DocuSign Envelope ID: ClAD950E-9B4C-4DE5-98D5-725EBB24CD9D <br />(c) Fraudulent practices; <br />(d) False pretenses; <br />(e) Frauds; <br />(0 Credit card crimes; <br />(g) Forgery; <br />(h) Counterfeiting; <br />(i) Violations involving checks or drafts; <br />0) Misuse of medical or personnel records; and <br />(k) Felony theft. <br />13.4 Confidentiality. <br />The Contractor must maintain confidentiality of all confidential data, files, and records <br />related to the commodities or contractual services provided pursuant to the Contract and <br />must comply with all state and federal laws, including, but not limited to sections <br />381.004, 384.29, 392.65, and 456.057, F.S. The Contractor's confidentiality procedures <br />must be consistent with the most recent version of the Department security policies, <br />protocols, and procedures. The Contractor must also comply with any applicable <br />professional standards with respect to confidentiality of information. <br />SECTION 14. WARRANTY OF CONTRACTOR'S ABILITY TO PERFORM. <br />The Contractor warrants that, to the best of its knowledge, there is no pending or <br />threatened action, proceeding, or investigation, or any other legal or financial condition, <br />that would in any way prohibit, restrain, or diminish the Contractor's ability to satisfy its <br />Contract obligations. The Contractor warrants that neither it nor any affiliate is currently <br />on the Suspended Vendor List, Convicted Vendor List, or the Discriminatory Vendor List, <br />or on any similar list maintained by any other state or the federal government. The <br />Contractor shall immediately notify the Department in writing if its ability to perform is <br />compromised in any manner during the term of the Contract. <br />SP approved version 7-1-2019 17 <br />
