, Florida Statutes, “Public Records Law.” No claim of <br />confidentiality or proprietary information in all or any portion of a response will be honored unless <br />a specific exemption from the Public Law exists and is cited in the response. An incorrectly claimed <br />exemption does not disqualify the firm, only the exemption claimed. Contractor acknowledges the <br />public shall have access at all reasonable times, to all documents and information pertaining to <br />City’s contracts, subject to the provisions of Chapter 119, Florida Statutes, and agrees to allow <br />access by the City and the public to all documents subject to disclosures under applicable law. To <br />the extent that Contractor has been provided access to or has received security sensitive <br />information, as defined by Florida Statutes, Section 119.071 and/or has executed a Confidential <br />Information Acknowledgement and Agreement as part of the ITB process, Contractor shall keep <br />and maintain the security sensitive information as confidential and exempt from public disclosures <br />as required by Florida Statutes.
