The Cicy shall upon its own <br />action or upon written request of an authorized representative of the Dt!PHrLmCnt of <br />Labor withhold or cause to be withheld, from any moneys payable on account of work <br />perrormed by the contractor or subcontractor under any such contract or any other <br />Federal contract with the same prime contractor, or any other federally -assisted contract <br />subject to the Co Work Hours itnd Safcty Standards Act, which is held by the same <br />prime contractor, such sums as may be determined to be nee.essary to satisfy fitly <br />liabilities of mc11 contractor or sttbcomractor for unpaid wvaees and liquidated damages <br />as provided in tho clause set forth in paragraph (2) of this section. <br />(4) Subcontracts. The contractor or subcontractor shall insert in any subcontracts Lhe <br />clauses set forth in paragraph (1) through (4) ol'this section and also a clause requiring <br />the sub coil tractu rs to include these clauses in any lo%vwr tier subcontracts. The prime <br />contractor shall be responsible for compliance by any subcontractor or lower tier <br />subcontractor with the clauses set north in paragraphs (1) Ihrouah {4) of this section." <br />1.18. COMPLIANCE WMI THE CO1<'1?J..AN1) ANTI -)KICKBACK ACT <br />(1) Contractor. The contractor shall comply writh J 8 U.S.C. § 874, 40 U.S.0 . § 31415, and <br />the rCgL1Ircrr1c11ts of 29 CXA. pt, 3 as may be applicable, which are incorporated by <br />rcforence into this contract_ <br />(2) Subcontracts. The contractor or suhcontractor shall insert in arty subcontracts the <br />clause above and suCll OthCr CIMISC5 as the FEMA may by appropriate instructions <br />require. and also a clause requirin3 the subcontractors to include Lhcsc clauses in any <br />lower tier subcontracts. The prime contractor shall be responsible for the comp-liancc <br />by any subcontractor or lower tier subcontractor with 311 of these contract clauses. <br />Breach. A breach of the contract clauses above, may he grounds for term ination of the <br />contract, and fen- debarnwnt as a eontrac;tor and subcontractor as provided in 29 <br />C.F.R, 5x,12, <br />1.19.
