Section 7. Amendment to Chapter 108 of the City Code. Chapter 108 of the City Code is <br />hereby amended to read as follows: <br />Chapter 108 – BEACHES <br />ARTICLE I - Swimming or Fishing During Dangerous Water Conditions <br />§ 108-3. - Definitions. <br />The following words, terms and phrases, when used in this article, shall have the meanings <br />ascribed to them in this section, except where the context clearly indicates a different meaning. <br />CITY MANAGER — The City Manager of the City of Sunny Isles Beach. <br />(`ODE ENFORCEMENT DEPARTMENT — The Code and T :eonsing Development Services <br />Department of the City of Sunny Isles Beach. <br />§ 108-5. - Enforcement and penalties. <br />The City's redo Enf feemet4 Department shall be responsible for enforcing this article. The <br />City may impose a civil penalty of $250 for each violation. In addition, a violator may be subject <br />to arrest by the Police Department for failing to obey the red flag warning system if dangerous <br />water conditions exist and lawful order to evacuate the waters has been issued. <br />ARTICLE II - Beach Chairs <br />§ 108-8. - Definitions. <br />CODE E-NF/lD!`T7Ai ENT AND LICENSING G DEPARTMENT — The City of Sunny Isles <br />Development Services Department. <br />108-9. - Permit required. <br />It shall be unlawful for any owner, as defined in this article, to place a beach chair or equipment <br />on a publicly owned or controlled beach area within the City without first obtaining a permit. <br />A. Application. Any owner, as defined above in this article, shall apply for a permit on a form <br />prepared by the City and submit same, along with the applicable permit application fee, to <br />the Cede Enfefeeffient and bieensing Department for processing.
