SOURCEWELL <br />Book 2 — IQCC Standard Terms and Conditions and Contract General Conditions <br />SECTION TWO - CONTRACT GENERAL CONDITIONS <br />1. PROJECT MANAGER <br />Project Manager, the person or firm designated by a Sourcewell Member and authorized to <br />represent the Sourcewell Member in connection with a signed Purchase Order. <br />2. SOURCEWELL MEMBER'S RIGHT TO STOP WORK <br />The Sourcewell Member may order the Contractor to stop the Work on any Purchase Order, or any <br />portion thereof, at any time for any reason. <br />3. .SOURCEWELL MEMBER'S RIGHT TO COMPLETE WORK <br />If the Contractor has been ordered to stop the Work, the Sourcewell Member may, without <br />prejudice to other remedies, have the Work completed by any available means. <br />REVIEW OF HELD CONDITIONS <br />4.1 Before submitting a Price Proposal, the Contractor shall carefully study the Detailed Scope of <br />Work, as well as the information furnished by the Sourcewell Member, shall take field <br />measurements of any existing conditions related to the Work and shall observe any conditions <br />at the Site affecting it. Any errors, inconsistencies or omissions discovered by the Contractor <br />shall be reported promptlyto the Project Manager. <br />4.2 Any design errors or omissions noted by the Contractor during this review shall be reported <br />promptly to the Project Manager, but it is recognized that the Contractor's review is made in <br />the Contractor's capacity as a Contractor and not as a licensed design professional, The <br />Contractor is not required to ascertain that the Detailed Scope of Work is in accordance with <br />applicable laws, statutes, ordinances, building codes, and rules and regulations. However, any <br />nonconformity discovered by or made known to the Contractor shall be reported promptly to <br />the Project Manager. <br />S. SUPERVISION <br />5.1 The Contractor shall supervise and direct the performance of the Detailed Scope of Work, <br />using the Contractor's best skill and attention. The Contractor shall be solely responsible for <br />and have control over construction means, methods, techniques, sequences and procedures <br />and for coordinating all portions of the Work. If the Detailed Scope of Work gives specific <br />instructions concerning construction means, methods, techniques, sequences or procedures, <br />the Contractor shall evaluate the Site safety thereof and, except as stated below, shall be fully <br />and solely responsible for the jobsite safety of such means, methods, techniques, sequences <br />or procedures. if the Contractor determines that such means, methods, techniques, <br />sequences or procedures may not be safe, the Contractor shall give timely written notice to <br />the Project Manager and shall not proceed with that portion of the Work without further <br />written instructions from the Project Manager. <br />5.2 The Contractor shall be responsible to the Sourcewell Member for acts and omissions of the <br />Contractor's employees, Subcontractors and their agents and employees, and other persons <br />or entities performing portions of the work for or on behalf of the Contractor or any of its <br />Subcontractors. <br />15 Section Tv o — Contract General Conditions March 2019 <br />
