E. Nothing herein shall: <br />(1) Preclude the Police Department from responding to panic or ambush alarm signals, calls <br />describing emergencies or crimes in progress, or routine calls for service; <br />(2) Limit the Code E..f_,., efne„* a„a T Teens ^n Development Services Department from <br />issuing civil violation notices for alarms in violation of this chapter; or <br />(3) Be construed to create a duty to respond in any circumstances where such a duty does <br />not exist pursuant to the statutory or common law of Florida. The chapter imposes or <br />creates no duties on the part of the City or its departments and employees, and the <br />obligation of complying with the requirements of the chapter, and any liability for failure <br />to do so is placed upon the parties responsible for owning, operating, monitoring or <br />maintaining security alarms. <br />(4) Preclude the Police Department from responding to any alarm signal at the discretion <br />of the Police Chief. <br />Section 6. Amendment to Chapter 99 of the Cites Chapter 99 of the City Code is hereby <br />amended to read as follows: <br />Chapter 99 - PUBLIC HEALTH AND SAFETY <br />ARTICLE I - E -Cigarettes; Sale of E -Cigarettes and Liquid Nicotine to Minors <br />Prohibited <br />§ 99-4. - Enforcement. <br />A. The provisions of this Article shall be enforced the City of Sunny Isles Beach Eemmunity <br />Development Services Department. <br />§ 99-6. - Possession or purchase by minors of electronic cigarettes and other electronic smoking <br />devices. <br />A. It is unlawful for any person under 18 years of age to knowingly purchase or possess an <br />electronic cigarette or other electronic smoking devices. <br />B. Any person violating Section 99-6 will be punished by a fine of $25.00 for the first offense; <br />$50.00 for the second offense and $100.00 for each subsequent offense. However, in lieu of <br />the monetary fine, a violator may elect to provide eight hours of volunteer labor services to <br />the City's Public Works or Cultural and Community Services Department. Such provision of <br />services shall be carried out under adequate supervision, with proper regard for the health and <br />safety of participants, and in accordance with applicable state and federal law. This Section <br />shall be enforced by the City's Police Department or Development Services <br />Department. <br />
